Comment Number: 2 09/15/2020: INFORMATION: As part of your resubmittal you will respond to the comments provided in this letter. This letter is provided to you in Microsoft Word format. Please use this document to insert responses to each comment for your submittal, using a different font color. When replying to the comment letter please be detailed in your responses, as all comments should be thoroughly addressed. Provide reference to specific project plans or explanations of why comments have not been addressed, when applicable. Please avoid using acknowledged, noted, or other non-descriptive replies. 2 Comment Number: 3 09/15/2020: INFORMATION: This proposed project is processing as a Type 2 Major Amendment (MJA) with an Addition of Permitted Use (APU). The decision maker for Type 2 is the Planning and Zoning Board. Staff would need to be in agreement the project is ready for Hearing approximately 3-5 weeks prior to the hearing. I have attached the 2020 P&Z schedule, which has key dates. Comment Number: 4 09/15/2020: INFORMATION ONLY: When you are ready to resubmit, please let me know at least 24 hours in advance. Submittals are accepted any day of the week, with Wednesday at noon being the cut off for routing the same week. Comment Number: 5 01/27/2021: I am letting you know that your quasi-judicial item will be heard remotely and that there is the option to hold off until an in-person hearing can be conducted. Any person or applicant seeking a quasi-judicial decision from City Council, a City board or commission or an administrative hearing officer under the City Code or the City's Land Use Code, shall be notified in writing or by email of the intention to conduct a Quasi-Judicial Hearing using Remote Technology. Such person or applicant shall be entitled to request that the Quasi-Judicial Hearing be delayed until such time as the Hearing can be conducted in person. Acknowledged. From the information provided at the present time, this pond appears to provide less storage volume than the original design. If there is sediment accumulation or “mounding” at the bottom of the pond, then pond maintenance will need to be performed with the development project to restore the original design grading. Acknowledged. Comment Number: 11 03/09/2021: FOR FINAL PLAN: I acknowledge your response. 01/26/2021: FOR FINAL PLAN: The design of the water quality outlet structure will need to be refined. Please review my redlines and contact me to discuss before FDP round 1 submittal. Acknowledged. 3 Comment Number: 12 03/09/2021: FOR INFORMATION ONLY: After construction has been completed, the project will be required to complete a Site Drainage Certification and a Lot Grading Certification. These will need to be reviewed and accepted by the City off before the building Certificate of Occupancy can be issued. I will provide more information on these during the FDP review. Acknowledged. Comment Number: 13 01/26/2021: FOR HEARING: This project will require a formal variance to the LID and Water Quality requirements. We are in support of this variance (as we have discussed) for this project. Please fill out the included stormwater variance for and submit to me for review. Variance application has previously been submitted and included as part of this resubmittal. Comment Number: 14 03/09/2021: FOR FINAL PLAN - UPDATED: We will process the variance during FDP. Please submit a signed copy of the variance form for our approval. Feel free to contact me with any questions. 01/26/2021: FOR HEARING: Please revise the water quality capture volume calculations to include 120% of the WQCV. Comment Number: 17 03/09/2021: FOR HEARING: This comment is a follow up on the previous comments about impacts to the parking lot detention area. The modifications and impacts to the existing Pond B need to be shown on the Site Plan, Landscaping Plan, and Utility Plans. The Forestry and Planning departments will need to see how these modifications will impact the existing landscaping, specifically impacts to existing trees. Sheets C5.1, C6.1, C8.1 and L1.1 have been added to show Pond B and the impacts to the existing landscaping. We don’t expect the trees to be impacted. 