Enclosed you will find a redrafted Petition for Amendment to
Annexation based upon the information that you gave me over the
telephone on April 12, 1993, and based upon the request from Harry
McCabe to remove CSU as an owner of the property and only provide
for a signature by CSU as having agreed to the amendment to
annexation. If the Petition is acceptable to you, please arrange
for the signature by Timberline as well as by the State Board of
Agriculture, and return the Petition to Ken Waido at the earliest
possible convenience so that it may be included in the packet for
the Planning and Zoning Board's April 1993 meeting. It would be
helpful if you would also provide me with a copy of the Petition.
When it is received, Ken will be sure to deposit the originally -
signed Petition with the office of the City Clerk.
Please coordinate the graphics to be attached to the Petition
and to the Ordinance with Ken Waido so that he can be sure that the
graphics are such that they will be easily understood by the
Planning and Zoning Board and the City Council. You might also
discuss with Ken any questions that he might have regarding the
preparation of a background report for the Board and the Council.

PETITION FOR AMENDMENT TO ANNEXATION
THE UNDERSIGNED hereby petition the Council of the City of
Fort Collins, Colorado, for an amendment to the Blue Spruce Farm
Annexation to the City of Fort Collins (Ordinance No. 135, 1987).
WHEREAS, by Ordinance No. 135, 1987, there was annexed to the
City of Fort Collins certain lands as shown on Exhibit "X" attached
hereto consisting of a total of approximately 173.2442 acres, and
belonging in part to Blue Spruce Farm, Inc., and in part to the
Colorado State Board of Agriculture, hereinafter referred to as the
"Blue Spruce Farm Annexation"; and
WHEREAS, to accommodate certain urgent needs of Blue Spruce
Farm, Inc., the State Board of Agriculture has agreed to trade a
1.4875 acre parcel (Parcel I on Exhibit "X" hereto) presently owned
by said State Board of Agriculture (but not located in the Blue
Spruce Farm Annexation) to Blue Spruce Farm, Inc., in return for a
1.7106 acre parcel (Parcel II on Exhibit "X" hereto) located in the
Blue Spruce Farm Annexation; and
WHEREAS, the State Board of Agriculture has made as a
condition of said trade that the land to be acquired by said State
Board of Agriculture in the Blue Spruce Farm Annexation must be
subject to the identical annexation terms, conditions and
limitations as were included in the Blue Spruce Farm Annexation
pertaining to the part thereof owned by the State Board of
Agriculture and described on Exhibit "A" of Ordinance 135, 1987.
NOW, THEREFORE, the petitioner hereby respectfully requests
that the City Council make the following amendment to Ordinance No.
135, 1987:
That Exhibit "A" of Ordinance No. 135, 1987, be amended
to include the following described additional parcel of
land, with such amendment to become effective upon the
date established in the Charter of the City for the going
into effect of ordinances or upon the recording with the
Larimer County Clerk and Recorder of the Deed conveying
the below described property to the State Board of
Agriculture, whichever last occurs:
A parcel of land located in Section 29,
Township 7 North, Range 68 West of the 6th
P.M., City of Fort Collins, County of Larimer,
Colorado, being more particularly described as
follows:
Considering the West line of the Southwest one
quarter of said Section 29 as bearing N
00002157" W and with all bearings contained

West one quarter corner of said Section 29,

square feet or 1.7106 acres, more or less.
This petition may be signed in counterparts by each petitioner
hereto and all such counterparts shall constitute one agreement.
