Provision of water quality treatment for 100% of the improvements - Volume 3, Chapter 4, Section 4.5.5
The existing conditions of the site prevent the berm surrounding the detention pond from being raised higher than proposed.
Significantly altering the grades of the strips of proposed sidewalk not being treated would cause damage to existing trees.
The strips of proposed sidewalk cannot be graded to drain to the detention pond while maintaining the intended function of the existing drainage facility and site grades.
Water quality treatment is being provided for 86% of the hardscape improvements via rain garden or similar and grass buffers or existing water quality pond A.

The owner agrees to comply with the provisions of the zoning ordinance, building code and all other
applicable sections of the City Code, Land Use Code, City Plan and all other laws and ordinances
affecting the construction and occupancy of the proposed building that are not directly approved by
this variance. The owner understands that if this variance is approved, the structure and its occupants
may be more susceptible to fl ood or runoff damage as well as other adverse drainage issues.
