Previously, other lands owned by the State Board of Agriculture have been annexed to the City of Fort Collins under conditions mutually acceptable to the City Council and the Board. The conditions are as follows: Petitioner specifies as a condition of the proposed annexation that the proposed annexation in no sense shall be interpreted as: (1) conveying to said City any right, title or interest in the property so annexed; (2) conveying any right to establish new streets or extend existing streets upon or across said property, or to construct utility lines of any kind upon or across said property; (3) granting any right to apply the provisions of any municipal ordinance, and specifically any building code, zoning code, or licensing ordinance, upon the property so annexed so long as title shall remain in the State Board of Agriculture; provided, however, that the jurisdiction of the City of Fort Collins shall extend over the property annexed insofar as it relates to the application of: (1) city traffic ordinances; (2) city ordinances relating to police enforcement of the traffic code, City Ordinances relating to offenses against the person, CfferLsees against public -,)e3c2, offenses reicti:^:y to -mortals, and offenses relating to public health and safety, and (3) the jurisdiction of the municipal court is extended to include violations of ordinances included in the foregoing items 1 and 2 of this paragraph occurring on the lands so annexed; provided, however, that nothing contained in the annexing ordinances shall be construed to limit the authority of the University officials to impose upon its students and employees any supplemental traffic regulations or restrictions or to impose such other penalties as are consistent with their status with respect to the University. Please add these conditions to the Petition for Annexation. Also, note that the owner is State Board of Agriculture not CSURF. Mrs. Li ley June 11, 1986 Page 2 With regard to the financing of a special improvement district, funds are not currently available. The cost of improvements will be included in a budget request for capital construction funding. The likelihood of obtaining funds in the next several years is remote as this requirement is not of the highest priority. I would like to point out that state statutes prohibit incurring debt beyond the current fiscal year. This precludes us from participating in the district bond with annual payments over a 15-year period. The value used for the additional 10' of right-of-way appears to be $20,000/acre. Is this a fair market value for frontage along Timberline? The next Board meeting is scheduled for July 10 in Gunnison, Colorado, whic1a may : :ese nt sane loc'_stics problems. Our preference is to submit this matter as an agenda item for the August 15 meeting to be held in Fort Collins. This would allow all interested staff to attend as well as eliminate the expense of a trip to Gunnison where accommodations may be difficult to arrange at this time. Please advise if this schedule would impose an undue hardship for your completion timetable. Long range University plans were taken into consideration at that time. 4) The furthest west utility corridor already exists and should have no negative affect on land use,. The 24** and 48* lines paralleling Vine Drive extended would involve a 45' right-of-way restricting new buildings; however, activi- ties on the land surface would not be affected,. 5) Acceptance of the furthest west line would eliminate the existing CSU pumping station, which is approved by R,. F,. Conard,. This line would also be ad iacent to the district's proposal and would be coordinated with overall long range water plans for the northern Colorado area. 6) Some staff work remains, such as disposition of the aban- doned 20** pipe and making certain that this proposal does not interfere with University long range plans, coordination with the College of Engineering on the runway in this area. Richardson is no longer a member of the Water Board. ITEM 3: CITY OF FORT COLLINS REQUEST TO ANNEX A PORTION OF UNIVERSITY PROPERTY ON EAST DRAKE ROAD Presentation by R. H,. Burnham. The City of Fort Collins has requested that the University request the City submit an annexation proposal for the Nature Center and 20 adiacent acres currently used for grazing. H,. Alden, Nature Center Director, and central administration have no problems with the concept. The question before the committee is preliminary in nature and only commits the University to review a future annexation request by the City for accepta- bility to the University. At that time, staff work will be accomplished to determine long range or existing caveats required as to a possible annexation. -4- C� Discussion: 1) The University does not wish to be subject to the existing City street frontage fee.. 2) The Nature Center is close to the new county fail facility and already enjoys good police and fire protection response time. The basic advantage to the University in accepting such a proposal would be fostering a good neighbor policy with the City. 3) How would City regulations affect the Animal Science feeding area adiscent to the Nature Center? When this annexation request is made, staff work must address whether there are adverse wildlife and stock containment regulations which would apply to this area if it were annexed. 4) In 1956, when the main campus was an- nexed, a precedent was established that City ordinances did not apply to CSU.. Amendments since that time have applied sales tax collections, traffic codes, and health and life safety codes to CSU property.. ITEM 4: TRI-DISTRICT FORT COLLINS/LOVELAND WATER AND SANITATION DISTRICT REQUEST TO PURCHASE APPROXIMATELY 6 ACRES OF UNIVERSITY FOOTHILLS PROPERTY FOR EXPANSION OF THEIR WATER TREATMENT PLANT Presentation by M. DiTullio, FCLWD District Manager, and B,. Reed, Tri-District Water Treatment Plant Manager. M. DiTullio briefly outlined the local water authorities, the areas they serve•. If the Water District acquires the re- quested land from CSU, they would reconstruct on the CSU parcel the basins currently located on land leased from the federal government, and expand capacity. Their proposal is consistent with the general land use of this area. CSU would retain a roadway access and would not interfere with adjacent CSU land uses.. Discussion: 1) The University should retain ownership of 100' on the east side of this parcel of land for road access and utility corridor. 2) Suggest- ed that the land be traded for land of equal value contiguous to the south Ofside of Foothills Campus, instead of sold. 3) Can a shielding fence be -5-
