In an effort to address your comments concisely and simplify your review of the I-25 Frontage Road Plans, we have summarized the CDOT comments and our responses below. COMMENT RESPONSE LETTER COMMENTS CONTAINED WITHIN 3/10/2021 EMAIL R4 Stormwater: 1. Please see attached filled out deeds. One last requirement from the CDOT side. I need to get a copy of the title commitment for the property prior to their filling out the names on the deed. We were able to trace title back to 1975. All transfers were via warranty deed. If they don't have a title commitment for the plat work they are doing, I think we are ok with the research I have done. The deed to CDOT needs to show the Grantor's name as: Poudre Valley Co-Operative Association, Inc., a Colorado Corporation Response: Acknowledged. Developer continues to coordinate dedication instruments with City and CDOT. Developer to submit the requested forms via separate email. R4 Hydraulics: 2. The City of Fort Collins pointed out a potential discontinuity between the documentation provided in the Drainage Report (dated Dec 2, 2020) and the Frontage Road Plans (dated Dec 2, 2020). The drainage report seems to indicate the work stopping at Redman Drive based on the Existing and Proposed basin delineations and grading. However, the Plan set appears to be indicating additional modifications to the Frontage Road pavement, roadside drainage, and cross-culverts which do not appear to be addressed in the Drainage Report We concur with the City's assessment that the area south of Redman should have Page 2 kimley-horn.com 4582 South Ulster Street, Suite 1500, Denver, CO 80237 303 228 2300 been included in the drainage report and brought to CDOT's attention as a referral reviewer. We recommend that these additional improvements be addressed and documented in an addendum to the report that was initially submitted to CDOT for review, or that the work south of Redman be deleted from the work and excluded from the Access permit. Please provide the modified report for our re-review, focusing specifically on any changes to the capacity of the roadside drainage and potential covering up of some cross-culverts which was not readily apparent in the initial report. Response: Correct, improvements to the Frontage Road south of Redman Drive are proposed. Revised Drainage Report included for CDOT review. COMMENTS CONTAINED WITHIN 3/3/2021 EMAIL ROW update: 1. What the City wants seems to be 6 of 1, half dozen of another. We don't want to make a mountain out of a molehill though, so we'll be flexible. We will take the direct title from the dedication. R4 will add language that it is from a development property. Currently we are going to review the legal and then we will add the required language to the deed that the property will be transferred to CDOT for $1. Response: Acknowledged. Developer continues to coordinate dedication instruments with City and CDOT. I-25 Design Residency: 1. Approved plans Response: Acknowledged. R4 Operations Engineer Comments: 1. Submittal 9 Frontage Road Plans: · use the updated S-627-1 6" standards. · ONLY stencil is needed in sheet 10/15 · Stop bar needs to be 2' wide. They don't have a width specified Response: Acknowledged. Plans updated to incorporate CDOT comments. Submittal 6 Comments: 1. Who will be maintaining the streetlights they are proposing along the frontage road? Are these needed? Response: Note added to sheet C4-0. City of Fort Collins will install and maintain streetlights. Streetlights required per City standards. 2. Streetlights should be using breakaway bases per standard attached. P 13/13 does not reflect this Response: Streetlights will be installed and maintained by the City of Fort Collins. The City will coordinate directly with CDOT regarding the correct streetlight pole and base. Page 3 kimley-horn.com 4582 South Ulster Street, Suite 1500, Denver, CO 80237 303 228 2300 3. Are there sign plans? I see mentions of relocated street signs (ie sub 9 sheet 11) but not signs being called out. Response: Refer to Sheet C5-0 and C5-1 for our Signing and Striping Plans. All signed identified on the Removal and Reset Plans have a corresponding callout location on the Signing and Striping Plans. 