FC07100.000-200 1 EXECUTIVE SUMMARY This report presents the results of the Phase I Environmental Site Assessment (ESA) that was performed by CTL | Thompson, Inc. (CTL) for Ditesco Project & Construction Services. The “Site” is located at 2133 South Timberline Road, Fort Collins, Larimer County, Colorado. The Phase I ESA was conducted in general conformance with the methods and procedures described in the American Society for Testing and Materials (ASTM) E 1527- 13, Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process. The Site consists of one vacant parcel with a total of approximately 1.22 acres of land that has been cleared and improved with stormwater management features, but is otherwise undeveloped. Adjoining facilities include a Burger King, vacant land, and residences. The Site appears to have been developed in the 1960s as part of the former EnCoat facility, which manufactured coated piping. The former EnCoat facility was entered into the Colorado Voluntary Cleanup (VCUP) program. The Site itself appears to have been used primarily for pipe storage, while the bulk of the environmental concerns associated with the former EnCoat facility appear to have been located north and west of the Site. It is unclear from the VCUP plan reviewed, but the Site may have been impacted by coal tar and shot blast. It does not appear that prior soil or groundwater investigations at the larger EnCoat facility included sampling within the boundaries of the Site. Although soil remediation appears to have been performed at other areas of the former EnCoat facility, it is unclear whether any soil remediation was performed within the boundaries of the Site. Regardless, a No Action Determination (NAD) was issued, allowing for re- development of the former EnCoat facility with commercial or industrial facilities. Based on the issuance of the NAD, the former use of the Site as part of the EnCoat facility is considered an Historic REC. It is possible that the Site may have been PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 2 impacted by coal tar and shot blast from former EnCoat operations. In addition, groundwater in the vicinity of the Site has been shown to be contaminated by volatile organic compounds (VOCs). The NAD indicates that the Site and adjoining areas of the former EnCoat facility were considered, as of January 2008, suitable for commercial and industrial development. Our understanding is that the Site will be developed with a commercial office building, which would generally be consistent with the approved VCUP Plan for the site. Should it be desired in the future, residential development or use of the Site would require a revised VCUP Plan and would likely also require additional investigation and/or remediation. The NAD does not discuss groundwater; however, based on groundwater contamination being identified at levels exceeding groundwater and drinking water standards, it should be assumed that the development and use of shallow groundwater would be restricted. If it were desired to develop and use shallow groundwater, a revised VCUP Plan would be required along with additional groundwater investigation and/or groundwater remediation. Based on VOC concentrations closest to the Site reported in the VCUP report (tetrachloroethylene at 0.5 micrograms per liter [µg/l], bromodichloromethane at 0.1 µg/l, and chloroform at 2 µg/l) and a review of EPA vapor intrusion screening levels, vapor intrusion is not considered a REC for the site usage for commercial purposes. If residential development were desired, vapor intrusion would be a concern, and additional investigation would be required to further assess the vapor intrusion risk. If a greater degree of certainty were desired regarding the potential for soil and groundwater contamination to be present at the Site, soil and groundwater sampling could be conducted. This executive summary is not intended to serve as a standalone document. Please refer to the full report for a detailed listing of the objectives, methods, scope of work, limitations, and development of findings for this project. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 3 1.0 INTRODUCTION This report was prepared by CTL | Thompson, Inc. (CTL) for Ditesco Project & Construction Services and presents the results of the Phase I Environmental Site Assessment (ESA) for 2133 South Timberline Road in Fort Collins, Colorado (referred to hereafter as the “Site”). The Phase I ESA was conducted in general accordance with proposal no. FC-15-0304 and subsequent authorization by Mr. Keith Meyer. 