I expressed to the Board that our application could be quickly modified to include all of the future access elements which were suggested so that our PUD would not preclude any of those access options. Upon modification, it would be completely compatible with the South College Access Plan and with the staff's recommendation for approval of our application. At that time, I requested that the Board review our access modifications at their next meeting as it appeared that all other elements of the PUD were acceptable, if not appealing (land use, design elements, landscapiexpressed etc) - T resserd t- the Board -hat our company already had a great deal of money invested y in developing the PUD to meet everyone's development criteria, but that we were running into contractual deadlines which we were certain would not be extended and which put our investment at risk. As you hopefully recall, I then spoke to you directly about including our revised plan at the next Board meeting as; (i) time was of the essence for our company, (ii) the Board's familiarity with our project would enable the revised plan to be reviewed expeditiously; (iii) the Board had acknowledged a willingness to have us on the November agenda. We concluded our conversation by you stating that you would review the matter and respond to us in a few days. 2121 3Oth Street • Boulder, Colorado 80301 • 303/449-6162 During the past week, we have met with Rick Ensdorff and reconfirmed that our revised access plan is acceptable and will be recommended for approval. We have also reconfirmed that our deadlines for contractual control of the project will not be extended and that our substantial investment is, indeed, at risk. Therefore, we are formally requesting that the revised access plan for the Foothills Parkway PUD be included on the Planning and Zoning Board's agenda on November 20, 1989. We intend to continue to be a responsible member of the Fort Collins business community as we have been for the last 20 years, and in that spirit, we appreciate your consideration of this request and your time spent on this matter. sincerely, Ed Massey President/CEO Round the Corner Restaurants, Inc.