4. With regards to the FoCo comments- Let's ensure the S-627-1 6" standards are being used. The FoCo comments seem to be a different striping layout. Response: Acknowledged. CDOT standards are being utilized. COMMENTS CONTAINED WITHIN 2/18/21 EMAIL Traffic Design & Safety / ADA residency Comments 1. Gen Note 1 - Since this is a CDOT facility, our specs should take precedence. At some point this may be a City local road thru devolution but that time is not Today. Response: Acknowledged. 2. Gen Note 26: NPDES being specified as the governing agency on erosion control. This is not a federally owned frontage road so it should be CDPHE instead. Response: Acknowledged, note updated to reflect change to CDPHE. 3. Gen Note 29: This note seems to relieve the City from testing. CDOT reserves the right during construction by our own Region 4 materials lab perform pop-quiz style popup testing without warning to verify that the contractor's results are accurate. There isn't really a change per say to the notes except for this statement of our intent. If the City isn't performing testing oversight CDOT may elect to. Response: Acknowledged, note updated to clear up confusion. 4. Sheet 3 needs to be updated with the most recent standard plans list I think 12/30/20 is the most recent. Response: Acknowledged, standard plans updated. 5. Sheet 4: I recommend they show the 6" of subgrade prep depth below the sidewalk Response: Acknowledged, pavement inset detail updated to include 12” subgrade preparation depth per Geotech recommendation. COMMENTS CONTAINED WITHIN 2/10/21 EMAIL General Comments: 1.Hydraulics approved your report so that discipline is done. Response: Acknowledged. 2. Environmental additional comments are in the attached doc: 1. Migratory Bird Treaty Act (MBTA): Page 4 kimley-horn.com 4582 South Ulster Street, Suite 1500, Denver, CO 80237 303 228 2300 It has been determined that the proposed project could potentially result in the take of migratory birds, their nests, and or their eggs. It is the applicant’s responsibility to follow the MBTA federal regulations. Comments: MBTA was mentioned in the Ecological Characterization Study in regards to seasonal restrictions. These restrictions need to be followed within CDOT ROW. Response: Acknowledged. Project shall comply with all Federal regulations. 2. Historic Properties (Archaeology, History): It has been determined that archaeological and/or historical resources may be affected by the proposed project activities. It is the applicant’s responsibility to comply with regulations under the Colorado Office of Archaeology and Historic Preservation. If archaeological resources are discovered within CDOT ROW, the applicant must contact CDOT’s Staff Archaeologist. Comments: If the irrigation ditch is within CDOT ROW and will be impacted by the project, the applicant will need to contact the State Historic Preservation Officer. Response: Existing irrigation ditch is not within CDOT ROW. 3. SWMP and Colorado Discharge Permit System: CDOT requires a Storm Water Management Plan (SWMP) be prepared for every project occurring within any existing or newly dedicated public right-of-way. Therefore, before a permit can be issued, the applicant must provide a copy of the SWMP to the CDOT Region Environmental Unit. Additionally, if the project results in one acre or more of earth disturbance, the applicant must obtain a Colorado Discharge Permit issued by the Colorado Department of Public Health and Environment. It will be the applicant’s responsibility to ensure all conditions of the permit are adhered to during and after construction. Projects within a Municipal Separate Storm Sewer System (MS4) area that result in disturbance of one acre or more; or have under one acre of disturbance, but are part of a larger common plan of development or sale; must provide the SWMP to CDOT Region Environmental Unit for review and approval and should obtain a Memorandum from the local MS4 municipality that they will perform MS4-required stormwater permit compliance audits. Response: Acknowledged. Developer shall obtain CDPHE General Permit prior to any earth disturbing activities. Email confirmation from the City of Fort Collins provided to CDOT on 1/25/21 regarding SWMP compliance/inspections. COMMENTS CONTAINED WITHIN 2/10/21 EMAIL General Comments: 1. For the ROW deed front, Region 4 is in the process right now of modifying the required deeds we want the developers to provide. That is the holdup in