1.1 Purpose The purpose of the Phase I ESA was to identify Recognized Environmental Conditions (RECs), to the extent feasible, pursuant to the methods and procedures described in the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessments, E 1527-13. A REC is defined as the presence or likely presence of hazardous substances or petroleum products on a site under conditions that indicate an existing release, a past release, or a material threat of a release of hazardous substances or petroleum products into the ground, ground water, or surface water of the site. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. ASTM Standard E1527-13 also has separate definitions for past conditions that would otherwise be considered a REC but have been addressed to the satisfaction of the applicable regulatory agencies and would either allow for generally unrestricted use of the Site (referred to as a Historic Recognized Environmental Condition, or HREC) or for use of the Site with various restrictions (referred to as a Controlled Recognized Environmental Condition, or CREC). PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 4 1.2 Scope of Services The scope of services for this assessment consisted of a records review, a site reconnaissance, historical research, interviews, and documentation of findings in a report. 1.3 Limitations This Phase I ESA was prepared in general accordance with ASTM Standard E 1527-05. There may be additional environmental issues present at the site that are outside the scope of this practice that includes, but are not limited to the following: Asbestos-containing materials; Radon; Lead-based paint; Lead in drinking water; Cultural and historic resources; Mold and fungi; Industrial hygiene; Indoor air quality; Health & safety; Ecological resources; Endangered species; Biological or infectious agents and pathogens; Wetlands; Jurisdictional waters of the U.S; Regulatory compliance; High voltage power lines; and, Mine subsidence. CTL provided an opinion based upon the condition of the site on the day it was observed and a review of existing and reasonably ascertainable regulatory records and historical information. Our scope did not include chemical testing of soils or ground water. The opinion, conclusions, and recommendations of this report are not intended to be used or relied PHASE I ESA 2133 S. With the written consent of our client, CTL may be available to contract with other parties to provide an opinion or conduct additional environmental assessment services. Due to latent conditions and other contingencies which may become evident in the future, the current assessment does not result in any guarantee the subject site is free and clear of hazardous materials. Should additional surface, subsurface or chemical data become available, the conclusions and recommendations contained in this report shall not be considered valid unless the data is reviewed and the conclusions of this report are modified or approved in writing by our firm. We believe that this investigation was conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions in the locality of the project. No warranty, express or implied, is made. 1.4 Data Gaps and Limiting Conditions Significant data gaps or limiting conditions were not encountered during the performance of this Phase I ESA. 2.0 SITE DESCRIPTION AND LOCATION 2.1 Location and Legal Description The Site consists of one vacant parcel with a total of approximately 1.22 acres of land addressed as 2133 South Timberline Road, Fort Collins, Larimer County, Colorado. According to the Larimer County Assessor, the legal description for the Site is “LOT 11, TIMBERLINE CENTER, FTC (20060045462)”. The Site location is shown on Figure 1. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 6 2.2 Assessor Records Larimer County Assessor records indicate that the Site is legally identified as Parcel No. 87194-44-011. Assessor records do not indicate any current or previous use or development of the Site. 2.3 Current Occupant / User Information The Site is currently vacant but has been graded and improved with utilities, as well as stormwater management features shared by the adjoining property to the north. According to the Larimer County Assessor, the Site is owned by Timberline Development, LLC. 2.4 General Description of Site and Improvements The Site is vacant. The site layout is shown on Figure 2. 2.5 General Uses of Adjacent Properties The Site is located in a suburban area of Fort Collins, Colorado, used primarily for residential, retail, commercial, and light industrial purposes. Adjoining properties include a Burger King restaurant, vacant land, and Timberline Road, across which is a residential development. 3.0 PHYSICAL SETTING 3.1 Topography The Site is relatively flat. According to the USGS topographic map, the Site sits at an approximate elevation of 4,940 feet above mean sea level, and the general area slopes down to the east. PHASE I ESA 2133 S. FC07100.000-200 7 3.2 Geology and Soils According to the Geologic Map of the Boulder – Fort Collins – Greeley Area, Colorado, the Site is underlain by Eolium, which is described as windblown clay, silt, sand, and granules. According to the USDA, soils onsite are clay loams. 