Comment Number: 12 Comment Originated: 10/09/2013 Topic: Easements 10/09/2013: The offsite legals and exhibits emailed on 9/11 generally look acceptable with a couple of comments: 1) I'm assuming these will all be dedicated to the City using the City's standard form, if viewed otherwise, we should discuss 2) The "Temporary construction and grading" I think leaves ambiguity on whether the grading is also temporary or permanent. If only the construction is meant to be temporary, it may read better as a grading and temporary construction easement. 3) Our standard language does not address "temporary" easements, whether for construction, grading, or both. If the intent is to have the construction (and grading) expire, we may need to look further at how this process occurs, whether if by language in the easement or through a separate vacation process later on (which requires a $400 fee to vacate each easement). 4) The requirement of cross sections for Timberline Road mentioned below may show the need for additional construction and grading easement along Timberline north of the development. We may need a permanent slope easement also as a designation for this easement. 5) The legals for the easements/rights-of-way have not been checked by Technical Services yet for closure. I'm comfortable with them starting this process now, except for the construction and grading easement along Timberline Road, pending additional review of grading and cross sections. 6) Each deed of dedication requires a $250 TDR fee. In addition, Larimer County recordation fees will be assessed once the number of pages is known. Comment Number: 4 Comment Originated: 10/09/2013 Page 2 of 8 Topic: General 10/09/2013: Red Willow Drive would need to be shown on the Master Street Plan as a collector roadway approved by City Council in order for it to be eligible for street oversizing reimbursement. If this has not yet occurred, coordination with Transportation Planning is needed, as the adoption of this roadway as a collector would need to occur prior to approval of the Final Plan. It is likely that Red Willow Drive cannot then be the street name as collector roadway names are also approved through Council.
