Resolution 87-103 Finding Substantial Compliance and Initiating Annexation
Proceedings for the Blue Spruce Farm Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
A written petition for the annexation of approximately 173.24 acres has
been submitted by Blue Spruce Farm, Inc. and the State Board of Agriculture
for property that is within the Fort Collins Urban Growth Area and located
south of Drake Road, east of Timberline Road and north of Horsetooth Road
known as the Blue Spruce Farm Annexation. This resolution accepts the
annexation petition and determines that the petition is in compliance with
State law. The resolution also establishes the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinance for the property.
BACKGROUND:
As adopted in 1980, the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS
URBAN GROWTH AREA provides that the City of Fort Collins will annex all
eligible property within the Urban Growth Area. A written petition for the
annexation of approximately 173.24 acres has been submitted by Blue Spruce
Farm, Inc. and the State Board of Agriculture for property that is within
the Fort Collins Urban Growth Area and located south of Drake Road, east of
Timberline Road and north of Horsetooth Road known as the Blue Spruce Farm
Annexation. The attached resolution establishes the date, time and place
when a public hearing will be held regarding the passage of an annexation
ordinance for the property.
The Planning and Zoning Board held a public hearing on the proposed
annexation on June 22, and voted to recommend approval to the City Council.
The Council will consider first readings of ordinances annexing and zoning
the property at their September 15 regular meeting.

RESOLUTION 87-103
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
BLUE SPRUCE FARM ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an
annexation map, was heretofore filed with the City Clerk requesting the
annexation of certain property more particularly described as situate in
the County of Larimer, State of Colorado, to wit:
A part of the Northwest 1/4 and of the South 1/2 of Section 29,
Township 7 North, Range 68 West, of the Sixth P.M., Larimer
County, Colorado, which, considering the West line of said
Northwest 1/4 as bearing N 00*25' E, and with all bearings
contained herein relative thereto, begins at the West 1/4 corner
of said Section 29, and runs thence along the West line of said
Northwest 1/4, N 00*25' W 1323.00 feet; thence S 88°55'46" E
1380.61 feet; thence S 00°38'40" W 800.00 feet; thence
S 88°55'46" E 1266.09 feet to the North -South centerline of said
Section 29; thence along said centerline, S 00"22'01" W 622.98
feet; thence S 88°55'46" E 1295.89 feet; thence S 00°22'01" W
1226.89 feet to the South line of the North 1/2 of the South 1/2
of said Section 29; thence along said South line, N 88°59'26" W
3941.59 feet to the West line of the Southwest 1/4 of said
Section 29; thence along said West line, N 00°26'35" E 1331.07
feet to the point of beginning, EXCEPT a tract of land situate in
the Northwest 1/4 of Section 29, Township 7 North, Range 68 West,
of the Sixth P.M., County of Larimer, State of Colorado, which,
considering the West line of said Northwest 1/4 as bearing
S 00025' W and with all bearings contained herein relative
thereto, is contained within the boundary lines which begin at a
point which bears S 00*25' W 2159.50 feet, and again S 89*35' E
30.00 feet from the Northwest 1/4 of said Section 29, and runs
thence S 89*35' E 231.50 feet; thence S 00*25' W 150.00 feet;
thence N 89*35' W 104.35 feet; thence S 00*25' W 96.00 feet;
thence N 89*35' W 122.15 feet; thence N 00*25' E 246.00 feet to
the point of beginning. The annexation contains 173.2442 acres
more or less.

WHEREAS, the City Council desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the City Council hereby accepts said annexation
petition, finds and determines that the annexation petition and
accompanying map are in substantial compliance with Section 31-12-107,

C.R.S., and desires to initiate annexation proceedings in accordance with
1 aw.
Section 2. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
puhlic hearing will be held regarding the passage of an annexation
ordinance pertaining to the above described property. The City Clerk is
directed to publish a copy of this Resolution and said Notice as provided
in Section 31-12-108 (2), C.R.S.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 4th day of August, A.D. 1987.

TO ALL PERSONS INTERESTED:
NOTICE
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins
has adopted a Resolution initiating annexation proceedings for the Blue
Spruce Farm Annexation, said Annexation being more particularly described
in said Resolution, a copy of which precedes this Notice.
That, on September 15, 1987, at the hour of 6:30 p.m., or as soon
thereafter as the matter may come on for hearing in the Council Chambers in
the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins
City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be
annexed meets the applicable requirements of Colorado law and is considered
eligible for annexation. At such hearing, any persons may appear and
present such evidence as they may desire. This meeting is fully accessible
to the handicapped.