3.3 Ground Water During a prior investigation of the Site and adjoining area (see Section 4.4), groundwater was found to flow in an easterly direction, which is generally consistent with topography. Topographic data suggests areas upgradient of the Site are generally to the west. According to the USGS depth to groundwater map, the depth to groundwater under the Site is expected to be between 10 and 20 feet below grade, although depth to groundwater measurements in the vicinity, which were reported in the prior investigation discussed in Section 4.4, ranged from 21.62 to 23.85 feet below grade. Based on a review of the Colorado Division of Water Resources online AquaMap, there are no registered water wells on the Site or adjacent properties. 4.0 HISTORICAL USE INFORMATION 4.1 User Provided Information Mr. Keith Meyer of Ditesco Project & Construction Services provided ASTM-required user-provided information. Mr. Meyer indicated the purpose of performing the Phase I ESA was for acquisition of the Site. Mr. Meyer did not have any specialized knowledge or experience related to previous environmental activities on the Site. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 8 Mr. Meyer was not aware of existing environmental liens on the Site or recorded activity and use limitations, such as engineering controls, institutional controls, or land use restrictions related to the Site. Mr. Meyer was not aware of a valuation reduction of the Site because of environmental issues. CTL was provided with a title commitment for the Site, prepared by Land Title Guarantee Company on August 17, 2015. Based on a cursory review of the title exceptions, we observed no obvious indications of environmental liens or AULs associated with environmental contamination. It should be noted that CTL’s practitioners are not title professionals or attorneys, and our review of title documents does not necessarily eliminate the user’s ASTM requirement to perform a search for environmental liens and AULs. 4.2 Standard Historical Sources CTL conducted a search of various historical records. A complete list of records searched is included on the references page, and copies of reviewed documents are included in at the end of the report text. The results of our historical research are presented below in Table I. Historical documentation is included in Appendix A. According to EDR, Sanborn maps are not available for the property area. FC07100.000-200 11 4.4 Previous Environmental Assessments CTL was provided with excerpts from Environmental Resources Management’s (ERM’s) Voluntary Cleanup (VCUP) Plan for the Site and adjoining areas included within the former EnCoat Facility (report dated January 24, 2006; apparent ERM project no. 0040684); portions of the excerpts are included in Appendix B. The Site appears to be situated within the far southeast corner of the former EnCoat facility; Figure 3 shows the approximate boundaries of the Site and former EnCoat facility. ERM states that the former EnCoat facility coated steel pipes with coal tar, fusion bond epoxy, and polyethylene. Prior to the coating process, the pipes were cleaned by shot blasting and acid washing. The facility briefly painted and foam-coated pipes in the early 1990s. The EnCoat facility reportedly began operations in 1962, prior to which the area was used for agricultural purposes. In the 1960s, the EnCoat facility consisted of two buildings well north of the Site, with exterior pipe storage. By the late 1970s, the EnCoat facility had been expanded with one newer building (the epoxy Fusion Bond Building) located immediately north of the Site. The VCUP Plan indicates that the area of the Site was used for pipe storage, and residual coal tar had been observed on the ground surface near the Site. Shot blast dust was also described as being observed near the Site. However, the report does not provide specific information regarding these observations, and it is unclear whether the Site itself was impacted. Other potential concerns identified for neighboring areas of the former EnCoat facility appear to have included spills from aboveground fuel tanks; the use of a septic system; disposal of limited amounts of process-related, contact cooling water in impoundments; use of methyl ethyl ketone, paints, and other raw materials; and PCBs. Soil and groundwater sampling was conducted in 2004 as part of a test pit investigation at the EnCoat facility; in addition, four soil borings were advanced and converted into groundwater monitoring wells. The 2004 sampling was focused primarily on building locations, with limited additional sampling in storage areas; however, none of the sampling was conducted within the boundaries of the Site. The soil analyses generally identified heavy metals, volatile organic compounds (VOCs), and PCBs at various PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 12 locations north of the Site, including several compounds at concentrations exceeding residential limits. Groundwater was contaminated with VOCs at concentrations exceeding drinking water and groundwater standards. The VCUP Plan indicated that additional contaminant delineation would be performed and that dig-and-haul type remediation would be performed. No documentation of the additional delineation or the remediation was provided. A No Action Determination (NAD) was issued by CDPHE on January 18, 2008 (see Appendix B). 4.5 Historical Use Summary The Site appears to have been developed in the 1960s as part of the former EnCoat facility. The former use of the Site as part of the EnCoat facility is considered an Historic REC. It is unclear from the VCUP plan reviewed whether the Site was impacted by coal tar and shot blast, but it does not appear that soil or groundwater investigations were performed within the boundaries of the Site. It is unclear whether any soil remediation was performed within the boundaries of the Site. As such, it is possible that the Site may have been impacted by coal tar and shot blast from former EnCoat operations, and groundwater in the vicinity of the Site has been shown to be contaminated by VOCs. The NAD indicates that the Site and adjoining areas of the former EnCoat facility were considered, as of January 2008, suitable for commercial and industrial development. The NAD does not discuss groundwater; however, based on the VCUP application, it should be assumed that the use of shallow groundwater would be restricted unless it can be demonstrated to be suitable for use. Based on VOC concentrations closest to the Site reported in the VCUP report (tetrachloroethylene at 0.5 micrograms per liter [µg/l], bromodichloromethane at 0.1 µg/l, and chloroform at 2 µg/l) and a review of EPA vapor intrusion screening levels, vapor intrusion is not a REC for the site usage for commercial purposes. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 13 5.0 REGULATORY AGENCY RECORDS Regulatory agency records were provided by Environmental Data Resources. The database report, dated September 4, 2015, is presented in Appendix C and contains a full description of findings, definitions of databases reviewed, and a list of database acronyms. The following discusses pertinent findings of the database search. 5.1 On-site The Site was listed as part of the EnCoat VCUP facility discussed previously. The Site was not listed on other databases searched. 5.2 Off-site With the exception of the adjoining portions of the former EnCoat facility, no adjoining sites were listed in the databases searched. The remaining database listings do not appear to represent RECs due to distance, topography, or case status. The database includes two “Orphan” listings, which are facilities that cannot be mapped due to incomplete or inaccurate information. Based on a cursory review, none of the remaining Orphan listings appear to be associated with the Site or adjoining properties. 5.3 Regulatory Agency Contacts CTL reviewed oil and gas production facility records available from the Colorado Oil and Gas Conservation Commission (COGCC). No oil/gas wells were identified on the Site or adjoining properties. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 14 6.0 SITE RECONNAISSANCE 6.1 Methodology and Limiting Conditions Mr. Dana Harris conducted a site visit on September 8, 2015. The Site was accessed by walking. A photographic record of the site reconnaissance is presented in Appendix D. 6.2 Site Observations During our reconnaissance, we specifically looked for obvious evidence of the site features listed in Table II. Table II lists features typically observed outside of site structures. An “X” located within each table indicates that the feature was readily observable. Those features which were observed on the Site are discussed in further detail within the following subsection(s). FC07100.000-200 15 6.3 Discussion of Site Features 6.3.1 Surface Water, Streams, Ponds, Lagoons A stormwater detention pond is located on the east end of the site. The pond appears to receive drainage from the Site and the adjoining Burger King to the north. CTL did observe visible evidence of releases to the pond, such as staining around the banks of the pond or a sheen on water in the pond. Based on the absence of visible releases and the use of the pond for stormwater management, this pond does not appear to be a REC. 6.3.2 Solid Waste or Disposal Areas The Site was littered with scattered household waste. No evidence of hazardous materials was observed among the wastes, and no visible evidence of releases, such as soil staining, stressed vegetation, or dead animals, was observed. Based on the lack of observed hazardous materials and releases, the waste disposal does not appear to be a REC. 6.4 Review of Adjoining Properties General observations of properties adjacent to the Site were performed in conjunction with on-site observations made on September 8, 2015. The site is bordered to the north by a Burger King restaurant; to the east by Timberline Road, across which is a residential development; to the south by a vacant lot, beyond which is a police station; and to the west by a paved access road, across which is a vacant lot. Observation of adjoining properties did not reveal obvious visual evidence that is of environmental concern. We did not observe evidence of landfills, lagoons, pits, or other waste treatment or disposal operations; underground storage tanks, spills, releases, or discharge of hazardous material that would indicate a REC. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 16 7.0 FINDINGS, OPINION, CONCLUSIONS, RECOMMENDATIONS The Site consists of one vacant parcel with a total of approximately 1.22 acres of land addressed as 2133 South Timberline Road, Fort Collins, Larimer County, Colorado. The Site has been cleared and improved with stormwater management features, but is otherwise undeveloped. Adjoining facilities include a Burger King, vacant land, and residences. The Site appears to have been developed in the 1960s as part of the former EnCoat facility, which manufactured coated piping. The former EnCoat facility was entered into the VCUP program. The Site itself appears to have been used primarily for pipe storage, while the bulk of the environmental concerns associated with the former EnCoat facility appear to have been located north and west of the Site. It is unclear from the VCUP plan reviewed, but the Site may have been impacted by coal tar and shot blast. It does not appear that prior soil or groundwater investigations at the larger EnCoat facility included sampling within the boundaries of the Site. Although soil remediation appears to have been performed at other areas of the former EnCoat facility, it is unclear whether any soil remediation was performed within the boundaries of the Site. Regardless, a NAD was issued, allowing for re-development of the former EnCoat facility with commercial or industrial facilities. Based on the issuance of the NAD, the former use of the Site as part of the EnCoat facility is considered an Historic REC. It is possible that the Site may have been impacted by coal tar and shot blast from former EnCoat operations. In addition, groundwater in the vicinity of the Site has been shown to be contaminated by VOCs. The NAD indicates that the Site and adjoining areas of the former EnCoat facility were considered, as of January 2008, suitable for commercial and industrial development. Our understanding is that the Site will be developed with a commercial office building, which would generally be consistent with the approved VCUP Plan for the site. Should it be desired in the future, residential development or use of the Site would require a revised VCUP Plan and would likely also require additional investigation and/or remediation. PHASE I ESA 2133 S. TIMBERLINE ROAD FORT COLLINS, COLORADO PROJECT NO. FC07100.000-200 17 The NAD does not discuss groundwater; however, based on groundwater contamination being identified at levels exceeding groundwater and drinking water standards, it should be assumed that the development and use of shallow groundwater would be restricted. If it were desired to develop and use shallow groundwater, a revised VCUP Plan would be required along with additional groundwater investigation and/or groundwater remediation. Based on VOC concentrations closest to the Site reported in the VCUP report (tetrachloroethylene at 0.5 micrograms per liter [µg/l], bromodichloromethane at 0.1 µg/l, and chloroform at 2 µg/l) and a review of EPA vapor intrusion screening levels, vapor intrusion is not considered a REC for the site usage for commercial purposes. If residential development were desired, vapor intrusion would be a concern, and additional investigation would be required to further assess the vapor intrusion risk. If a greater degree of certainty were desired regarding the potential for soil and groundwater contamination to be present at the Site, soil and groundwater sampling could be conducted. 8.0 QUALIFICATIONS This Phase I ESA was performed under the responsible charge of Mr. Dana Harris. Mr. Harris has performed or reviewed over 1,000 Phase I ESAs and has more than 10 years of environmental consulting experience in Colorado.
