DCI Response: Noted Comment Number: 5 04/06/2021: INFORMATION: Temporary Service Changes - City of Fort Collins Development Review In order to continue providing thorough reviews and giving every project the attention it deserves, the City of Fort Collins is implementing temporary changes in how we serve our development customers. As you may be aware, we are experiencing staff shortages in a number of key departments, which has begun to impact the quality and timeliness of our reviews. We recognize that development and construction play a critical role in our community’s vibrancy and economic recovery, and we have been exploring options for mitigating impacts to our customers. As a result, we will be making some temporary service changes. Beginning Monday May 10th one additional week of review time will be added to all 1st and 2nd round submittals (increase from 3 weeks to 4 weeks). DCI Response: see redlines for additional responses Comment Number: 2 04/02/2021: FOR FINAL APPROVAL: Please see redline comments on Landscape Plan related to Coniferous Tree numbers, and landscaping area east of the building. RMS Response: Due to the utility easement along the outside of the property planting bigger evergreen trees where indicated would result in the trees overgrowing into the drive aisle. Larger limber pines have been shown on the north-east where there is more room for them. Five of the trees on the east have been updated to be evergreen to address board concerns. Due to previous comments from Forestry about spacing out proposed trees from existing trees we cannot add any additional trees. We have changed out of of the ornamental tree for another pinyon pine tree. A toal of 6 evergreen trees are now in the buffer areas. Comment Number: 3 3 04/02/2021: INFORMATION ONLY: Per our correspondence in January 2020 the proposed reductions of the building footprint and alterations to the building architecture will not constitute a formal Amendment process, and are instead being incorporated into the FDP. Staff has reviewed the changes to the building architecture and finds that it still meets the LUC standards. DCI Response: Noted Department: Engineering Development Review Contact: Spencer Smith, 970-221-6603, smsmith@fcgov.com Topic: General Comment Number: 1 04/06/2021: FOR FINAL APPROVAL: This comment is just a reminder that there is a repayment due to the City of Fort Collins for previously constructed I-25/Hwy 392 interchange improvements. I believe I provided an estimated cost of the repay in a previous comment or email. Please contact me if you would like to have the exact amount provided. DCI Response: see redlines for additional responses Comment Number: 2 04/06/2021: DEVELOPMENT AGREEMENT: A development agreement (DA) will be required for this project. Please complete and submit a development agreement information form (included in the comments/redlines for this submittal). I will need this in order to prepare the draft agreement. I will try and get a draft DA ready for review by our City Attorney by the time we issue comments on your next submittal. Once our attorney has reviewed the agreement, the draft will be provided to you for review. The DA will need to be completed prior to final approval. For more information on development agreements, please visit the City Development Review Engineering website: https://www.fcgov.com/engineering/devrev.php DCI Response: see attached agreement from Maverik Comment Number: 3 04/06/2021: DEVELOPMENT CONSTRUCTION PERMIT: A development construction permit (DCP) will be required prior to commencing construction of any public improvements. Once the plans are close to approval, we will need an engineer's opinion of cost submitted by the consulting engineer (licensed in CO). This cost estimate will be reviewed by Engineering and Engineering Inspections staff. Once approved, it will serve as the basis for Engineering inspection fees as well as public improvement surety that will be required prior to DCP issuance. A copy of the new signature block is included with these 4 comments/redlines. Please remove all of the existing City signature blocks throughout the utility plans and place the new signature block on the cover sheet only. DCI Response: Revised on cover sheet and removed signature block on all other sheets. Comment Number: 5 04/06/2021: FOR FINAL APPROVAL: There are going to be quite a few easement dedications and vacations for this site. They will need to be processed by separate instrument, which will require legal descriptions and exhibits for each, as well as deeds of dedication or vacation resolutions. We will want to see the survey documents as soon as possible once the site, utilities, etc. are pretty well set and not going to change. You will need to submit a completed TDRF application and fees for the easements ($250/dedication and $400/vacation). There is more information as well as template deeds of dedication on our website: City Development Review Engineering website: https://www.fcgov.com/engineering/devrev.php. Please note that this comment only applies to easements to be dedicated to the City of Fort Collins or City easements being vacated. Easements dedicated to or being vacated that are owned by another municipality would be handled per that entity's standards and coordinated with them. We would just need the documentation (reception #) for those dedications/vacations to be shown on the plans. DCI Response: the proposed easements are being prepared by the surveyor and will be dedicated by separate documents. An additional easement plan has been provided in the FDP plans. Comment Number: 6 04/06/2021: FOR APPROVAL: Please add additional information, details, etc. to demolition plan (see redlines). DCI Response: See redlines for additional responses Comment Number: 7 04/06/2021: FOR FINAL APPROVAL: Please add directional pedestrian ramps at the site access to the frontage road (see redlines). Also make sure to include City standard details in detail sheets. DCI Response: this comment no longer applies base on the video meeting and further discussion with Spencer. Comment Number: 8 04/06/2021: FOR FINAL APPROVAL: I'm a little unsure of what the existing easements that cross your site are. You are calling out for the temporary construction one to be dedicated by separate instrument, which doesn't make any sense. The other one is called out to be vacated by separate instrument. Who's easements are these and are there any existing improvements within them? We will need to confirm that the easement owner is approving of any vacations. The vacation information will need to be provided on the plans as well (reception #'s). DCI Response: These easements have been vacated and no longer are shown on plan set to avoid confusion. Comment Number: 9 04/06/2021: FOR FINAL APPROVAL: 5 Please try and make the proposed easement limits as clear as possible. Some of them are hard to follow due to overlapping linework and lack of dimensions, labels, etc. DCI Response: An additional easement plan has been provided in the FDP plans. Comment Number: 10 04/06/2021: FOR FINAL APPROVAL: There are some issues with the proposed grading plan. There are proposed contours shown behind the back of walk along the frontage road. The contours are too steep and there is not supposed to be any grading behind the walk. There are also spot elevations labeled that don't look correct when compared to the contours. In some cases it looks like your 2 foot max thickened edge would have to be taller if the elevations matched the contours. DCI Response: The grading has been update. The thickened edge does exceed the 2 foot limit at most by 0.5 feet. This will need to be updated to 2.5 feet max. height need for thickened edge. Comment Number: 11 04/06/2021: FOR FINAL APPROVAL: Your frontage road p&p sheets shows a horizontal as well as a vertical angle point. Since you're matching the existing frontage road alignment and profile, this doesn't seem correct. We don't want angle points in the proposed walk that don't meet standards. DCI Response: revised this linework to better represent “match existing” roadway conditions. Also added a “note” to the roadway plans. Comment Number: 12 04/06/2021: FOR FINAL APPROVAL: Please make sure that a qualified geotechnical engineer has designed and/or approved of the thickened edge along the proposed back of walk. I want to make sure that we won't have any slope or walkway/roadway stability issues with the proposed design. DCI Response: Noted. Comment Number: 13 04/06/2021: FOR FINAL APPROVAL: Please go through the City standard details and make sure that all applicable details are included in the detail sheets. It seems like some are not included that should be. DCI Response: additional details have been provided in the FDP plans. This will need to be reviewed by CDOT. Items to note, the bike lane should be signed and stenciled, with a bike lane ends sign to the north of your access. The bike lane at your access should be next to the through lane, and the right turn lane should be next to the curb. This should also have stencils. As per previous comments provided during the development review process and from the 'Prairie Dog Management Plan' provided by the applicant, a written plan of action should have been provided 1 week prior to initiation of removal activities, and a summary of actions should have been provided after completion of activities. Work was anticipated to be completed no later than March 15, 2021, two weeks prior to writing this comment. Additionally, was any attempt made to contact Rocky Mountain Raptor Program (https://www.rmrp.org/, 970-484-7756) prior to euthanization? They accept prairie dog donations year round. Copies of communications with them need to be provided. Maverik Response: see management plan Comment Number: 2 03/30/2021: FOR DCP AND DEVELOPMENT AGREEMENT: Since a humane form of fumigation is to be used (PERC) the lower payment-in-lieu fee of $3,797.08 is available. The payment-in-lieu is due prior to issuance of the DCP, and the fee and payment mechanism is required to be recorded in the Development Agreement. As of January 1st, 2021, these fees will be collected on all projects for such inspections. The Erosion Control fees are based on; the number of lots, the total site disturbance and the estimated number of years the project will be active; the Stormwater Inspection Fees are based on the number of LID/WQ Features that are designed for on this project. Based on the proposed site construction associated with this project we are assuming 1 lot, 2.89 acres of disturbance, 1 year from demo through build out of construction and an additional 3 years till full vegetative stabilization due to seeding. Which results in an Erosion Control Fee estimate of $ 1,172.09 Based on 1 extended detention and 2 sand filters/underground treatments, the estimate of the Stormwater LID/WQ Inspection fee to is $ 1,080. Please note that as the plans and any subsequent review modifications of the above-mentioned values change the fees may need to be modified. I have provided a copy of the spreadsheet used to arrive at these estimates for your review.
