Timberline Farms P.U.D. - Diamond Shamrock Cornerstore - Preliminary, #42-89C. Member Strom removed himself due to a conflict of interest. Ted Shepard, Senior Planner gave the staff report recommending approval. Mr. Shepard also pointed out that there was a request for a variance from the point chart and that was to be voted on separately, before the main motion. Member Mickelson asked if the canopy color was the same color discussed in the worksession. Mr. Shepard replied yes. Chairperson Carnes asked what the status of the Overall Preliminary PUD for the Harmony School Shops Shopping Center. Mr. Shepard replied it was on the agenda for the December 18th Planning and Zoning Board Hearing. Rick Gibson, Real -Estate Representative for Diamond Shamrock, gave the applicant's presentation. Dave Jones, Galloway, Romero & Associates, consulting engineers representing Diamond Shamrock gave a description of their project. Mr. Jones spoke on the location, access to the project, shared access with the adjoining shopping center, the elevations, accent blocks on the building, brick to match the Harmony School, the split canopy, the similar features of the carwash, and the color of the canopy. Mr. Jones discussed the variance request for the point charts. Member Mickelsen asked why the canopies over the pumps could not have the same shape as the school. It was a drastic contrast and was not very compatible. Member Davidson commented that perpendicular rooftops would make the design a whole lot better and more compatible. He felt they overpower the main building. Mr. Jones responded that one of the difficulties they would have in putting a similar roof structure on a canopy was it would be quite an immense structure. He thought that it would overpower the site for the use of a convenience store. 0 . Planning and Zoning Board Minutes November 13, 1995 Page 10 Member Mickelson stated she was looking at the depth and that it could be maybe 4 or 5 feet. It would be more appealing and fit into the character more. Member Davidson asked about the amount of signage on the building. Mr. Davidson also asked about the car wash and what material they would be using? Would they complement the brick. Mr. Gibson addressed the signage issue and that they would seek no more signage than they currently have at Oakridge and Lemay. Member Davidson asked if it was their policy to utilize windows for signage. Mr. Gibson replied that he was not sure if it was a policy, but more of a necessity of the nature of their business. They do use the windows for signage for limited, short time specials. Mr. Gibson added that the signage had not been specifically addressed with Staff. Mr. Jones addressed the car -wash question. They utilize a commercial type over -head door. The door will be of a color that will complement and blend with the brick. Member Mickelsen asked Mr. Shepard to review where the Planning and Zoning Board stands on the sign code. Mr. Shepard replied that this project was located in the Residential Sign District, which is the most restrictive commercial sign district. The signage is regulated and permitted by the Zoning Department based on the sign code. What the Planning and Zoning Board has the ability to do is to look at the elevations of a structure, the location on the elevation, and basically this is a criteria that is looked at at final. Mr. Shepard added that the store at Oakridge and Lemay is tasteful, and that the Board does have the ability in the LDGS, in the residential sign district to look at location on the elevation of where signage would be appropriate. Window signage is regulated in the sign code. Member Colton asked what the architectural philosophy behind having the three foot canopies over the gas pumps as compared to a one -foot or six-inch. Mr. Jones replied that typically in the convenience store industry, canopies are three to four feet high. Where that came from he was not sure. He was not sure you could build a canopy less than three feet and still accomplish hiding the gutters and deck above. Mr. Jones explained the structural needs of the canopies. Planning and Zoning Board Minutes November 13, 1995 Page 11 Member Bell asked about the point chart and asked for clarification on the energy usage and joint parking. Mr. Shepard replied that the applicant used Method 2 for energy conservation. There are 37 different ways of trying to earn enough raw points, which to obtain your net score on the point chart. The joint parking was that you could park somewhere on the shopping center site and you could walk into the convenience store and purchase an item. You could also park your car somewhere on the Diamond Shamrock site and walk over to the neighboring restaurants or tenants. The theory is that you can park your car in the area and cross different sites without having to get into your car and drive within the center. Member Bell asked to see a slide of the Overall Development Plan for Harmony School Shops. Member Bell questioned why we were seeing this a month in advance of the actual ODP. Mr. Jones responded that Diamond Shamrock actually started this process a year and a half ago. Their first submittal was prior to the Harmony Corridor Moratorium. At that point the Overall Development had not been planned this far. Mr. Jones felt it was a coincidence, due to the moratorium and some of the delays they took to deal with the issues staff and the neighborhood brought up, that the Overall Plan has almost caught up with them. Mr. Jones stated they could come in simultaneous with the ODP, but would like to move forward to deal with design issues with Transportation regarding the deceleration lane. Deputy City Attorney read into the record the code for window signs. Chairperson Carnes asked about the lighting under the canopies. Mr. Jones replied that the lights under the canopy would be recessed. You will not be able to see a vertical face on the light like you would on older canopies. The lighting would be the same as the Oakridge/Lemay store. Member Davidson asked if there was any criteria for candle power as far as lighting goes. Mr. Shepard replied yes, under All Development Criteria for lighting, A 2.15. There are - some foot candle specifications for commercial buildings. Planning and Zoning Board Minutes November 13, 1995 Page 12 PUBLIC INPUT Stan Whittaker, Vice President with GT Land confirmed that the planning for this site is consistent with the planning for the overall shopping center site. PUBLIC INPUT CLOSED Member Davidson suggested that the horizontal facade be accented with brick texture to compliment the vertical pole and the building. He also suggested another vertical column closer to the actual building that was brick that might break this up more. Member Bell was concerned that without reviewing the ODP concept, she was not certain this will work, and felt it might be better to see this in a month along with the ODP. Member Bell also suggested a condition that when the ODP is seen, if the Board feels something needs to be adjusted, the Board would have the ability to do that at that point. Mr. Jones replied that since this was only preliminary at this stage, the overall has to come in as a preliminary and then final. He felt there would be plenty of opportunity to make sure that Diamond Shamrock and the shopping center operate as one contiguous property. Member Bell felt that the Board should not vest layout until the Board has a chance to review the ODP. Deputy City Attorney Eckman responded that the Board would approve the project conditioned upon not being vested for layout pending final. Member Bell stated that she really does not have any major issues, but has a general concern that she has not had a chance to see the whole ODP. Member Bell asked about the variance, and once it is part of the ODP, will it meet all of the criteria. Mr. Shepard replied yes. Member Walker moved to grant a variance from the minimum score of the point chart. Member Mickelsen seconded the motion. Member Mickelsen recommended approval of the Diamond Shamrock at Timberline Farms, Preliminary P.U.D. with removal of the condition in the staff report regarding the canopy color, and with the condition that states that at the time of final P.U.D., that the Preliminary P.U.D. for the Harmony School Shops Shopping Center will have been approved. Member Davidson seconded the motion. Member Mickelsen added a condition that this approval will not grant them preliminary approval of the layout. Member Davidson accepted the condition as second. Member Colton stated he could support a motion if the layout is not vested. The motion was approved 6-0. Member Strom rejoined the hearing. Recommendation to City/ Council Regarding Harmony Corridor Implementation Items: Rezoning Three Properties. #3-95. Member Walker moved to approve the Harmony Corridor Rezonings. Member Mickelsen seconded the motion. The motion was approved 7-0. North College Avenue Rezoning. #2-95A Clark Mapes, City Planner gave the Staff presentation and report recommending approval of two new zoning districts and support of the proposal to rezone certain properties into those districts. PUBLIC INPUT Karen Weitkunat, North College Avenue Citizen's Committee, urged the Board's acceptance of the rezoning of the standards and guidelines for the North College Corridor. She stated that the citizens committee felt this was the best direction for our sector of the City. It complements downtown, it enhances Fort Collins strongest natural