my response. I have Page 5 kimley-horn.com 4582 South Ulster Street, Suite 1500, Denver, CO 80237 303 228 2300 your plans into Region 4 Right-of-Way with the question of “Just tell me what kind of deed they want”. Response: Acknowledged. Developer continues to coordinate dedication instruments with City and CDOT. 2. For the SWMP Fort Collins e-mail, I had to wait a bit for R4 SWMP to approve it since they originally wanted a memo. The verbiage is the same though really so ultimately, I got them to accept the e-mail. They didn't comment on the acreage you provided which I assume means "That was the information they needed and are good" but again.... I followed up with them to avoid any last minute surprises. Response: Acknowledged. 3. I am still waiting on the following comments back. I reached out to the appropriate CDOT person pressing them for their comments as quickly as possible right before sending this e-mail: Signing & Striping, Traffic Design & Multimodal, Hydraulics, and the I-25 Residency. Response: Acknowledged. 4. I did receive R4 Materials comments back, which are: I have reviewed their designs and report and they are marked Revise and Resubmit as they are utilizing a version of Pavement ME that CDOT does not currently accept. They are required to rerun their design using CDOTs accepted version of Pavement ME which is version 2.3.1 Hotfixed and specifically are required to use CDOT's calibration coefficients and specific HMA materials loaded from CDOT's database. We do not allow use of Default materials for design. Also, they are required to use CDOT's weather data which they can also obtain through Melody below. They can contact Melody Perkins for the appropriate information at melody.perkins@state.co.us Response: Acknowledged. Pavement Design Report updated. Refer to revised report included with resubmittal. COMMENTS CONTAINED WITHIN 1/18/21 EMAIL General Comments: 1. Thank you for the stormwater quantity information. I've passed that on to R4 environmental for them to continue their review. Please do not forget the comment on "We will need a memo from the appropriate municipality that they will audit for MS4 compliance". It is up to you all to liaise with the appropriate local stormwater department. Pursuing & obtaining that memo is not something CDOT undertakes on your behalf. It is your responsibility. Response: Per response above, email confirmation from the City of Fort Collins provided to CDOT on 1/25/21 regarding SWMP compliance/inspections. 2. Our Roadway design unit sent in the following comments to address in the next round of plans you provide: Page 6 kimley-horn.com 4582 South Ulster Street, Suite 1500, Denver, CO 80237 303 228 2300 Roadway Comments: 1. At Redman Dr...doesn't appear thru lanes, NB and SB I-25 Frontage Rd lanes, are lining up. Response: Plans updated to better align thru lanes. Refer to sheets C5-0 and C5-1. 2. For 45 MPH Speed Limit...Taper Rate = 13.5:1 (Minimum) and Redirect Rate 45:1 (Minimum). Seems like we are violating the Redirect Rate on both the North and South side. Response: Tapers have been updated to reflect the minimums. Refer to sheets C5-0 and C5-1. 3. 12 FT Lane width for new SB I-25 Frontage Rd lane Response: Lane width updated to 12’. Refer to sheets C2-0, C2-1, C5-0 and C5-1. 4. 16 FT Median width (4 FT Median | 12 FT LT Turn Lane) desirable...provide justification for using 12 FT minimum width with no Median. Response: Ultimate street cross section determined by City of Fort Collins based on an anticipated devolution, but pavement markings located based on CDOT criteria. Median width reduced to accommodate full shoulder widths. General Comments (cont.): 3. It's ironic slightly that you're writing about the "Other mechanism" for ROW dedication. Up until literally a week ago I would have said "We will take a Quit Claim Deed from you". A week ago the Region 4 Right-of-Way manager changed the process to "We will take a warranty deed".... but then wanted to continue discussing the issue with his staff. As of right now I can't tell you whether we want a Quit Claim Deed or a Warranty deed. Whichever way we pick I will provide a with an example. Please follow up with me in a week to see if the issue is settled internally here. Response: Acknowledged. Developer continues to coordinate dedication instruments with City and CDOT.
