PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 4 Cardno ATC 2.0 INTRODUCTION 2.1 Purpose The purpose of this Phase I ESA was to identify recognized environmental conditions and certain potential environmental conditions outside the scope of ASTM Standard Practice E 1527-13 in connection with the property at the time of the site reconnaissance. This report documents the findings, opinions, and conclusions of the Phase I ESA. 2.2 Scope This Phase I ESA was conducted in general accordance with the ASTM Standard Practice E 1527-13, consistent with a level of care and skill ordinarily practiced by the environmental consulting profession currently providing similar services under similar circumstances. Significant additions, deletions, or exceptions to ASTM Standard Practice E 1527-13 are noted below or in the corresponding sections of this report. The scope of this assessment included an evaluation of the following:  Physical setting characteristics of the Site through a review of referenced sources such as topographic maps and geologic, soils and hydrologic reports.  Usage of the Site, adjoining properties and surrounding area through a review of referenced historical sources such as land title records, fire insurance maps, city directories, aerial photographs, prior reports, and interviews.  Observations and interviews regarding current property usage and conditions including: the use, treatment, storage, disposal, or generation of hazardous substances, petroleum products, hazardous wastes, nonhazardous solid wastes and wastewater.  Usage of adjoining and surrounding area properties and the likely impact of known or suspected releases of hazardous substances or petroleum products from those properties on the Site.  Information referenced environmental agency databases and local environmental records, within the specified approximate minimum search distance from the Site. The scope of the assessment also included consideration of the following environmental issues or conditions that are beyond the scope of ASTM Standard Practice E 1527-13:  Mold Screening to report the findings of a baseline survey of readily observable mold and conditions conducive to mold on the property identified by limited interview, document review, and physical observation and to provide an opinion on whether an identified condition warrants further action. The scope of work for the Mold Screening was intended to be consistent with ASTM Standard Practice E 2418-06: Standard Guide for Readily Observable Mold and Conditions Conducive to Mold in Commercial Buildings: Baseline Survey Process. The scope of work, including potential deviations from the Standard Guide, is described as follows. The interview was limited to one knowledgeable person from property management or engineering staff. The document review was limited to only those relevant documents made readily available to Cardno ATC in a timely manner. The physical observations were limited to certain Heating, PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 5 Cardno ATC Ventilation and Air Conditioning (HVAC) system areas and other readily accessible building areas likely to become subject to water damage, plumbing leaks, and flooding. Unless noted otherwise herein, Cardno ATC observed the HVAC equipment room(s) and readily accessible mechanical rooms and, in buildings with package units in the ceiling, at least one unit per floor. Also, unless noted otherwise, Cardno ATC observed readily accessible areas of the basement (or lowest level), the top floor, the roof and at least one mid-level floor (if applicable). For multi- story buildings, the total number of floors observed (inclusive of those already mentioned) was intended to be up to 10% of the total number of floors (if readily accessible). For hotel and multi-family buildings, Cardno ATC targeted the lowest and highest levels and roof as described above and up to 10% of units, including one per floor if readily accessible. The Mold Screening did not include destructive methods of observation. No sampling or laboratory analyses were conducted. The Mold Screening service as described herein was limited in scope and by the time and cost considerations typically associated with performing a Phase I ESA. No method can guarantee that a hazard will be discovered if evidence of the hazard is not encountered within the performance of the Mold Screening as authorized and that opinions and conclusions must, out of necessity, be extrapolated from limited information and discrete, non-continuous data points. Unidentified mold or other microbial conditions may exist on the property.  Visual observation and limited sampling of suspect asbestos-containing material (ACM) at the property. The visual observation consists of providing an opinion on the condition of suspect ACM on the property, based upon visual observation during the site reconnaissance. The limited sampling, if conducted, consists of the submission of bulk material samples to an accredited laboratory for determination of asbestos concentrations. The sampling was “limited” in that is was not intended to comply with the sampling requirements described in 40 CFR Part 763 or 40 CFR Part 61. Limited surveys are performed to identify the presence of readily accessible suspect ACM and to develop recommendations as to the need for a more thorough survey and/or an Operations and Maintenance program.  