ORDINANCE NO. 2006- 1234
BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY KNOWN AS THE
WINDSOR HIGHLANDS TENTH ANNEXATION" TO THE TOWN OF WINDSOR,
COLORADO
WHEREAS, pursuant to the Municipal Annexation Act of 1965 and the Code of the Town of
Wmdsor, an annexation petition has been filed with the Town Clerk requesting the annexation of
certain territory more fully described hereafter; and
WHEREAS, the Town board has found and concluded that the aforesaid annexation petition
meets the requirements as set forth in § 31 -12 -104 and 31 -12 -105 C.R.S.; and
WHEREAS, pursuant to this ordinance, public hearings on the aforesaid annexation petition
were held before the Windsor Planning Commission on September 1, 2005 and before the Windsor
Town Board on September 12, 2005; and
WHEREAS, a community of interest exists between the territory to be annexed and the Town
ofWmdsor; and
WHEREAS, not less than one -sixth ofthe perimeter ofthe area to be annexed is contiguous to
the Town ofWmdsor; and
WHEREAS, the territory to be annexed is urban or will be urbanized in the near future and has
been integrated or is capable ofbeingintegratedwithinthe Town of Wmdsor, and
WHEREAS, the Town Board finds that all provisions of the Municipal Annexation Act of
1965 have been complied with and
WHEREAS, the petitioner has agreed to comply with all of the ordinances of the Town of
Wmdsor and to pay all ofthe fees set out in those ordinances in connection with this annexation;
NOW, THEREFORE, BE IT ORDAINED BY' 1HE TOWN BOARD OF THE TOWN
OF WINDSOR, COLORADO, AS FOLLOWS:
That the territory to be annexed is located in the County ofLarimer, State ofColorado
and is precisely described in "Exhibit A" which is attached hereto and incorporated
herein by this reference.
2. That the described property is hereby annexed to the Town ofWmdsor.
That the annexation ofthe aforesaid territory shall be deemed complete on the effective
date of this ordinance, except for the purpose ofgeneral property taxes pursuant to §
31 -12 -113, C.R.S.
4. That the territory annexed by this ordinance shall be known as the " Windsor
Highlands Tenth Annexation."
That the territory to be annexed shall be zoned with an appropriate zoning classification
following the effective date ofthis annexation, with such zoning classification thereafter
being shown on the Official Annexation Map on file in the office of the Director of
Planning for the Town ofWindsor, Colorado; and
6. That the Official Zoning District Map of the Town of Wmdsor shall be changed in
accordance with this ordinance and in accordance with the zoning classification
assigned to the subject property following the effective date of this annexation on said
Official Annexation Map, and entries shall be made thereon noting the annexation of
the aforesaid territory. Such entries, together with a brief description of the nature of
the change, shall be signed by the Mayor of the Town of Windsor, attested to by the
Town Clerk and properly filed with the Weld County Clerk and Recorder.

Township Six North (T.6N.), Range Sixty -eight West (R.68W.) of the Sixth Principal Meridian (6`h
P.M.), County of Larimer, State ofColorado, and being more particularly described as follows:
BEGINNING. at the South Quarter (S1/ 4) Corner of said Section 22, and assuming the South line
of said SE1 /4 as bearing North 88 °59' 51" East, being a Grid Bearing of the Colorado State Plane
Coordinate System, North Zone, North American Datum 1983/ 92, a distance of2688.93 feet with
all other bearings contained herein relative thereto:
