• The applicant shall conduct a survey,
subject to the review and approval by the
City’s Environmental Planner, for active
Red-tailed or Swainson’s Hawks’ nests on
the subject property and adjoining
properties, prior to construction.
• If Red-tailed or Swainson’s Hawks are
determined to be nesting on the property or
adjoining properties, the developer shall
implement a temporary limit of
development of a four-hundred-foot radius
from active nests during the period from
February 15 through July 15 of the first
year of construction, as per Section 3.4.1
(N) (5.c) of the Land Use Code.