Radon document review, consisting of the review of published radon data with regard to the potential for elevated levels of radon gas in the surrounding area of the property.  Lead in drinking water data review, consisting of contacting the water supplier for information regarding whether or not the potable water provided to the property meets or exceeds drinking water standards for lead.  Visual observation of Lead-based paint (LBP), consisting of providing an opinion on the potential for LBP based on the construction date of buildings on the property and visual observation of the condition of suspect LBP.  Wetlands document review, consisting of a review of a current National Wetlands Inventory map of the surrounding area to note if the property is identified as having a wetland.  Flood plain document review, consisting of a review of a reasonably ascertainable flood plain map of the surrounding area to note if the property is identified as being located within a flood plain. PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 6 Cardno ATC 2.3 Significant Assumption Any assumptions in this report were not considered as having significant impact on the determination of recognized environmental conditions associated with the property. 2.4 Limitations and Exceptions Cardno ATC has prepared this Phase I ESA report using reasonable efforts to identify recognized environmental conditions associated with hazardous substances or petroleum products at the property. Findings contained within this report are based on information collected from observations made on the day(s) of the site reconnaissance and from reasonably ascertainable information obtained from certain public agencies and other referenced sources. The ASTM Standard Practice E 1527-13 recognizes inherent limitations for Phase I ESAs, including, but not limited to:  Uncertainty Not Eliminated – A Phase I ESA cannot completely eliminate uncertainty regarding the potential for recognized environmental conditions in connection with any property.  Not Exhaustive – A Phase I ESA is not an exhaustive investigation of the property and environmental conditions on such property.  Past Uses of the Property – Phase I requirements only require review of standard historical sources at five year intervals. Therefore, past uses of property at less than five year intervals may not be discovered. Users of this report may refer to ASTM Standard Practice E 1527-13 for further information regarding these and other limitations. This report is not definitive and should not be assumed to be a complete and/or specific definition of all conditions above or below grade. Current subsurface conditions may differ from the conditions determined by surface observations, interviews, and reviews of historical sources. The most reliable method of evaluating subsurface conditions is through intrusive techniques, which are beyond the scope of this report. Information in this report is not intended to be used as a construction document and should not be used for demolition, renovation, or other property construction purposes. Any use of this report by any party, beyond the scope and intent of the original parties, shall be at the sole risk and expense of such user. Cardno ATC makes no representation or warranty that the past or current operations at the property are, or have been, in compliance with all applicable federal, state, and local laws, regulations, and codes. This report does not warrant against future operations or conditions, nor does it warrant against operations or conditions present of a type or at a location not investigated. Regardless of the findings stated in this report, Cardno ATC is not responsible for consequences or conditions arising from facts not fully disclosed to Cardno ATC during the assessment. An independent data research company provided the government agency database referenced in this report. Information on surrounding area properties was requested for approximate minimum search distances and is assumed to be correct and complete unless obviously contradicted by Cardno ATC’s observations or other credible referenced sources reviewed during the assessment. Cardno ATC used reasonable efforts to identify evidence of aboveground and underground storage tanks and ancillary equipment on the property during the assessment. “Reasonable efforts” were limited to observation of accessible areas, review of referenced public records and interviews. These reasonable efforts may not identify subsurface equipment or evidence hidden from view by things including, but not limited to, snow cover, paving, construction activities, stored materials and landscaping. Any estimates of costs or quantities in this report are approximations for commercial real estate transaction due diligence purposes and are based on the findings, opinions, and conclusions of this assessment, which are limited by the scope of the assessment, schedule demands, cost constraints, accessibility limitations, and other factors associated with performing the Phase I ESA. Subsequent determinations of costs or quantities may vary from the estimates in this report. The estimated costs or quantities in this report are not intended to be used for financial disclosure related to the Financial Accounting Standards Board (FASB) Statement No. 143, FASB Interpretation No. 47, Sarbanes/Oxley