Is space available in the existing enclosure to accommodate the additional usage? If additional containers are ever required they will be required to be enclosed and future modifications of the enclosure or construction of a new enclosure will require City approval Response: No modifications to the trash enclosure are anticipated at this time. The existing trash enclosure is adequate for the additional usage 2 Department: Engineering Development Review Contact: Morgan Uhlman, 970-416-4344, muhlman@fcgov.com Topic: General Comment Number: 1 Comment Originated: 09/11/2019 09/11/2019: For Information: In my conceptual comments I made the comment that a repayment was due to the City for the frontage improvements that were installed on Lincoln Ave frontage. I have found a receipt that this payment has been made and this obligation is satisfied for Lot 1 of the Patrick Subdivision. I have put a copy of this receipt in the project folder. Response: Acknowledged. Thanks! Comment Number: 2 Comment Originated: 09/11/2019 09/11/2019: For Hearing: A letter of intent will be needed prior to scheduling the hearing for this project from the property to the north that the re-aligned access is okay where it is shown. Ultimately, the City will need to see the easement for this access road signed by the property owners. Response: Letter of intent has been included in the submittal. Comment Number: 3 Comment Originated: 09/19/2019 09/19/2019: For Approval: The proposed fence along the frontage is located in the right-of-way. More discussion is needed internally about this fence location. Private fences should be located out of the right-of-way or a major encroachment permit will need to be submitted and approved before it is allowed to be built in the right-of-way. Response: The project will apply for a revocable ROW encroachment permit. Given the narrative provided - when the previous approved use is compared to the new use, the additional traffic does not meet the threshold of requiring a traffic impact study (TIS). The need for a TIS is waived. Response: Acknowledged. They will discuss the looped access to the neighboring Lot to the east. Response: The Emergency Access Easement has been redesigned and been connected NW to the existing EAE along the north side of 800 Lincoln as well as looping to the east onto the property at 832 Lincoln. >If MAQs in the winery are exceeded then additional upgrades will be required. Response: Acknowledged. 09/13/2019: FIRE LANE >It is understood from this submission that the project team is proposing to link the Emergency Access required for 824 East Lincoln to the neighboring west property 820 East Lincoln. This will satisfy the need for an approved turnaround but will not provide access to the east side of the 824 building which was discussed at the last staff review meeting. Response: Access to the east side of the buildings on 824 Lincoln has been provided by looping the fire lane through the property at 832 Lincoln. >This building is 50ft out of compliance for access. UPDATE after staff review meeting There is an existing fire lane that links to the property to the east which will be shown on the site plan at the next submission. Location of fire lane signage will be discussed at that time. Thank you. Response: This has been shown on the site plan PFA will likely have further comments depending upon MAQs of products and their storage. Response: Acknowledged. ACCESS >Access is required to within 150ft of all portions of the exterior perimeter of these buildings. >This cannot be measured from Lincoln Avenue because it is classified as an arterial street therefore a Fire Lane will be required on the property to achieve this access and shown on the Plat as an Emergency Access Easement or dedicated by separate document. >In order to achieve this access the fire lane will be greater than 150ft in length therefore an approved turnaround will be required. Response: The fire lane has been redesigned to meet these requirements. Comment Number: 2 Comment Originated: 09/13/2019 09/13/2019: OCCUPANT LOAD 4 >Please note that should the occupant load of any assembly area exceed 49 persons, then two approved exits will be required >Should the occupant load be greater than 99 persons, then an automated fire sprinkler system will be required. Response: Acknowledged. Please clarify the size of the disturbed area. If the disturbed area exceeds 10,000 square feet then, an Erosion Control Plan and Report would be required per City criteria. The erosion control requirements are