Also, please provide calculations as they pertain to canopy shade trees.
Requirement: 1 tree per 150 s.f. of interior landscaping; and must provide 8
feet at its smallest dimension and at least 80 square feet of ground area per
tree.
All required calculations are now shown.
12/15/2015: Section 3.2.1 (E) (4) requires interior and permeter landscaping
for parking lots. Please revise the plans and show the calculations as shown
in Figure 1.
The perimeter parking lot landscaping was revised to include more
evergreens as well as beaming where possible.
Parking Lot Perimeter Landscaping. Parking lot perimeter landscaping
(in the minimum setback areas required by Section 3.2.2(J) (Access,
Circulation and Parking) shall meet the following minimum standards:
(a)
Trees shall be provided at a ratio of one (1) tree per twenty-five (25) lineal feet
along a public street and one (1) tree per forty (40) lineal feet along a side lot
line parking setback area. Trees may be spaced irregularly in informal groupings
or be uniformly spaced, as consistent with larger overall planting patterns and
organization.
Perimeter landscaping along a street may be located in and should be
integrated with the streetscape in the street right-of-way.
(b)
Screening. Parking lots with six (6) or more spaces shall be screened from
abutting uses and from the street. Screening from residential uses shall
consist of a fence or wall six (6) feet in height in combination with plant
material and of sufficient opacity to block at least seventy-five (75) percent of
light from vehicle headlights. Screening from the street and all nonresidential
uses shall consist of a wall, fence, planter, earthen berm, plant material or a
combination of such elements, each of which shall have a minimum height of
thirty (30) inches. Such screening shall extend a minimum of seventy (70)
percent of the length of the street frontage of the parking
lot and also seventy (70) percent of the length of any boundary of the parking
lot that abuts any nonresidential use. Openings in the required screening shall
be permitted for such features as access ways or drainage ways. Where
screening from the street is required, plans submitted for review shall include
a graphic depiction of the parking lot screening as seen from the street. Plant
material used for the required screening shall achieve required opacity in its
winter seasonal condition within three
(3) years of construction of the vehicular use area to be
screened. (5)
Parking Lot Interior Landscaping. As required in Section 3.2.2(M)(1) Access,
Circulation and Parking, six (6) percent of the interior space of all parking lots

with less than one hundred (100) spaces, and ten (10) percent of the interior
space of all parking lots with one hundred (100) spaces or more shall be
landscape areas. (See Figure 1). All parking lot islands, connecting walkways
through parking lots and driveways through or to parking lots shall be
landscaped according to the following standards:
(a)
Visibility. To avoid landscape material blocking driver sight distance at
driveway-street intersections, no plant material greater than twenty-four (24)
inches in height shall be located within fifteen (15) feet of a curbcut.
(b)
Maximized Area of Shading. Landscaped islands shall be evenly distributed to
the maximum extent feasible. At a minimum, trees shall be planted at a ratio of
at least one (1) canopy shade tree per one hundred fifty (150) square feet of
internal landscaped area with a landscaped surface of turf, ground cover
perennials or mulched shrub plantings.
(c)
Landscaped Islands. In addition to any pedestrian refuge areas, each
landscaped island shall include one (1) or more canopy shade trees, be of
length greater than eight (8) feet in its smallest dimension, include at least
eighty (80) square feet of ground area.
Based on actual calculations, it is not physically possible to get the number
of trees required by code, and staff has accepted a realistic number of
parking island trees.

headlights from the street to a height of at least 30 inches. If, as noted in the
modification request, there are retaining walls along the south and west of the
parking lot please note them on the plans as they will help screen headlights.
The perimeter parking lot landscaping was revised to include more

Orientation. Building entrances shall face and open directly onto the adjoining
local street with parking and any service functions located in side or rear yards
and incorporated into the development according to the provisions of this
Code.
The requested setback modifications should be requested according to the
language in LUC Section 2.8:
(H)
Step 8 (Standards): Applicable, and the decision maker may grant a
modification of standards only if it finds that the granting of the modification
would not be detrimental to the public good, and that:
(1)
the plan as submitted will promote the general purpose of the standard for
which the modification is requested equally well or better than would a plan
which complies with the standard for which a modification is requested; or

without impairing the intent and purpose of this Land Use Code, substantially
alleviate an existing, defined and described problem of city-wide concern or

specifically and expressly defined and described in the city's Comprehensive
Plan or in an adopted policy, ordinance or resolution of the City Council, and
the strict application of such a standard would render the project practically
infeasible; or
(3)
by reason of exceptional physical conditions or other extraordinary and
exceptional situations, unique to such property, including, but not limited to,
physical conditions such as exceptional narrowness, shallowness or
topography, or physical conditions which hinder the owner's ability to install a
solar energy system, the strict application of the standard sought to be modified
would result in unusual and exceptional practical difficulties, or exceptional or
undue hardship upon the owner of such property, provided that such difficulties
or hardship are not caused by the act or omission of the applicant; or
(4)
the plan as submitted will not diverge from the standards of the Land Use
Code that are authorized by this Division to be modified except in a nominal,
inconsequential way when considered from the perspective of the entire
development plan, and will continue to advance the purposes of the Land Use
Code as contained in Section 1.2.2.
Any finding made under subparagraph (1), (2), (3) or (4) above shall be supported
by specific findings showing how the plan, as submitted, meets the requirements
and criteria of said subparagraph (1), (2), (3) or (4).

by a different company/owner a new utility easement will need to be dedicated
on the property around the proposed transformer locations. Please work with
Katie Sexton in Engineering to dedicate a utility easement to the City by
separate document. I have a redline plan showing the limits of the utility
easement that will be needed on the property. Below is a web link for
additional information on the process to dedicate easements by separate
document. Please contact me if you have questions.
Response: A new easement boundary has been added around the
transformers and connects to the drainage easement in the adjacent swale to
the east. This will be dedicated as a Drainage and Utility Easement by
separate document following the scheduled hearing. Aspen also reviewed this

has not been turned in for review as the engineer (Aspen) wants to wait for the
drainage report to be accepted by stormwater at which time and Erosion
Control Report will be supplied. At this time erosion control has not met the
Criteria and must wait till report has been submitted and reviewed against the
criteria, there by placing the progression of the project in a holding pattern. Will
wait for next round of review for the report. If you need clarification

02/09/2016: Response letter says the sanctuary will hold 240. Does the plan
meet minimum parking requirements?
12/16/2015: Does the project meet minimum parking requirements? A 248
seat sanctuary will likely generate more than 64 vehicles. It would seem that
there could be quite a bit of spill over parking into the neighborhood.

12/16/2015: Candlewood is a local road with parking allowed. Autumn Ridge is
a minor collector with 50 ft roadway. This would normally allow parking, but not
in areas where there is a center turn lane. Parking needs to be restricted
between Candlewood and Trilby if the center turn lane is maintained.
Response: Two No parking signs have been added to the Horizontal Control
sheet along the east side of Autumn Ridge as discussed.

12/16/2015: The internal circulation seems very ackward (with the one way
drive by the entrance). Although this is private, and not under City jurisdiction
to require changes, I'm not convinced it will function very well.
