DECISION
Based on the findings and conclusions, the request for Rigden Farm Parkside East
Replat is approved.

A. Rigden Farm Parkside East Replat contains a permitted use in the LMN -
Low Density Mixed -use Neighborhood Zoning District.
B. The Rigden Farm Parkside East Replat request meets the procedural
requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development
Applications, and Section 2.4 - Project Development Plan located in Article
2 - Administration.
C. The Rigden Farm Parkside East Replat meets the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
AFF RECOMMENDATION
Staff recommends approval of Rigden Farm Parkside East Replat, File #56-98L.
FINDINGS AND CONCLUSIONS
After reviewing the staff report and the record of the public hearing, the Hearing Officer
makes the following findings and conclusions:
A. The Rigden Farm Parkside East Replat is subject to administrative review and
the requirements of the Land Use Code (LUC).
B. The Rigden Farm Parkside East Replat request meets the procedural
requirements located in Division 2.1 - General Procedural Requirements, Division
2.2 - Common Development Review Procedures for Development Applications,
and Section 2.4 - Project Development Plan located in Article 2 — Administration
C. The Rigden Farm Parkside East Replat is consistent with the approved Rigden
Farm Parkside East Project Development Plan.
D. The Rigden Farm Parkside East Replat meets the plat requirements located in
Section 3.3.1 - Plat Standards located in Article 3 - General Development
Standards.
E. Future development of the property will be required to meet Land Use Code
Division 2.6 DEVELOPMENT CONSTRUCTION PERMITS; and, Division 2.7
BUILDING PERMITS.

1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
2) No building permit or certificate of occupancy shall be issued for
construction of any new principal building or no act which changes the use
of any building shall be permitted until the subdivision plat is filed and
recorded in the City of Fort Collins.
B. The replat is in compliance with Section 3.3.1(B) Lots in that:
1) Each lot has direct vehicular access to a public and the side lot lines are
substantially at right angles or radial to the street lines.
2) The general layout of lots, roads, driveways, utilities, drainage facilities
and other services within the proposed development were established with
the approval, filing, and recording of Rigden Farm Filing One, and Rigden
Farm Filing Three (Parkside East PDP). The design of the adjacent platted
roads are unaffected.
C. The replat is in compliance with Section 3.3.1(C) Public Sites, Reservations
and Dedications in that:
1) The rights -of -way for the adjacent streets (Rigden Parkway, Canby Way,
and Des Moines Drive) were dedicated with Rigden Farm Filing One. The
drainage and utility easements necessary to serve this area were
dedicated with the original Rigden Farm Filing Three plat (Parkside East
PDP) that is on record in the City of Fort Collins. The new lot and
easement configurations continue to adequately serve the access, utility,
and drainage needs.
FINDINGS OF FACT
After reviewing the Parkside East Replat, File #56-98L, staff makes the following
findings of fact and conclusions:

BACKGROUND
The staff report states the following:
Background
The surrounding zoning and land uses are as follows:
N: LMN —A portion of Rigden Farm First Filing,
T — Cargil Research Farm, historic barn, farm land,
E: LMN — undeveloped phases of the Rigden Farm Development, approved filing 1
of Rigden Farm (under construction),
S: LMN — undeveloped phases of the Rigden Farm Development, a neighborhood
center (under construction) including relocated Johnson Farm structures
RL — existing Dakota Ridge and Stone Ridge Residential Developments,
W: LMN —Approved 2Id filing of Rigden Farm (not yet developed),
MMN & NC — undeveloped phases of the Rigden Farm Development.
Parkside East is approved for 38 multi -family housing units in 4-plex and 6-plex
buildings and a pool and clubhouse facility on 3.24 acres of land within the Rigden Farm
Development, The approved density is 11.75 dwelling units per acre. The site is
located at the northeast corner of Rigden Parkway and Des Moines Drive, in the LMN
zone district. All approved units are 2-bedroom units.
As part of the final compliance review, staff will require that the street maintenance
general note be included on the plat, and also, the staff will require the title of the plat to
be revised to reflect that this is a replat of the original Parkside East Plat.
2. Compliance with the Overall Development Plan
The Rigden Farm Overall Development Plan was approved on April 15, 1999. This 3.24
acre Project Development Plan is part of a 34.36 acre parcel identified on the ODP as
"parcel H." Since the proposed replat request does not affect the approved PDP, the
proposed replat continues to comply with the approved ODP.
3. Article 3 of the Land Use Code — General Development Standards
The request complies with the applicable requirements of the LUC, specifically the plat
requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
A. The replat is in compliance with Section 3.3.1(A) General Provisions in
that:

NOTICE OF PUBLIC HEARING: Notice of public hearing was made on February 14,
2001 by mailing to property owners within 1,000 feet of the subject property.
The public hearing was advertised in the Coloradoan.
PUBLIC HEARING
After reviewing the Staff Report and recommendation, a public hearing was held on the
subject application at 4:00 PM on June 28, 2001. The hearing was held in Conference
Room A at 281 North College, Fort Collins, Colorado.

PROJECT DESCRIPTION:
This is a request to replat the property known as Rigden Farm Parkside East from one
lot to 8 lots. The approved P.D.P. for the site is unaffected by the replat.
SUMMARY OF RECOMMENDATION AND DECISION:
