03/29/2016: We'll need to coordinate the placement of a big note on the cover sheet
of Phase 1 (road plans) referencing the date of the expiration of the temporary
construction agreement between MAVD and Intel. To the extent that the ability to
perform work on the plans within Intel's property is predicated on the agreement not
having expired, a note similar to the following (subject to finalizing) should be added
to the cover sheet of Phase 1 (and may also be added as a condition to the DCP for
Phase 1):
"The Phase 1 plans are valid for construction until March 24, 2019 in conformance
with the "Grant of Temporary Construction and Grading License" from Intel
Corporation to Harmony Technology Park, LLC, granting access onto Intel
Corporation property for the purposes of constructing Technology Parkway as
shown on the Phase 1 plans. No work on Intel Corporation property is allowed after
March 24, 2019, and Harmony Technology Park, LLC's agents, successors and/or
assigns agrees to cease work on Intel Corporation property until either: 1) the Phase
1 plans are amended and approved by the City in a manner which no longer
requires access onto Intel Corporation's property, or 2) a new license or extension
of the license is granted by Intel Corporation to Harmony Technology Park, LLC (or
alternatively, the City of Fort Collins).
01/06/2016: Carried over as unresolved. Note that the plans would need to be
revised should permission for work on Intel property not be obtained.
11/24/2015: The permission from Intel for work on their property is required prior to
approval of the plans.
08/03/2015: The limits of development show that construction is occurring on Intel,
which would require some sort of easement, letter from Intel for doing work that falls
within their property. Additionally, easement would appear to be needed for
construction and grading on both sides of Timberwood Drive.

03/29/2016: I would want to confirm with Aspen the latest legal description for the
pond. Tony had emailed a legal on 3/9, but I'm aware of subsequent emailed
seeking further discussion of this while I was out on vacation. I would just want to
make sure that I'm understanding what is the latest legal description for this
dedication and the boundaries established for it. A $250 deed of dedication
Transportation Review Fee is required (if not already provided) and recording fees
assessed by Larimer County upon determining the number of pages.

03/29/2016: I'm ready for the submittal of mylars (pending the addition of the note
referenced in comment #6). The deed of dedication in the previous comment will
need to be finalized, dedicated and associated fees provided prior to final sign off by
the City Engineer on the civil drawings. Additionally, I'll need advisement from Brad
Yatabe on the acceptability to complete the sign off on the civil mylars pertaining to
the status of the agreement with Les Kaplan.
