HomeMy WebLinkAboutHIGHWAY I-25 THIRD ANNEXATION & ZONING - ANX170004 - SUBMITTAL DOCUMENTS - ROUND 1 - ANNEXATION DOCUMENTS (19)TOWN OF WINDSOR ORDINANCE NO. 2002 - 1109 BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY KNOWN AS THE FOSSIL CREEK MEADOWS ANNEXATION" TO THE TOWN OF WINDSOR, COLORADO. WHEREAS, pursuant to the Municipal Annexation Act of 1965 and the Code of the Town of Windsor, an annexation petition has been filed with the Town Clerk requesting the annexation of certain territory more fully described thereafter; and WHEREAS, the Board of Trustees has found and concluded that the aforesaid annexation petition meets the requirements as set forth in § 31 -12 -104 and 31 - 12 -105 C.R.S.; and WHEREAS, pursuant to this ordinance, a public hearing on the aforesaid annexation petition was held before the Board of Trustees on February 28, 2000; and WHEREAS, a community of interest exists between the territory to be annexed and the Town ofWindsor; and WHEREAS, not less than one -sixth of the perimeter of the area to be annexed is contiguous to the Town ofWindsor; and WHEREAS, the territory to be annexed is urban or will be urbanized in the near future and has been integrated or is capable of being integrated within the Town ofWindsor; and WHEREAS, the Board of Trustees finds that all provisions of the Municipal Annexation Act of 1965 have been complied with; and WHEREAS, the petitioner has agreed to comply with all of the ordinances of the Town of Windsor and to pay all of the fees set out in those ordinances in connection with this annexation; and WHEREAS, an annexation agreement outlining all of the conditions of said annexation shall be executed between the petitioner and the Town of Windsor and shall be recorded in conjunction with the recordation of the Annexation Map in the Office of the Larimer County Clerk and Recorder; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS: 1. That the territory to be annexed is located in the County of Larimer, State of Colorado and is precisely described in " Exhibit A" which is attached hereto and incorporated herein by this reference. 2. That the described property is hereby annexed to the Town of Windsor. EXHIBIT "A" LEGAL DESCRIPTION ( FOSSIL CREEK MEADOWS) A PARCEL OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 10, THE WEST HALF OF SECTION 14, AND THE EAST HALF OF SECTION 15, T6N, R68W, OF THE SIXTH PRINCIPAL MERIDIAN; COUNTY OF LARIMER, STATE OF COLORADO; BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE EAST QUARTER CORNER OF SAID SECTION 15 AND CONSIDERING THE . That the annexation of the aforesaid territory shall be deemed complete on the effective date of this ordinance, except for the purpose of general property taxes pursuant to § 31 -12 -113, C.R.S. 4. That the territory annexed by this ordinance shall be known as the " Fossil Creek Meadows Annexation." 5. That the territory to be annexed shall be zoned as GC -PUD, General Commercial - Planned Unit Development, District and RMU, Residential Mixed Use, District as shown on the Annexation Map on file in the office of the Director of Planning for the Town of Windsor, Colorado; and 6. That the Official Zoning District Map of the Town of Windsor shall be changed in accordance with this ordinance, and entries shall be made thereon noting the annexation of the aforesaid territory. Such entries, together with a brief description of the nature of the change, shall be signed by the Mayor of the Town of Windsor, attested to by the Town Clerk and properly filed with the Larimer County Clerk and Recorder.