Act or any United States Securities and Exchange Commission reporting obligations, and may not be used for such purposes in any form without the express written permission of Cardno ATC. Per ASTM Standard Practice E 1527-13, Section 6, User Responsibilities, the User of this assessment has specific obligations for performing tasks during this assessment that will help identify the possibility of recognized environmental conditions in connection with the property. Failure by the User to fully comply with the requirements may impact their ability to use this report to help qualify for Landowner Liability Protections (LLPs) under Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Cardno ATC makes no representations or warranties regarding a User’s qualification for protection under any federal, state, or local laws, rules, or regulations. In accordance with the ASTM Standard Practice E 1527-13, this report is presumed to be valid for a six month period. If the report is older than six months, the following information must be updated in order for the report to be valid: (1) regulatory review, (2) site visit, (3) interviews, (4) specialized knowledge and (5) environmental liens search. Reports older than one year may not meet the ASTM Standard Practice 1527-13 and therefore, the entire report must be updated to reflect current conditions and property-specific information. Any third party agrees by accepting this report that any use or reliance on this report shall be limited by the exceptions and limitations in this report, and with the acknowledgment that actual site conditions may change with time, and that hidden conditions may exist at the property that were not discovered within the authorized scope of the assessment. Any use by or distribution of this report to third parties, without the express written consent of Cardno ATC, is at the sole risk and expense of such third party. Cardno ATC makes no other representation to any third party except that it has used the degree of care and skill ordinarily exercised by environmental consultants in the preparation of the report and in the assembling of data and information related thereto. No other warranties are made to any third party, either expressed or implied. Unless otherwise agreed upon in writing by Cardno ATC and a third party, Cardno ATC’s liability to any third party authorized to use or rely on this report with respect to any acts or omissions shall be limited to a total maximum amount of $50,000. PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 9 Cardno ATC 3.0 SITE DESCRIPTION 3.1 Location and Legal Description The property is an approximate 1-acre piece of property located at 4333 East Mulberry Street in Fort Collins, Larimer County, Colorado 80524. A property Vicinity Map is located in Appendix A, a Property Plan is included in Appendix B, and Property Photographs are provided in Appendix C. According to information obtained from the Larimer County Tax Assessor’s website, http://maps.larimer.org/lil/?xCenter=3139592&yCenter=1454663&Scale=600, the property consists of one and a half parcels of land totaling approximately 1-Acre in size (Parcel # 87152-07-017 and 87150- 00-012). The legal description of the parcels acquired from the County Recorder’s office is included in Appendix L. 3.2 Surrounding Area General Characteristics The surrounding area is primarily characterized by commercial and residential uses. A hotel (Guesthouse Hotel) is west of the property, which is part of parcel # 87152-07-017. The property is accessed from Interstate 25 to the west and Mulberry Street from the north. Specific adjoining property information is further discussed in Section 3.5. 3.3 Current Use of the Property The property is currently a restaurant and vacant land. The property is currently zoned Commercial. The property is generally flat with a gradual slope to the west. Site Photographs are provided in Appendix C. 3.4 Description of Property Improvements The property consists of one and a half parcels of land totaling approximately 1-Acre in size. Documentation may be found where referenced in this report. 4.1 Title Records User did provide title records information for the parcel. No obvious environmental issues were found in documentation. This information can be reviewed in Appendix D. 4.2 Environmental Liens or Activity and Use Limitations (AULs) User provided no information regarding property environmental liens or activity and use limitations (AULs). Cardno ATC attempted to identify Environmental Liens and Activity Use Limitations through Client supplied data. No liens or AULs were identified on the property. 4.3 Specialized Knowledge User did not provide specialized knowledge regarding recognized environmental conditions associated with the property. 4.4 Significant Valuation Reduction for Environmental Issues User provided no information regarding a significant valuation reduction for environmental issues associated with the property. 4.5 Owner, Property Manager and Occupant Information User provided Cardno ATC with a site access contact indicating the property was a hotel and an escort was not required. 4.6 Reason for Performing Phase I ESA User indicated that the Phase I ESA was being completed prior to a financial transaction regarding the property. 