PROJECT DESCRIPTION: This project is a request to the Larimer County
Planning Commission for a Master Plan, Preliminary Residential PUD and Sub-
division for two lots in Terry Point Estates. Lot One would contain 21,781
square feet and one four-plex structure. Lot 2 would contain 16,337 square
feet and one three-plex structure. The site is located on Terry Point Drive
in Terry Point Estates Subdivision and zoned M, Low to Moderate Density
Multi -family.
RECOMMENDATION: Approval with two conditions
EXECUTIVE SUMMARY: This Master Plan, Preliminary PUD, and Subdivision
request represents the latter stages of the Terry Point Estates project.
The two structures within this PUD would be the only multi -family units in
the subdivision. Water would be provided by the East Larimer County Water
District and sewer would be provided by the Cherry Hills Sanitation Dis-
trict. All roads are improved out to Douglas Road. The developer must apply
to the City of Fort Collins for a waiver from the Off -Site Street Improve-
ment Ordinance. Staff is concerned about water quality and possible degra-
dation of Terry Lake as a natural and recreational resource.

1. Background:
The surrounding zoning and land uses are as follows:
N: M; Vacant (Terry Point Estates)
S: M; Single family detached
E: Terry Lake
W: M; Single family detached
The request is a replat of Lots 7 and 8 of Block 1 of the Amended Plat of
Lots 3-11, Block 14 and Lots 1-4, Block 2, Terry Point Estates.
2. Land Use:
The placing of multi -family structures on these two lots in the Terry Point
Subdivision is a use -by -right. The zoning designation M allows multiple
family development at the proposed density. The City supports both mixed
housing and a minimum of density of 3 dwelling units per acre within the
Urban Growth Area.
3. Resource Protection:
Staff is aware that the water in Terry Lake is owned by the shareholder of
the Larimer-Weld Ditch Company. Nonetheless, the developer should take
precautions to prevent erosion and contamination of the lake. It is
strongly encouraged that the future owners of the units be prevented from
planting a traditional blue grass lawn down to the water's edge. By leaving
a natural area of tall grasses and native vegetation, the erosion of soil
and lawn fertilizers is minimized. A natural area around the water's edge
will prevent the deposit of nutrients and organic matter and slow the
deposit of algae which can deplete oxygen and "choke" the lake. Also, a
natural area is less attractive to geese than a bluegrass lawn on the water
which would reduce conflicts with noise and droppings.
4. Transportation:
Within the Urban Growth Area, the City's Off -Site Street Improvement Ordi-
nance is in effect. This ordinance requires that local streets within sub-
divisions be approved out to the arterial street system. If these improve-
ments are not warranted by the traffic volume, then the developer must
apply to the City for a waiver from the Off -Site Street Improvement Ordi-
nance.

Staff finds that proposed Master Plan, Preliminary PUD and Subdivision
would promote the policies of achieving minimum densities of 3 dwelling
units per acre within the UGA. The proposal also contributes toward the
diversification of housing types. Staff is concerned about water quality,
and, therefore, recommends approval of the request subject to the following
conditions:
1. The developer is strongly encouraged to leave an area of land at the
water's edge in a natural state to lessen the potential degradation of
the water from erosion and the runoff of fertilizer and other matter.

SUBJECT: Agenda Item #23, Terry Point Estates, County Referral
This memo is to correct the language in the Staff Report on Agenda Item
#23, Terry Point Estates, County Referral. The correction relates to the
second condition. The second condition now reads:
"The developer shall pay the Off -site Improvement Waiver Fee to Larimer
County."
On Monday, May 18, 1987, Staff met with Mr. Tan Brady to discuss this
issue. Mr. Brady is aware of this condition of approval.