4 Comment Number: 18 03/09/2021: FOR FINAL PLAN: For the first FDP submittal, please provide: a. State Stormwater Detention and Infiltration (SD) compliance sheet. – please see the template provided with Fort Collins rainfall preloaded. b. Calculations and details for the water quality outlet structure design. c. Proposed Pond B – provide a stage-storage table based on the proposed grading d. Pond A – provide a stage storage tabulation – you may need to use 0.2’ or 0.5’ contours. This should show the existing storage volume (as available today) and proposed storage volume. Acknowledged. Will address as part of the FDP submittal. Comment Number: 19 03/09/2021: FOR FINAL PLAN: Please see redlines of the Utility Plan and Drainage report. Utility Plan (Sheet C8) and Drainage Report has been revised per redlines received on 3/12/2021. Department: Water-Wastewater Engineering Contact: Matt Simpson, (970)416-2754, masimpson@fcgov.com Topic: General Comment Number: 3 03/09/2021: FOR FINAL PLAN - UPDATED: The water service sizing calculation should include a summary memo from the engineer performing the calculation. This should present the calculated peak flows, assumptions, and basis for water service/ meter size selection. Based on what you have showed in the calculation sheet, you may be okay with a ¾-inch water service. This is your choice. The development fees for the 1-inch will be higher than the ¾-inch service. A revised calculation sheet with cover letter is included as part of this resubmittal. Client would like a 1-inch service. 01/26/2021: FOR FINAL PLAN - UPDATED: Please submit a water service sizing calculation for the domestic and irrigation water services. Currently you are proposing two 1.5-inch water services. For your information, the water development fees are based on the size of the water service and meter. These services may be larger than you need. 09/14/2020: FOR FINAL: Why are the proposed water services so large? FYI, there are water tap fees and water rights fees required for new services. Please contact me for more information. Comment Number: 7 03/09/2021: FOR HEARING: The proposed electric line appears to conflict with an existing water main. Please show the existing water main, north of your site, on plans. Provide 10-ft minimum separation to electric line. Electric routing has been revised and provides required separation from existing water main. 5 Comment Number: 8 03/09/2021: FOR FINAL PLAN: Please try to achieve 1% slope on the 6-inch sewer service line or explain why if it cannot be done. Revised Utility Plan (Sheet C8) to provide 1 percent slope. Matched existing invert at point of connection and added note for pipe insulation where pipe does not meet 4-foot cover. Department: Light And Power Contact: Rob Irish, 970-224-6167, rirish@fcgov.com Topic: General Comment Number: 8 03/09/2021: FOR HEARING - UPDATED: Proposed primary electric line shown in the drive isle needs to meet the minimum separation requirements from wet utilities. I believe there is an existing water main in the drive isle. Electric line has been revised on the Utility Plan (Sheet C8) and provides the required separation from the existing water main. 01/22/2021: FOR HEARING: The proposed electric primary does not appear meet required separation requirements from wet utilities and private utilities. Please coordinate with the wet utilities and show the new routing on the plan set. Comment Number: 9 03/09/2021: FOR HEARING - UPDATED: The proposed primary electric routing was moved out from under the landscape areas but now creates to many bends in the run and too many bore pits. The proposed electric routing will make pulling cable extremely difficult. Light & Power wants to see the routing be more fluid and gradual to limit the number of bends and bore pits. If this means going under landscape islands or trees this would be a better option if Forestry is okay with it. Electric line has been revised on the Utility Plan (Sheet C8) to have less bends, bore pits and minimize impacts to existing trees. 01/22/2021:FOR HEARING: The primary electric routing appears to go through a lot of landscaping and trees. Is it anticipated that the primary electric will be directionally bored under the trees and landscaping or will this be open cut through the trees and landscaping? Please reach out to Forestry to discuss the best approach to minimize the impact on trees. Recommend extending the landscape plan to include the area East of Boardwalk and show the primary electric routing on the Landscape plan to have a better understanding of the conflicts. Comment Number: 12 03/09/2021: FOR HEARING - UPDATED: Thank you for providing the easement. This may need to be adjusted once the final routing of the primary line is worked out. At this time, the proposed routing will not work. Acknowledged. Draft easement provided as part of this resubmittal. 