Dear George:
Thank you for meeting with us last Wednesday to discuss several aspects of
the 1990 Junior High School site. This letter addresses our discussion of
the storm drainage aspects, in particular, the incorporation of a Master
Planned Storm Drainage facility into the site.
As you know, the drainage channel on the southern boundary of the site
(parallel to Seneca Street) is identified as a master planned drainage
facility, designed to carry the developed stormwater flows from the basin
upstream of the site. The flows are ultimately directed to the regional
detention pond located southeast of the school.
Per Chapter 26, Article VII of the City Code (entitled Stormwater Utility),
master planned facilities, which are built by a developer as part of a site
development, are eligible for reimbursement of a portion of the costs. The
facility located on the site is therefore eligible for repayment.
The City requests the cooperation of the District in constructing this
facility by entering into a repayment agreement between the District and
the City.
For your information, I have attached a copy of that portion of the City
Code which addresses developer repayments. Engineering design fees,
right-of-way acquisition, and construction costs associated with master
planned facilities are eligible for repayment.

The eligible costs are determined by taking the difference between the
proposed basin improvement cost and the cost of stormwater improvements
necessary to meet the standard requirements of the development. Standard
requirements for this site include facilities for handling 10-year
developed flows from the site as well as routing the 100-year historic
off -site flows through the site.
Stan Myers of RBD, Inc. has put together a rough cost estimate of the
facilities for each scenario (see attached letter).
Cost of Providing Required Facilities: $18,500 ,
Cost of Master Planned Facility: $50,000
Therefore, the potential reimbursement would be approximately $31,500.00.
Please note that these are only guesstimates of the costs and do not
reflect engineering fees or potential changes due to different design
alternatives.
Normally, reimbursement agreements are in the form of our standards
Development Agreement with an attachment (see attached Exhibit B) which
delineates the items and associated costs eligible for reimbursement.
Actual reimbursement is then made first as a credit to the storm drainage
fees due for the site. If money is still owed it is paid as a lump sum
cash payment, subject to adequate documentation of the costs incurred. The
documentation required is outlined in the City Code which is attached. In
this particular case, the standard Developuezt Agreement may not be
appropriate. There are two other options which may be more appropriate for
the District.
The first would be an inter -governmental agreement which would cover the
terms of repayment. This agreement would go to the City Council for
approval.
The second option for repayment would involve crediting fees for this site,
with any additional reimbursement being taken as a credit on future school
sites. This could be arranged through a Letter of Agreement with the City,
signed by the City Manager.
To aid you in evaluating the different repayment agreements, I have
estimated the drainage fee for this site.
Basin fee = $3,021/acre
Approximate site area = 18 acres
Detention Reduction Factor = 1.0
Runoff Coefficient* = 0.5 - 0.7
Site fee = $27,200 to $38,100
* Exact coefficient is unknown at this time, so a range of reasonable
values was assumed. Based upon final design the actual fee could be higher
or lower than the range given.
The fee for the adjacent elementary school site was $5,354.47. It has not
yet been paid so could be used as credit towards any reimbursement.
We request that the District review this information and determine if a
repayment agreement can be entered into. If a positive reply is received
we can begin the final design process and drafting of the agreement.

UTILITIES
and charges shall be used solely to pay for the
costs of operation, repair, maintenance, improve-
ments, renewal, replacement, reconstruction, de-
sign, right-of-way acquisition and construction of
public stormwater facilities and costs incidental
thereto. If there are amounts in the fund in ex-
cess of the amount required to satisfy the purpose
of the fund, the City Council may by ordinance
authorize the transfer of such excess amount to
any other fund of the city.

acres, and can be adjusted for parcels of different
areas using the following formula:

DIVISION 3. STORMWATER
FACILITIES*
Sec. 26-541. Property owners to provide storm -
water facilities.
The City Council further finds, determines and
declares under all attendant circumstances that
the owners of property within stormwater basins
in the city should provide the stormwater facili-
ties necessary for the drainage and control of flood
and surface waters within stormwater basins and
should provide the facilities required to convey
such waters from the stormwater basin to major
drainageways. Therefore, the cost of installing
stormwater facilities in a stormwater basin should
be assessed in whole or in part against the lands
in the stormwater basin. The City Council fur-
ther finds, determines and declares that all real
property within a stormwater basin will be bene-
fited by the installation of stormwater facilities
within the basin since the development of ele-
vated lands increases the runoff of stormwaters
from such lands causing increased amounts of
stormwater to flow onto adjoining lands of lower
elevation. The owner of such elevated land has a
duty to prevent such increased runoff from doing
damage to other lands which duty will be met if
adequate stormwater facilities are installed in
the stormwater basin. To the extent possible, the
charges assessed against lands in a stormwater

basin for construction of stormwater facilities should
take into account the amount of stormwater which
will run off such lands after they have been
developed.

Sec. 26-542. Establishment of stormwater
basins.
After receiving the report and recommendation
of the Storm Drainage Board, the City Council
shall officially adopt by resolution a stormwater
map which is on file in the City Clerk's office
delineating the boundaries of the stormwater basin
in the city and in areas which may be annexed.
Such map may also indicate existing development
of properties within the basin, zoning of proper-
ties, and such other information as may be de-
termined to be advisable. Such map shall after
adoption by the City Council serve as official des-
ignation of the respective stormwater basins of
the city, but such map may be revised from time
to time by the City Council to conform with exist-
ing conditions.

Sec. 26-543. Master drainage plans.
(a) Master drainage plans are hereby adopted
by reference and declared to be a part of this
Article for the following stormwater basins of the
city:
(1) McClellands and Mail Creek Major Drain.

in the office of the City Clerk. The city may adopt
additional master drainage plans by reference and
declare them to be a part of this Article and cop-
ies of such master drainage plans shall be on file
in the office of the City Clerk. The plans may be
modified by the Director of Utility Services, and
if modified, the modification shall be filed in the
office of the City Clerk.

Sec. 26-544. Stormwater facilities required for
subdivisions.
Prior to the final approval of the plat of any
subdivision, the owners of the property being sub-
divided shall at such owners' cost prepare a de-
tailed drainage report and construction plans for
the installation of all stormwater facilities required
for such subdivision, including any off -site facili-
ties required to convey stormwater to existing
drains, channels, streams, detention ponds or other
points, all in conformity with the master plan of the
stormwater basins and the Design Criteria and
Construction Standards adopted by the City Coun-
cil. The Director of Utility Services shall review
such reports, plans and cost estimates; and after
approval of the same, the plat of the subdivision
may be approved subject to the city's being fur-
nished with acceptable assurance that such facil-
