Mark,
Thanks for your time earlier. As I mentioned on the call, we are agreeable to your proposal and want to be a good
neighbor. Our only request is that your team pay any expenses we incur related to these easements and indemnify us
for any potential damage. I hope your team views that as reasonable.
Rob Holt (cc) our legal counsel will draft a simple agreement to that end. Please let us know if you have a legal counsel
you’d like for us to correspond with on this matter or if we should send the agreement to you directly.
Also please let us know if we can be helpful in any other ways, today or in the future.
Thank you
Matt

Hi Mark,
We certainly want to be a helpful and accommodating neighbor. I need to ensure such
easements don’t impact our ability to expand in the future, as we are considering
expanding south at some point. I’ll discuss with our legal team and capital projects
team. Get back to you soon.
Matt

Attached is an exhibit showing the easements that we are requesting.
We are requesting sewer and water easements. We are also requesting
a temporary access easement for a turnaround. This will ultimately be
temporary but will probably be there for some time until Mars Road is
extended. Thank you for entertaining our request. We were a little
surprised that they weren’t already in place. In any case we would
certainly appreciate help with this. We don’t believe that these requests
should have any real impact on the function of your facility. Please
contact me with any questions or if you need additional information.
Again, thank you for entertaining our request.
Best Regards,
Mark
