E, Suite 200 Fort Collins, CO. 80526 Dear Mr. Dengler: There are several issues that remain for the Shoreline PUD that should be resolved prior to the final hearing on September 28, 1987. These issues, along with additional comments, are discussed below: 1. The Water and Sewer Utility has reviewed the proposed alternatives for the manhole location for the sewer line and accepts the location in the proposed off-street parking bay as opposed to the driveway. 2. The Water and Sewer Utility requests that any proposed building enve- lope that presently abuts a water and sewer easement be pulled back a dis- tance of 5 feet. This is to prevent potential damage to foundations or exterior walls should excavation be necessary to service the lines. 3. Those lots that have a water and sewer easement in the yard area should have restrictive covenants or deed restrictions to prevent the planting of trees and shrubs in the easement. 4. Both the final PUD site plan and the final plat should contain a note that states that the location of a water and sewer easement outside the street right-of-way is an unusual situation and not the normal policy of the Water and Sewer Utility. The general tone of this note should be to let the buyer beware that repair and maintenance to water and sewer lines placed in the out of street easements would cause disruption to private yard areas of the affected lots. The affected lots should be enumerated. The note should be placed prominently on the documents so that any reason- able search by a title company or interested consumer will reveal the situ- ation on the affected lots. Please review the final language of this note with the Planning Staff. 5. The Water and Sewer Utility is concerned that construction traffic and homeowner watering could possibly cause subsidence over the sewer line. SERVICES, PLANNING Shoreline PUD Commits Page 2 This settling could cause problems with future lot owners. The Utility, therefore, requests that a soil compaction test, or a nuclear density test, be conducted in the affected area. The results of such a test is to be reviewed by the Utility. Possible mitigation measures may be required if potential subsidence becomes a public liability. This test should be con- ducted prior to final approval. 6. The Development Agreement will contain language reflecting the nature of the out of street water and sewer easement and the above discussion. 7. A final drainage report has not yet been submitted. The Stormwater Utility, therefore, has the same concerns raised during the preliminary discussions. These concerns relate to the extension of the culvert into the lake past the high water line, the platting of an easement for the pans and pipes, and the submittal of a detail for the channel cross-section for the drainage swale along the southerly property line. 8. In addition, there has been a concern raised by the property owner to the north about the culverts to be extended. A calculation showing the effects of lengthening the culvert needs to be included. The street should not be overtopped by the design flow as in the original design. 9. The final plat must dedicate 8 foot minimum width utility easements adjoining the street right-of-way lines on both sides of Southshore Court and on the east side of Westshore Way. 10. The Warren Lake Trunk Sewer repay will be assessed against each lot. 11. Please show exact location of all proposed fencing. 12. Mountain Bell requests a 6 foot easement in the front of lots 1 - 7. This concludes staff_ comments at this time. Normally, this letter would have been sent at an earlier date but it was held until the water and sewer easesment issue was resolved. Please note the following dates and let us know if there are any problems in meeting the deadlines: Plan revisions are due September 10, 1987 PMT's, colored renderings, and 10 prints are due September 21, 1987 Final mylars and documents are due September 24, 1987 As always, please call if there are any questions or concerns.
