RE: Crestridge Drive Realignment
FOSSIL CREEK APARTMENTS
Dear Staff:
It is our understanding that the Fossil Creek Apartments project requires additional access to
Highway 287. The intent is to provide a right-in/right-out at the north access to the site along with
access at Crestridge Drive. The alternative option of improving Venus Avenue is believed to be
infeasible and comes with significant opposition from the neighboring subdivision to the south.
It has been requested that if the Crestridge Drive access is used to provide the secondary access,
Crestridge Drive be relocated to align with Smokey Street and signalized in order to provide full-
movement access. This alignment would divide the current Tynan’s Nissan dealership and
construction would render the business inoperable until additional accommodations are provided to
the north of the new Crestridge Drive realignment and reconstruction to the south has been
completed.
It is the full intent of all owners of the Vineyard ODP properties to participate and cause the
realignment to be built before traffic generated by the properties negatively impacts any existing
facilities. The plans, however, must be separated to depict portions of the infrastructure that is
buildable for each property owner at the time of approval.
It is our intent to provide preliminary alignment and street plan and profiles with the PDP for Fossil
Creek Apartments, showing feasibility of the ultimately realigned Crestridge Drive. The
improvements for the connection of the private drive to Venus Drive and associated reconstruction
of Venus Drive as required for cohesive construction, will be designed with FP of the apartments
project itself. The final realignment plans for Venus drive will be designed during the site planning of
the Tynan’s dealership. An interim connection of Crestridge Drive to HWY 287, providing temporary
access at right-in/right-out for the apartments during construction, will be designed with the Fossil
Creek Apartments FP providing sacrificial improvements as needed.
When the realignment of Crestridge Drive is designed with the Tynan’s dealership site plan, the
parking facilities can be designed concurrently so as to provide proper and cohesive connections to
the new and reconstructed facilities. This will allow the approval of the Fossil Creek Apartments FP
to proceed according to and with reliance on the ODP to provide the framework for development of
the Tynan’s property with required access realignment.
We understand that no certificates of occupancy and/or building permits as deemed appropriate by
the City would be provided for the apartment complex until all traffic related improvements are

installed and accepted by the City as appropriate. This should be agreed to and memorialized by
development agreements between the City and the developer prior to approval of the project. The
property owners can also provide agreements prior to FP approval, between each other to perform
upon the realignment of Crestridge Drive and signalization at such time that they are required.
We hope that this proposal is acceptable and that the City will allow us to provide acceptable
solutions for any staff concerns.