6 01/22/2021: FOR HEARING: The proposed electric primary and transformer will need to be shown in a Utility easement for the entirety of the run from Boardwalk if the blanket utility easement does not go that far. Department: Forestry Contact: Molly Roche, 224-616-1992, mroche@fcgov.com Topic: General Comment Number: 7 3/9/2021: FOR HEARING Any impacts to existing trees or other landscaping near the "detention Pond B", south of the Sam’s Club building, need to be surveyed and shown on the utility and landscape/site plans for Forestry review. If any impacts are suspected, an on-site meeting with City Forestry shall occur prior to hearing to obtain additional tree inventory and mitigation information. Sheets C5.1, C6.1, C8.1 and L1.1 have been added to show Pond B and the impacts to the existing landscaping. We don’t expect the trees to be impacted. Comment Number: 8 3/9/2021: FOR HEARING Please include the following note on the utility and landscape/site plans near existing trees 1-4 as there is potential that they may be impacted by the installation of the water service lines: PLEASE HYDROEXCAVATE OR POTHOLE PRIOR TO INSTALLING NEW WATER SERVICE LINE(S) NEAR EXISTING TREES 1-4. HAND DIGGING SHALL BE USED WITHIN THE CRITICAL ROOT ZONE OF THESE FOUR TREES. IN ADDITION TO REQUIRED TREE PROTECTION THAT MUST BE INSTALLED AROUND THESE TREES, PLEASE PRESERVE AND PROTECT ALL EXISTING ROOTS, ESPECIALLY THOSE GREATER THAN 2 INCHES IN DIAMETER. CONTACT CITY FORESTRY IF ANY ROOTS GREATER THAN 2 INCHES NEED TO BE SEVERED IN ORDER TO INSTALL THIS UTILITY. Note has been added to the Site Plan (Sheet C5), Utility Plan (Sheet C8) and Landscape Plan (Sheet L1) as requested. Acknowledged. Comment Number: 1 09/15/2020: FOR APPROVAL: Thank you for providing the draft legal exhibits for the easement vacation. Please continue to work with me and Technical Services to finalize this and eventually get it recorded with the county. 7 Department: Erosion Control Contact: Basil Hamdan, 970-222-1801, bhamdan@fcgov.com Topic: Erosion Control Comment Number: 1 03/04/2021: INFORMATION ONLY - UPDATED: 01/21/2021: INFORMATION ONLY: The City Manager’s development review fee schedule under City Code 7.5-2 was updated to include fees for Erosion Control and Stormwater Inspections. As of January 1st, 2021, fees will be collected on projects for these inspections. The Erosion Control fees are based on; the number of lots, the total site disturbance, the estimated number of years the project will be active and the Stormwater Inspection Fees are based off the number of LID/WQ Features that are designed for on this project. Based upon the materials submitted we are assuming 1 lot, 1.2 acres of disturbance, 1 year from demo through build out of construction and an additional and no additional years till full vegetative stabilization due to seeding. Which roughly estimates an Erosion Control Fee of $913.39. I have included a copy of the fee calculation spreadsheet for your review. No LID inspection fee will be assessed since none were proposed for this site. Based on the area of disturbance, a State permit for construction dewatering discharge due to will be required and will need to be obtained from the State prior to commencing construction activities on the site. FOR FINAL PLAN: Plans are OK, since the site development will disturb in excess of one acre an Erosion and Sediment Control Report will be required. The report will need to comply with City of Fort Collins Crietria. The erosion control requirements are located in the Stormwater Design Criteria in Chapter 2 Section 6.0 a copy of the requirements can be found at www.fcgov.com/erosion 09/10/2020: FOR FINAL APPROVAL: Please address all redlined comments provided on the Erosion and Sediment Control (ESC) Plan. Please provide a calculation of the total disturbed area due to all construction activities associated with this on site's development. Please provide an erosion control escrow cost estimate. It is calculated as 1.5 times the cost of the ESC measures or the 1.5 times the cost of re-seeding the total disturbed area on the site, whichever is greater.