4.7 Other User Provided Documents User provided an environmental questionnaire and site map concerning the property. (EDR) of Shelton, Connecticut, was reviewed for information regarding reported releases of hazardous substances and petroleum products on or near the property. Cardno ATC also reviewed the “unmappable” (also referred to as “orphan”) listings within the database report, cross-referencing available address information and facility names. Unmappable sites are listings that could not be plotted with confidence, but are potentially in the general area of the property based on the partial street address, city, or zip code. Any unmappable site that was identified by Cardno ATC as a being within the approximate minimum search distance from the property based on the site reconnaissance and/or cross- referencing to mapped listings, is included in the discussion within this section. The Marathon Metallic Building (Marathon) site located near the intersection of Interstate 25 and Colorado 14 (Mulberry Street) was listed as a Federal Resource Conservation and Recovery Act (RCRA), Corrective Action facility (CORRACTS) and a RCRA Non-Generator facility. The facility is located approximately 400 feet east of the property and has EPA ID # COD000112599. According the EDR report, the facility showed corrective action compliance evaluations performed in 1984, 1993, and 1994. No violations were reported and the current human exposures and irrigation of contaminated groundwater are both under control as of June 1994 and the corrective action process was terminated. No other information was provided. The Marathon site was also identified as a RCRA Non-Generator facility in 1993 with no violations reported. Based on the corrective action process terminated and because the facility does not currently generate hazardous waste, the facility is not considered a recognized environmental condition to the property. The Abound Solar Inc. site located approximately 770 feet east of the property at 4557 Denrose Court was listed as a RCRA Non-Generator facility. According to the EDR report the facility was listed in as a RCRA Small Quantity Generator (SQG) of hazardous waste that produced 1,000 kg or less of hazardous waste per calendar month in the years 2007-2009 and in 2012 the status changed to a Non-Generator facility. Several violations were recorded in 2008 and 2012. However, the facility achieved compliance soon after the violations. Based on the compliance achieved and because the facility does not currently generate hazardous waste, the facility is not considered a recognized environmental condition because the facility has no violations and is down-gradient of the property. Based on the distance, topography, assumed groundwater flow direction with relation to gradient, current regulatory status, and/or the absence of reported releases, no other sites in the federal agency databases are considered to represent a likely past, present or current material threat of significant impact to the property. Based on the information reviewed, properties indicated within the search radius, are not considered a recognized environmental condition to the property. 5.1.2 State and Tribal Database Findings The property is not listed in the State or Tribal Databases. There is one LUST site (Amoco Oil #9692) located approximately 600 feet northeast of the property. The LUST site has a closed date listed for it. There is one UST and AST site (Sunstate Equipment Co. LLC) approximately 600 feet northeast of the property. According to the EDR report, the site has seven USTs, which were permantelty closed and one multi- compartment AST, which was installed in 1998. No other information was available. However, due to the omission of the site being listed in any database indicating a release has occurred it is not considered a recognized environmental condition to the property. Based on the distance, topography, assumed groundwater flow direction with relation to gradient, current regulatory status, and/or the absence of reported releases, no other sites in the state and tribal databases are considered to represent a likely past, present or current material threat of significant impact to the property. Based on the information reviewed, properties indicated within the search radius, are not considered a recognized environmental condition to the property. 5.1.3 Local Environmental Records Sources Health Department Cardno ATC requested information from the Larimer County Health Department regarding records of environmental concern for the property and vicinity. At the time this report was prepared, the information/records had not been received. If information is received which changes the conclusions/recommendations of this assessment, this information will be forwarded as an addendum to this report. Fire Department Cardno ATC requested information from the Fort Collins Fire Department regarding records of environmental concern and hazardous material responses for the property and vicinity. At the time this report was prepared, the information/records had not been received. Planning Department According to the Larimer County Tax Assessor’s website, http://maps.larimer.org/lil/?xCenter=3139592&yCenter=1454663&Scale=600, the property is currently zoned Commercial. A zoning map is included in Appendix L. Building Department Cardno ATC requested information from the City of Fort Collins Building Department regarding records for the property. At the time this report was prepared, the information/records had not been received. Electrical Utility Company Electrical service for the property vicinity is provided by Xcel Energy. Water Utility Water utility for the property vicinity is provided by City of Fort Collins Utilities-Efficiency Works. Other Local Environmental Records Sources No additional local environmental records sources were reviewed for this assessment. 