RE: LETTER OF INTENT REGARDING OFF-SITE EASEMENT AND OFF-SITE-RIGHT-OF-WAY
To whom it may concern:
Engineering Department
These statements are being provided to allow all three properties, parcel #’s 9611100901,
9611100003 and 961110003, to share in the development of Venus Avenue as well as shared
detention, site access and utilities; among the three ownership entities. The items below must be
negotiated in the time for the final development plan submittal.
• The shared private and emergency access to Fossil Creek Apartments through the Vineyards
property, from the south, along with utility for waterline connection under that road
• The intent to provide shared detention in 2 detention ponds per the ODP
• Drainage easement to convey stormwater from Venus Avenue to and through the shared
detention pond
• Intent to allow relocation of the sanitary sewer if necessary to provide ultimate grading and
detention pond sizing per the ODP.
• Intent to provide the additional right of way and/or access and utility easement for Venus
drive and participate fully in the shared improvements for implementation of the ODP.
• Intent to provide the additional right of way for and to participate fully in the improvements
related to the realignment of Crestridge Drive including vacation of old Crestridge Drive right
of way and final design of Crestridge to meet the require access needs.
• Intent to provide maintenance agreement for the two shared detention ponds per the ODP.
