BOX 469 ORT COLLINS, CO 80522 /_ 0 I wanted to let you know where we are with the Rohrbacker PUD. Since both Mrs. Rohrbacker and her attorney are out of town, it was not possible to arrange a closing within an acceptable timeframe to get the fencing done. Mrs. Rohrbacker has agreed to go ahead and sign the PUD documents this Friday when she returns so that the Spechts can immediately get the necessary permits to begin the fencing. The closing will then take place later in December or early January. My understanding of the agreement we reached last week in the Planning Office regarding timing of the improvements and the certificate of occupancy is as follows. The Spechts must satisfactorily complete the construction of the eight -foot wooden fence along the eastern and western boundaries of the property. They must also put up the chain link screening in the interior of the property along Magnolia Street. At that point, the City would issue a temporary certificate of occupancy upon the filing with the City of a letter of credit for 125% of the cost to complete the remaining fencing and landscaping. We estimate that the temporary certificate of occupancy would be issued in January. We would request that the temporary certificate of occupancy be valid until June 30 since it will probably be April before the remaining fencing and the landscaping can be started. Please let me know right away if you have a different understanding of the discussion or if you have any problem with the proposal. Thank you for your continuing cooperation.