5.2 Physical Setting Sources 5.2.1 Topography The property is located on the United States Geological Survey (USGS) 7.5-Minute Series Timnath Topographic Quadrangle Map, dated 1971, provided by EDR. Cardno ATC’s review of this map indicates that the elevation of the property is approximately 4,900 feet above mean sea level (msl). The topography of the property is relatively flat, with a regional slope to the west. A copy of the topographic map is included in Appendix A. No potentially adverse topographic features, such as standing water, streams, playas, or karst topography were observed at the property on the topographic map. Cardno ATC did not observe any evidence of surface water, surface impoundments, or dry wells at the property during the site reconnaissance. Stormwater flows with surface topography into storm sewer drains located along Main Street. 5.2.2 Geology According to the United States Geological Survey interactive geologic map of Colorado, http://ngmdb.usgs.gov/maps/mapview/, the property is located in an area underlain by Quaternary gravels and aeolian (windblown clay, silt, sand, and granules) of the Bull Lake glaciation. 5.2.3 Soils According to the United States Department of Agriculture (USDA) Soil Conservation Service (SCS) Soil Survey website, http://websoilsurvey.sc.egov.usda.gov/App/HomePage.htm, of 4333 East Mulberry Street, Larimer County, Fort Collins, Colorado. The soil at the property consist of Fort Collins Loam (0 to 1 percent slopes). A copy of the Web Soil Survey is included in Appendix L. The EDR report indicates that the native soil at the property is Fort Collins Loam. The soil is described as moderately well and well drained and has moderate infiltration rates, the soils are composed of fine grained silts and clays, with an undefined hydric status. Additional soil layer information provided by EDR indicated the soil texture as silty-clay loam at 0-59 inches below ground surface (bgs). A copy of the EDR report is included in Appendix E. 5.2.4 Hydrology Considering the surface topography of the property vicinity and taking into account the influence of near- by rivers, groundwater is expected to flow to the east-southeast towards the Boxelder Creek. Therefore, in assessing potential off-site environmental impacts, properties located directly to the west-northwest are of primary concern. State Database Well Information included in the EDR Radius MapTM Report with GeoCheck® obtained for the Phase I ESA indicated there are six water wells within a 1/8-mile radius of the property. Several are State of Colorado wells and one is a USGS well. According to the EDR report, the groundwater elevation is approximately 10 to 25 feet below ground surface (bgs). However, the actual groundwater elevation and flow under the property can only be accurately determined by installing groundwater monitoring wells, which is beyond the scope of this project. 5.2.5 Other Physical Setting Sources Flood Plain Map A review of Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Panel 1003 of 1420 from Community Panel Number 1003G indicated the property is located in a Zone X Flood Zone. A Zone X flood zone is an area determined to be outside the 500-year floodplain and determined to be outside 0.2% annual-chance-flood plains. The property is also near areas with no base flood elevations determined. A copy of the FIRM Map is included in Appendix E. Wetlands Map According to the U.S. Fish and Wildlife Service, National Wetlands Inventory, no wetlands are located on the property. A copy of the Wetland Map is included in Appendix E. It is noted this investigation did not include a formal determination relating to the presence of possible wetlands areas on the property. 5.3 Historical Records Sources The following table summarizes the findings of the research presented below pertaining to historical property and surrounding area uses. However, based on the review of available historical sources, these data gaps did not have an impact on the recognized environmental condition determinations of this assessment and are not significant data gaps. 5.3.1 Aerial Photographs Cardno ATC reviewed available aerial photographs of the property and surrounding areas as provided by EDR. Available aerial photographs ranged from 1953 to 2011. Copies of aerial photographs are included in Appendix F. The following are descriptions and interpretations from the aerial photograph review. The “Unmapped Property” letter provided by EDR is included in Appendix G. The lack of historical fire insurance maps is considered a data gap. However, based on the additional historical research conducted during this Phase I ESA, the lack of historical fire insurance maps is not considered a significant data gap. 5.3.3 Property Tax Files Cardno ATC reviewed available tax files from the Larimer County Tax Assessors in an attempt to identify historical ownership information on the property. Limited historical information was available for the property. The following table contains information for the owner of the property as listed in the tax files available for review. However, Cardno ATC did conduct a search for Environmental Liens and/or AULs using client supplied information. No Environmental Liens or AULs were identified from the Client supplied information. 