Subject: Easement for Dr. Larry Magnuson
John, Dr. Magnuson from Raintree Animal Hospital is complaining about the length of time it has taken to
get his development approved and the hassle we gave him on giving him an easement through the Senior
Center parking lot. We still can't figure out what he is upset about. In our mind, we bent over backwards
to make everything work for him. The following is a chronology of his project.
August 3 1998: Letter from City telling him that CLRS staff agrees in concept to his easment proposal.
February 1, 1999: Appllicant brings a plan to conceptual review.
November 15, 1999: Letter from Ron Mills restating agreement on the easement and telling him that once
all the City's planning issues are resolved, CLRS will submit an ordinance to Council recommending
approval of the easement.
November 16, 1999: Applicant submits PDP
January 27, 2000: Letter from Dr. Magnuson's architect to Marty requesting letter giving them permission
to process minor amendment on the Senior Center property.
February 4, 2000: Letter from Marty giving them permission.
April 21, 2000: Planning - Administrative hearing officer gives appr'oval for PDP. (Steve Olt has prepared
a detailed timeline of the decision steps within the planning process. This will be sent to you if it hasn't
already.)
June 6 & 20, 2000: City Council approves easement for use of Senior Center Parking lot for the Animal
Hospital.
April 6, 2001: Applicant submits mylars of the site plan to Planning
Marty did most of the work on this easment. We believe we were good neighbors. We gave up 4 parking
spaces and had to destroy two trees to give this guy his access. The City received $ 0 and the ability to
use his parking lot as overflow parking during his non -business hours. The City gave up more than it got
in this deal.
It is interesting to note that there was a year between Planning's approval and his submittal of the site
plan.
He is now claiming that the City added to his cost because of our forced delays. The amount of time for
the PDP approval was not unusual and appeared to go pretty smooth. CLRS did not slow him up on his
easment. He took one year after approval to submit the site plan to planning.
My speculation is that they found additional development costs within their project and are now attempting
to put those costs on the City.
We are scheduled to have lunch with Dr. Magnuson on Fri. May 25.