located in the Stormwater Design Criteria in Chapter 2 Section 6.0 a copy of the requirements can be found at www.fcgov.com/erosion Response: An erosion control plan and details are included with the utility plans. Contact: Matt Simpson, (970)416-2754, masimpson@fcgov.com Topic: General Comment Number: 2 Comment Originated: 09/17/2019 09/17/2019: FOR FINAL APPROVAL: The proposed bridge crosses through the existing drainage easement on 800 E. Lincoln. You will need to show that the bridge abutments do not impact the function of the existing drainage channel and pond. The low chord of the bridge must be more than 1-foot above the 100-year WSEL of the existing pond. The drainage easement must be vacated around the bridge abutments. Response: The bridge has been removed from the project. Comment Number: 3 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: Please document the pavers run-on area ratio. The FCSCM allows a 3:1 runon-to-pavers area ratio. Feel free to contact me if you have questions. Response: The runon-to-pavers ratio is documented in the drainage report. The runon-to-pavers ratio is less than 3:1. Comment Number: 4 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: Please verify that all of subbasin A will drain to the proposed permeable paving. Please update the plans accordingly. The flow arrows on the drainage plan are unclear if all surface runoff will flow to the pavers. Response: Sub-Basin A was divided into two separate basins. Sub-basin A1 flows towards the permeable pavers. Sub-basin A2 flows towards the East Pond on 800 E. Lincoln Avenue. Flow arrows were updated accordingly. 5 Comment Number: 5 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: Please show more detail on the grading plan for the proposed berm on the south side of the site. Response: The berm is shown on the grading plans. Comment Number: 6 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: How will offsite flows from the steeper slopes north of the property be handled? Because this site plan proposes permeable pavers, the permanent stabilization of upstream areas is essential for long-term success and maintenance of the pavers. How will the soil in the ‘OS’ basin be stabilized (recognizing that this area is offsite) or the flows from this area diverted around the pavers? Response: A swale and inlet was installed along the north property line to divert offsite flows into the existing storm sewer. This swale will prevent flows from Subbasin OS-1 and OS-2 from impacting the permeable pavers. Comment Number: 7 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: Please see redlined plans and drainage report for other comments. Response: Redlines were update City comments. Comment Number: 8 Comment Originated: 09/17/2019 09/17/2019: FOR HEARING: In the drainage report, please clearly explain if all detention for 824 E. Lincoln will now be completely handled onsite, or if a portion of the 824 flows will still be handled in the “Odell East Pond” on the 800 E. Lincoln property. Response: A portion of 824 E. Lincoln Ave (Sub-Basin A2) will still flow towards the Odell East Pond on 800 E. Lincoln Avenue. Comment Number: 9 Comment Originated: 09/17/2019 09/17/2019: FOR INFORMATION: Thank you for providing the detention storage that was deficient from previous site changes. Response: The permeable pavers storage capacity was sized to provide the water quality for 824 E. Lincoln Avenue and the shortfall that occurred within the East Detention Pond on 800 E. Lincoln Avenue. Response: Native seed mix notes have been added to the landscape plan. Comment Number: 4 Comment Originated: 09/17/2019 09/17/2019: FOR APPROVAL. Submit photometric plan and luminaire 8 schedule. Site light sources shall be fully shielded and down-directional to minimize up-light, spill-light, glare and unnecessary diffusion on adjacent property [see LUC 3.2.4(D)(3)]. All lighting shall have a nominal correlated color temperature (CCT) of no greater than three thousand (3,000) degrees Kelvin [see LUC 3.2.4(D)(11)]. Please also consider fixtures with motion-sensing or dimming capabilities so that light levels can be adjusted as needed. Response: Site Photometric Plan has been included in this submittal. Comment Number: 5 Comment Originated: 09/17/2019 09/17/2019: INFORMATION ONLY. Please consider adding wildflowers to areas seeded with native grasses and especially if no broadcast herbicide application is expected to manage weeds during the establishment period. Adding wildflowers adds color, interest and assists