Daniel,
I have been directed back to the South 13 Subdivision plat dated November 15, 1976, in which a frontage road was
created. Although labeled US 287 Frontage Road, it was never deeded to or accepted by CDOT. Our ROW of 75 feet off
centerline takes us to the west curb line of the frontage road (1957, project C06-0001-15).
We do not know if Larimer County accepted this frontage road by resolution.

This is good news, but we have spent sometime pursuing compliance with CDOT's preferences on this based on FT
Collins assertion that CDOT had jurisdiction.
We are making a final submittal this week, so having the ownership of the right of way defined or agreed to between
ftcollins and CDOT at this time is important to prevent further delay in meeting development requirements.

A turn of events. I submitted the information for approval for the lease and was told we do not own the frontage
road at that location. Our ROW ends at the west curb of the frontage road. The plat dedicated the frontage road to
the County. Whether the County accepted it by resolution, I do not know.

regarding your e-mail here and I've been slow with responding to that meeting. Comments are below in Red:
When you review the Site plan you will find that the existing parking within the 287 frontage right of way has
been clearly designated on the site plan as public parking. We've talked internally and would rather the plat
reflect the existing area as "CDOT right-of-way" versus "Public Parking". We worry the "Public Parking"
connotation creates some level of understand that the spaces will always be allowed to remain.
The City wants direction from CDOT as to weather the public parking in the right of way will be required to be
removed, or allowed to remain. This affects what they will require for landscaping of the site frontage.
Ideally the parking spaces will be removed and re-landscaped. Any landscaping in the CDOT right-of-way will
need to be conducted with a CDOT Landscaping Permit. Our regulations state that the issuing authority (Fort
Collins) must be listed on the landscaping permit as the ultimate permittee with the business listed as the
applicant. Having said that, we realize the current location of the right-of-way line makes this site potentially a

unique circumstance. CDOT would at least discuss with the City about having a landscaping permit issued
solely to the applicant.
The City parking requirements for the Site are met by the parking spaces designated on site and the public
spaces in the CDOT right of way are not counted or relied upon to meet planning requirements for the
proposed site plan.
Because the spaces in the right of way are not needed, and there will be a note on the site plan designating
them as public for general publics use, my client does not intend to enter into the CDOT rental agreement.
Obviously the comments above eliminate the need for the CDOT rental agreement. In the event that the
parking spaces need to remain for some reason, CDOT feels that a plat note of "These parking spots are for
the public" is not sufficient and would pursue the rental agreement. The spots will be behind the existing
physical curbed entrance to this business. Regardless of what the plat states, in practice these spots will
solely serve this business directly.
I don't believe it will come to this as there doesn't seem to be a compelling reason for the developer to
maintain the spots.

Hello again. I communicated with you both in April about my clients proposed site development plan in
Fort Collins. 5724 South College Avenue.
We have submitted our Site plan application to Fort Collins and it is official name is Elite Infused
BDR180013 the City of Fort Collins Project Planner is Kai Kleer. 970 416 4284
The submittal was made in April and the City has completed their comments round and delivered
