PROPOSED MIDTOWN GARDENS MARKETPLACE
Know all persons by these presents, that the undersigned owners) of the following described land:
Parcel A:
Tracts 1, 2, and 4, of K-mart Plaza, and all of tract 2 of the Extension of K-mart Plaza;
Except that portion described in book 1605 at page 310, Larimer County records;
and except that portion taken and condemned by the city of Fort Collins, Colorado, a municipal
corporation, by rule and order recorded December 27, 1996 at reception no. 96092189, and further
excepting that parcel as conveyed to the city of Fort Collins, Colorado in deed recorded August 28,
2014 at Reception No. 20140048656, county of Larimer, state of Colorado.
Parcel B:
Tract 1 of the Extension of K-mart Plaza, excepting therefrom that parcel of land as conveyed to the
city of Fort Collins, Colorado in deed recorded may 13, 2011 at reception no. 20110028621 County
of Larimer, state of Colorado.
Parcel C:
A tract of land located in the se 1/4 of Section 23, Township 7 North, Range 69 W of the 6th P.M.
city of Fort Collins, county of Larimer, state of Colorado, being a portion of that tract of land
conveyed to the city of Fort Collins described in the quit claim deed recorded April 3, 2012 at
Reception No. 20120021853, office of the Larimer County clerk and recorder being more
particularly described as follows:
Commencing at the se corner of said Section 23, and considering the south line of the se 1/4 of said
Section 23 to bear n 89° 26’ 43” w, said line being monumented on both ends by a 3” aluminum
cap. Based upon gps observations and the city of Fort Collins coordinate system, with all bearings
contained herein relative thereto:
Thence along the south line of the se 1/4 of said Section 23 N 89° 26’ 43’ W. a distance of 732.56
feet to a point on the southerly extension of the easterly line of the tract conveyed in said quit claim
deed; thence along said southerly extension and along said easterly line. N 01° 23’ 12” E, a distance
of 305.59 feet to the point of beginning; thence 19.97 feet along the arc of a curve to the left having
a radius of 74.55 feet, a central angle of 15° 20’ 53”, and a chord which bears N 20° 56’ 03” W, a
distance of 19.91 feet: thence N 28° 36’ 48’ W, a distance of 39.85 feet; thence N 01° 23’ 12” E , a
distance of 426.38 feet to a point on the north line of the tract conveyed in said quit claim deed;
thence along said north line S 89° 26’ 43” E, a distance of 27.49 feet to the ne corner of said tract;
thence along the east line of said tract, S 01° 23’ 12” W, a distance of 479.71 feet to the point of
beginning.

Have caused the above described land to be surveyed and subdivided into lots, tracts, and streets
as shown on this plat to be known as Midtown Gardens Marketplace, subject to all easements and
rights-of-way now of record or existing or indicated on this plat.
