staff review meeting (Wednesday mornings) following receipt of the revisions. At
this staff review meeting it will be determined if the project is ready to go to the
Administrative Hearing Officer (or Planning and Zoning Board, if necessary) for
a decision and, if so, will be scheduled for the nearest open date.
Please return all red -lined plans and reports with your revisions when they are
submitted to the Current Planning Department. The number of copies of
revisions for each document to be resubmitted is on the attached Revisions
Routing Sheet. .

16. Additional street right-of-way for Evenstar Court must be dedicated on
this property. This can be done with the subdivision plat or by separate
document.
17. The pork chop in Evenstar Court may have to be removed and a median
built in South Shields Street.
18. Future access to the property to the south must be provided for with this
development plan.
19. A minor amendment to the Senior Center plans must be done to address
the revised parking in their northeast corner.
20. The traffic plan appears to be OK.

21. There could/should be another pedestrian between this facility and the
Senior Center, other than the sidewalk along the south side of Evenstar
Court.
22. A direct pedestrian connection to South Shields Street from the from
entry of the building should be provided.

24. Comments are on red -lines plans that are being forwarded to the
applicant.
This completes the staff comments at this time. Additional comments will be
forthcoming as they are received from City departments and outside reviewing
agencies.
Under the development review process and schedule there is a 90 day plan
revision submittal time -frame mandated by the City. The 90 day
turnaround period begins on the date of the comment letter prepared by
the project planner in the Current Planning Department. Upon receipt, the
revisions will be routed to the appropriate City departments and outside
view from both above and below by integrating it into the building and roof
design, to the maximum extent feasible.
11. Ward Stanford of the Traffic Operations Department offered the
following comments:
a. Is the "Cross access and parking easement" shown on the Site Plan
existing or new? Supposedly, there is an existing access easement
on the site to provide public access from Evenstar Court to
Raintree Drive. If the above stated easement is not the existing
easement, please research and include the existing easement on
the Site Plan and utility plans. If an easement cannot be.found to
exist, then a public access easement must be provided across this
property to facilitate a public access easement from Evenstar Court
to Raintree Drive.
b. Include the easements shown on the Site Plan on the utility plans.
C. A median is to be constructed on South Shields Street in this area.
The timing and responsibility for the costs are not yet determined.

The following comments and concerns were expressed at the weekly Staff
Review Meeting on December 15, 1999:
Stormwater (Basil Hamdan)
12. The grading at the southwest corner of the site does not tie into the
existing grading.
13. Obtain an easement for the necessary off -site grading and installation of
the storm sewer.
14. Show the storm sewer and trees to the west of the site.
15. The proposed gravel pack water quality structure is not acceptable to the
City Stormwater Utility.
d. Identify and label all handicap ramps on the Site Plan.
e. Label parking stall dimensions and width of driveway on the Site
Plan.
f. Is the trash bin going to be within the yard enclosure? How will it
be accessed by the trash hauler? Please clarify.
g. Show building dimensions, the building envelope, and distances
from the envelope to each property line.
h. Building -mounted lighting is noted in the General Notes on the
Site Plan but none is shown on the Building Elevations. Please
show the lights and their locations on the elevations.
i. Show the building width, as well as the length, on the Site Plan.
j. Is there going to be an outside area for animals to relieve
themselves? If so, show the location and how/ how often that area
will be cleaned up.

10. General Note 9 on the Site Plan should further commit to the rooftop and
ground -mounted mechanical equipment's compliance with Section
3.5.1(J) of the LUC, which states that it shall be screened from public
2. Dennis Greenwalt of AT&T Cable Services stated that they would like to
make the owner/developer aware of their facilities along South Shields
Street, which consist of both fiber and coax, and the coax cable that runs
along Evenstar Court. Otherwise, he sees no problems with the project.
3. Gene Fischer, representing the Larimer County Canal No. 2 Irrigating
Company, stated that this project has no effect on their canal.
4. Ron Gonzales of the Poudre Fire Authority offered the following
comments:
a. The building aggregate square footage exceeds 5,000 square feet.
The first floor shall be separated by a 1-hour occupancy separation
from the second floor or the building must be fire sprinklered.
b. Address numerals shall be visible from the streets fronting the
property and posted with a minimum 6" high numerals on a
contrasting background (example: bronze numerals on brown brick
are not acceptable).

5. A copy of the comments received from Rick Lee of the Building
Inspection Department is attached to this letter.
6. Representatives of the Zoning Department offered the following
comments:
a. What is the intended use, Animal Clinic or Hospital? Animal
Hospitals are not permitted in the NC District; therefore, the PDP
name needs to be changed to Clinic and the owner must
demonstrate that the facility will operate in the manner as set forth
for clinics. Please see the definition of Veterinary facilities, small
animal clinic in Article 5 - Terms and Definitions of the LUC (page
41).
b. Show the building height on the Building Elevations.
C. This property is in the Residential Neighborhood Sign District. The
sign locations only must be shown on the Building Elevations. This
is set forth in Section 3.8.7(E)(2) of the LUC.

Dear Greg,
Staff has reviewed your documentation for the RAINTREE ANIMAL HOSPITAL
(2335 South Shields Street), Project Development Plan - #22-98A that were
submitted to the City on November 16, 1999, and is offering the following
comments:
1. This property is located at the southwest corner of South Shields Street
and Evenstar Court, just east of the City of Fort Collins Senior Center. It
is in the NC - Neighborhood Commercial Zoning District. The proposed
animal hospital use is not permitted in this District. Is the actual use to
be a veterinary clinic, which is permitted and subject to an
administrative review (Type I) and public hearing for a decision?
Veterinary facilities, small animal clinic shall mean any facility
maintained by or for the use of a licensed veterinarian in the
diagnosis, treatment or prevention of animal diseases wherein the
animals are limited to dogs, cats or other comparable household
pets and wherein the overnight care of said animals is prohibited
except when necessary in the medical treatment of the animal.
The "overnight care" is what differentiates a clinic from a hospital. If a
permitted, Type I use, the Project Development Plan (PDP) must go to a
public hearing before an administrative hearing officer for a decision
unless any modifications of standards are required, which would
automatically change the request to a Type II, Planning and Zoning
Board review.
