2. Developer shall ensure that the Landscape Plan is coordinated with the plans done by other
consultants so that the proposed grading, storm drainage, or other construction does not conflict nor
preclude installation and maintenance of landscape elements.

8. Signage to comply with City of Fort Collins Sign Code. Monument signs indicated on plans are for
reference only and shall be approved through separate sign permit(s).
9. Other than for Phase One for which final design and easements shall be included as a part of the
Final Development Plan documents, buildings, parking, landscaping and other site elements are not
indicated in final detail with this Site Plan, Landscape Plan, Lighting Plan, and/or Building Elevations.
Final design shall be provided, approved, and accepted concurrent with and prior to the approval of the
minor amendment(s) for each additional phase(s), building(s) and/or prior to the start of any
construction work on these items, provided that the Minor Amendment does not result in a change in
character of this development. Each Minor Amendment for future buildings shall include a Traffic
Impact Analysis if applicable.
10. A variance was granted from the Water Board on January 17, 2013 to allow hazardous material
critical facilities to be constructed in the Poudre River flood fringe, with the following conditions prior to
approval of a FEMA Letter of Map Revision (LOMR) that will indicate the structures to be outside the
100- and 500- year floodplains once revised. The Conditions of Approval of the Variance are as follows:
a. A FEMA CLOMR and LOMR will be obtained for the property.The CLOMR must be approved by
the City and FEMA prior to any construction in the floodway. The LOMR must be approved by the
City of Fort Collins and submitted to FEMA prior to the issuance of the Certificate of Occupancy
for any building designated as a critical facility.
b. The proposed project hydraulic modeling will show 100-year water-surface elevations at or
below the pre-project regulatory conditions such that there is no adverse impact on any
insurable structures, including but not limited to, the City ’s Mulberry Wastewater Treatment
Plant and any structures upstream along Lincoln Avenue.
c. The lowest floor and all HVAC, electrical and mechanical shall be elevated to the existing
500-year flood elevation or two feet above the existing 100-year flood elevation, whichever is
higher.
d. A FEMA elevation certificate is required to be submitted and approved prior to issuance of the
Certificate of Occupancy for each structure built in the 100-year floodplain.
11. Building square footages shown on the plans represent the building footprint area, not the area of
the building envelopes.
12. On Lot 3, building envelopes are set X' from Lemay Avenue Right-of-Way to accommodate the
easement anticipated for the relocated PRPA transmission line. If the relocation route is changed from
this location along the west side of Lemay Avenue, the building envelopes shall be extended east to
comply with the build-to requirements of the Land Use Code.
13. No lighting shall be allowed to spill into buffer area.
14. Required bicycle parking for future phase buildings shall be located near buildings' primary
entrances as per Land Use Code.
15. Building foundation, parking lot and perimeter landscaping are indicated in detail for Phase One and
river restoration areas. Future Phase building foundation and parking lot landscaping within the
campus will be similar in character to Phase One. Specific areas of perimeter buffering are indicated on
the plans for future phase areas.
16. Landscape buffer areas shown on the plan shall be used to screen service, loading and parking areas,
including drive isles, from abutting uses, streets and natural areas. Screening shall consist primarily of
plant material with a minimum height of thirty (30) inches to provide solid visual screening but in an
informal arrangement reflecting the natural character of the adjacent river landscape. Where
appropriate and feasible, berming will also be used to accomplish visual screening. Buffers areas shall
be a minimum of twenty feet in width exclusive of right-of-way.
17. Tree removal shall be timed to avoid the nesting season in accordance with the Migratory Bird
Treaty Act. A nest survey shall be conducted prior to any tree removal if tree removal is proposed
during the nesting season (April-July).
