Canopy shade trees: 3.0” caliper balled and burlap or equivalent

business and multifamily complexes subscribe to recycling service by the end of 2020
that is at minimum 1/3 of their overall service capacity(total bin capacity x number of

Grow facilities for marijuana must meet minimum fire hazard and exit requirements. The
applicant is responsible for obtaining and completing a "Marijuana Check Sheet". The
check sheet is available from the the City of Fort Collins at such time a business permit
is obtained. The completed check sheet is to be returned to the Poudre Fire Authority
as directed. This document will be reviewed with the applicant at time of final
inspection. For more information, contact PFA Fire Inspector/Plans Examiner, Kerry
Koppes at 416-4241. [No such checklist has been able to be produced by Ft
Collins for applicants review and compliance. We request removal of condition.]

However, the new site plan appears to indicate that the slope of this fire lane is
up to 11.8%. The maximum acceptable slope for an approved fire lane is 10%.
Some clarification of this will be required before the proposal can be accepted.
Should the slope of the fire lane be greater than 10%, then the requirement will
be that the east building will be designed with an approved fire sprinkler

system. [Acknowledged – On June 21st a detailed grade analysis was
provided to staff depicting the exact grades that would be experience by
the model fire apparatus based on its wheel base. All grades on the only
available paths for the apparatus were below 10%. The exhibit was
acknowledged as demonstrating compliance with the standard on July
21st 2018. See Submital Reference documents 34 & 34a]

A determination from CDOT has not been been made whether or not parking will
be permitted to remain. [CDOT Confirmed no ownership of frontage road right
-of-way, See Comment response to Engineering # 4 and references for
detail. Ft Collins is the jurisdiction with authority to administer the right-of-
way] Two different scenarios could happen. If CDOT permits the existing parking
to remain the landscape median will need to be brought into compliance by
replacing dead or dying shrubs, adding a street tree, and installing plant material to
the north and south side of the parking lot perimeter. If CDOT does not permit the
existing parking to remain, the parking area will need to be removed and planted
with grass, street tree, and landscaping. [The existing public parking and

landscaping was requested, reviewed and approved by Larimer County and
Ft Collins in a previous approved Site Plan for the site. The property, right of
way, and improvements within the right-of-way were Annexed by Ft Collins in
2003 by Ordinance. It is our position that the parking curb gutter and paving
have been previously approved by Ft Collins on two previous occasions and
therefore does not meet the Code definition of an encroachment. The rights
and responsibilities for liability and maintenance of these improvements
curb, gutter, pavements are defined in municipal code so no special
agreement is needed between the property owner and the city]
[The existing parking spaces in the right-of-way are not counted in the Site
plan parking counts and are not required to meet the parking standards for
the two buildings on the adjacent Site and notes have been addd to the site
plan clarifying this.]

submitted Planning Materials it has been determined that this site; disturbs less
than 10,000 sq. ft., is not in a sensitive area, has no steep slopes (greater than
3H:1V), and is not part of a larger common development under construction.
Therefore, no submittal of Erosion Control Materials are needed at this time (if this
site substantially changes in size or design where the above criteria are anticipated,
erosion control materials should be submitted in such a case). Though the site at
