NOTICE OF APPEAL
TO: City Council
City of Fort Collins, Colorado

Fort Collins, Colorado 80521
Re: Zoning Application of Rosalie Rohrbacker
Rosalie Rohrbacker, the owner of the affected property, hereby gives
notice of appeal as to the decision of the Planning and Zoning Board which
denied the requested re -zoning for the subject property. The matter was
heard at the Board's regular meeting held Monday, March 26, 1990.
The grounds for appeal are alleged, as follows:
1. Abuse of discretion, in that its decision was arbitrary and with-
out the support of competent evidence in the record.
2. The Board considered evidence relevant to its findings which was
substantially false or grossly misleading.
3. The Board improperly failed to receive all relevant evidence offered
by the Appellant.
4. The Board received evidence regarding other properties which were
not in the City and had no relevance to the subject property or its rezoning.
5. The Board received testimony from persons who were not residents
of the annexed area or of the City of Fort Collins, nor did they own property
which would be affected by the rezoning.
The Appellant is Rosalie Rohrbacker, 430 West Myrtle Street, Fort Collins,
Colorado 80521, telephone number 482-2551, who is the owner of said property.
Appellant reserves the right to supplement this Notice of Appeal when
the record is prepared and can be reviewed by Appellant.
