2.8.1

Purpose
and
Applicability
The
decision
maker
is
empowered
to
grant
modifications
to
the
General
Development
Standards
contained
in
Article
3
and
the
Land
Use
Standards
and
Development
Standards
contained
in
Article
4
and
any
separation
or
proximity
standards
that
are
established
as
a
specific
measurement
of
distance
in
the
District
Permitted
Uses
There
are
4
private
residential
parking
stalls
provided
for
the
project.
Based
on
the
table
1
accessible
stall
is
required.
We
request
modification
of
the
standard
to
not
require
the
single
accessible
space.
Requiring
the
handicap
space
would
reduce
the
already
small
number
of
onsite
parking
stalls
provided.
The
parking
spaces
serve
the
residential
uses
only.
There
are
no
accessible
units
in
the
project;
so
needing
to
provide
an
accessible
space
is
counterintuitive
since
there
would
be
no
demand
for
it
from
a
resident.
Other
uses
in
the
building
are
exempt
from
minimum
parking
requirements
and
are
served
by
on
street
parking.
Currently
there
is
a
single
ADA
stall
at
the
front
of
the
building
that
can
support
the
commercial/retail
area
of
the
project.
We
believe
this
modification
would
not
be
detrimental
to
the
public
good,
and
that
it
affects
the
standard
in
a
nominal,
inconsequential
way.
The
parking
provided
is
entirely
private
and
this
modification
would
not
hinder
the
public
from
accessing
the
project.

Step

(Standards):
Applicable,
and
the
decision
maker
may
grant
a
modification
of
standards
only
if
it
finds
that
the
granting
of
the
modification
would
not
be
detrimental
to
the
public
good,
and
that:
(4)
the
plan
as
submitted
will
not
diverge
from
the
standards
of
the
Land
Use
Code
that
are
authorized
by
this
Division
to
be
modified
except
in
a
nominal,
inconsequential
way
when
considered
from
the
perspective
of
the
entire
development
plan,
and
will
continue
to
advance
the
purposes
of
the
Land
Use
Code
as
contained
in
Section
1.2.2.
MODIFICATION
REQUEST:
According
to
3.2.2(K)(5)(d):
Each
parking
lot
shall
contain
at
least
the
minimum
specified
number
of
handicap
spaces
as
provided
in
the
table
below.
Regardless
of
the
number
of
handicap
spaces
required,
at
least
one
(1)
such
space
shall
be
designated
as
a
van-‐
accessible
space,
and
must
be
a
minimum
of
eight
(8)
feet
wide
and
adjoin
a
minimum
eight-‐foot-‐wide
access
aisle.