native pollinators, and is aligned with the Fort Collins Nature in the City Strategic Plan. There are several "alternative lawn grass and wildflower seed mixes" available commercially if desired, for example, the Western Native Seed High Plains Foothills Wildlflower Mix and/or the Meadow Mix. https://www.fcgov.com/natureinthecity/ https://www.westernnativeseed.com/mixesintro.html Response: Wildflower seed mix has been incorporated into the plans. Department: Forestry Contact: Molly Roche, 224-616-1992, mroche@fcgov.com Topic: Landscape Plans Comment Number: 4 Comment Originated: 09/16/2019 9/16/2019: In the tree mitigation table, please include mitigation values for TR-7 (1.5) ad TR-8 (1.5). The new total required mitigation trees equals 5 (4.5 rounded up). The TR-# labels are off in the table. TR-7 should be TR-5, TR-8 should be TR-6, TR-9 should be TR-7, and TR-10 should be TR-8. TR-4 should be labeled as OFF PROPERTY. Response: Tree mitigation table has been updated. After reviewing the location of the property line, the existing fence is inset on the 824 Lincoln Property and many of the trees thought to be off property are located on the 824 Lincoln Property. One street tree will need to be removed due to the installation of the new water line. A new tree is proposed to replace that tree in the same location, shifted to avoid the water line. Comment Number: 5 Comment Originated: 09/16/2019 9/16/2019: Please provide reason for removing TR-4, TR-5, and TR-6. A new requirement, “Existing Tree Removal Feasibility Letter” should be submitted to City Forestry and the Project Planner for review. Proposals to remove significant existing trees must provide a justification letter detailing the reason for tree removal. This is required for all development projects proposing significant tree removal regardless of the scale of the project. The purpose of this letter is to provide a document of record with the 9 project’s approval and for the City to maintain a record of all proposed significant tree removals and justifications. Existing significant trees within the project’s Limits of Disturbance (LOD) and within natural area buffer zones shall be preserved to the extent reasonably feasible. Streets, buildings and lot layouts shall be designed to minimize the disturbance to significant existing trees. (Extent reasonably feasible shall mean that, under the circumstances, reasonable efforts have been undertaken to comply with the regulation, that the costs of compliance clearly outweigh the potential benefits to the public or would unreasonably burden the proposed project, and reasonable steps have been undertaken to minimize any potential harm or adverse impacts resulting from noncompliance with the regulation.) Where it is not feasible to protect and retain significant existing tree(s) or to transplant them to another on-site location, the applicant shall replace such tree(s) according to City mitigation requirements. Response: Letter has been included in the submittal. Comment Number: 6 Comment Originated: 09/16/2019 9/16/2019: Three trees that are off-property are proposed to be removed. In the next submittal, please provide written approval by the adjacent property owner that grants permission to remove these trees. Any off-property pruning that will occur should be approved by the adjacent property owner as well. Response: Off property tree removals have been approved by the adjacent property owner. Written approval will be provided once obtained. Comment Number: 7 Comment Originated: 09/16/2019 9/16/2019: On the Overall Landscape Plan, please show trees to be removed with a X over the symbol. On the Wine Garden Landscape Plan, please do not show the symbols for trees to be removed. Response: Symbols have been shown as requested. Comment Number: 8 Comment Originated: 09/16/2019 9/16/2019: According to Land Use Code 3.2.1.(D)(c), canopy shade trees shall constitute at least (50%) of all tree plantings. This plan does not include any canopy shade trees. My suggestion would be to swap the Spring Snow Crabapples for Hot Wings Maple and change the Hot Wings Maple to (4) canopy shade trees such as Kentucky Coffeetree ‘Espresso’, London Planetree ‘Exclamation’, Shumard Oak, or Sugar Maple ‘Fall Fiesta’ or ‘Green Mountain’. Additional shade would be nice for the outdoor seating area. Response: Shade trees have been added. 41% shade tree ratio has been achieved. Comment Number: 9 Comment Originated: 09/16/2019 9/16/2019: Please identify mitigation trees with a “M” on the landscape plan.
