When the property was annexed, a condition was put on the annexation that required all development to be done as a planned unit development (PUD) under the criteria of the Land Development Guidance System. Nicky's became a non -conforming use. When Nicky's stopped operating the restau- rant for one year, the non -conforming use right was lost. Any land use proposed for the site now, must be processed as a PUD. (Planning)
