HomeMy WebLinkAboutTIMBERLINE FARMS PUD, DIAMOND SHAMROCK CORNERSTORE - FINAL - 42-89E - CORRESPONDENCE - LUC REQUIREMENTSCOMMA Planning and Environmental Swices Building Permits and Inspection Division Citv of Fort Collins October 6, 1997 Mr. Rich Holloway, Store Manager Diamond Shamrock Comerstore 4502 Timberline Road Fort Collins, CO 80525 Dear Mr. Holloway: RE: Landscaping Violation # 97-096, Diamond Shamrock Cornerstore, 4502 Timberline Rd., Parcel Number 87323-43-001 We have been monitoring the removal and replacement of five Burr Oak trees at the above referenced property. The trees, four located on Timberline Road and one located on Milestone Drive, appear to have been removed following an inspection conducted last year by this office. We contacted Diamond Shamrock representatives this past spring concerning the tree removal. Replacement of the trees have never occurred since our last conversation with Diamond Shamrock. Division 2.13.6 of the City of Ft. Collins Land Use Code authorizes this notification due to a "failure to comply with any terms, conditions, or limitations on the site plan, landscape plan, building elevations or other approved documents pertaining to a development which has received final approval from the City." Timberline Farms Cornerstore was approved by the Planning and Zoning Board and developed as a Planned Unit Development (PUD). We are asking that the trees be replaced per the approved landscape plan for this development. The approved caliper for the tree bases was listed at 3". Please replace the trees with the same variety and caliper on or before October 20, 1997. Failure to comply is considered a misdemeanor can result in a maximum fine of $1000 per day of violation.