5.3.5 Historical USGS Topographic Quadrangles Cardno ATC reviewed 1908, 1960, and 1971 (revised from 1960), historical USGS Topographic Timnath Quadrangle (acquired from EDR) for information regarding past uses of the property. The topographic maps showed the property as undeveloped. The EDR Historical Topographic Map Report is included in Appendix G. The review of historical topographic maps did not identify past uses indicating recognized environmental conditions at the property. 5.3.6 City Directories Research regarding the availability of historical city directories was conducted by EDR and supplied as a report. Review of historical city directories did not identify past uses indicative of recognized environmental conditions. The EDR-City Directory Abstract is included in Appendix G. 5.3.7 Building Department Records Building Department Records were previously discussed in Section 5.1.3. 5.3.8 Zoning/Land Use Records Zoning/Land Use Records were previously discussed in Section 5.1.3. 5.3.9 Prior Reports No prior reports were supplied for review. 5.3.10 Other Historical Sources No other historical sources were reviewed, other than speaking to Mr. Mike Ohu of Hana Dul Inc. (property owner representative). Mr. Ohu indicated he is familiar with the historical usage of the property for the last 10 years. He indicated the property has been a hotel and restaurant for the last 10 years, and believes the property was prior used for agricultural purposes. He indicated he is not familiar with and previous environmental reports for the property. No recognized environmental conditions were found after speaking to Mr. Ohu. PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 20 Cardno ATC 6.0 SITE RECONNAISSANCE The site reconnaissance was conducted by Mr. Russell Hamblin of Cardno ATC on June 24, 2015. Cardno ATC was unaccompanied during the site walk. The following is a summary of visual and/or physical observations of the property on the day of the property visit. Photographs of the property can be found in Appendix C. 6.1 Methodology and Limiting Conditions The site reconnaissance consisted of visual and/or physical observations of: the property and improvements; adjoining sites as viewed from the property; and, the surrounding area based on visual observations made during the trip to and from the property. At the time of the site reconnaissance the weather conditions were sunny and approximately 80 degrees Fahrenheit. 6.2 Hazardous Substance Use, Storage, and Disposal Cardno ATC did not observe evidence of hazardous substance use, storage, or disposal at the property. 6.3 Underground Storage Tanks (USTs) Cardno ATC did not observe evidence of USTs on the property. 6.4 Aboveground Storage Tanks (ASTs) Cardno ATC did not observe evidence of an AST on the property. 6.5 Other Petroleum Products Cardno ATC did not observe the storage or disposal of other petroleum products in hydraulic lifts or other containers on the property. 6.6 Polychlorinated Biphenyls (PCBs) Polychlorinated biphenyls (PCBs) are toxic coolants or lubricating oils used in some electrical transformers, light ballasts, electrical panels, or other similar equipment. The Toxic Substance Control Act regulates any transformer with mineral oil containing PCBs in concentrations greater than 50 ppm. Such transformers are considered PCB-contaminated and require appropriate remediation should they be found to be stained or leaking. PCB content in electrical transformers has been grouped into three categories by the USEPA: < 50 ppm Non-PCB 50 to 499 ppm PCB-contaminated 500 ppm and greater PCB transformer The property has a pad-mounted transformer. The transformer appeared to be in good shape and no stains were observed. Based on current status of the transformers this does represent a recognized environmental condition at the property. Fort Collins City Building Department 7/20/15 Cardno ATC requested information from the Fort Collins City, Building Department regarding records for the property. At the time this report was prepared, the information/records had not been received. PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 23 Cardno ATC 8.0 OTHER ENVIRONMENTAL CONDITIONS 8.1 Asbestos-Containing Material (ACM) Efforts were made by Cardno ATC to visually identify the presence of the most obvious and common ACM at the Site. The buildings did have suspect ACMs on the site. Based on the date of construction of the buildings ACM is most likely present on the site. Suspect ACM, including drywall and joint compound, textured paints, and resilient floor tiles with associated mastics were noted in some cases to be in good condition at the time of the site visit. Based on the scope of work, Cardno ATC did not conduct sampling at the property for ACM. It should be noted that suspect ACM that has not been identified in this report and/or prior reports may be located within walls, ceiling cavities, and other non-accessible areas. Precaution should be used in relation to these currently unidentified materials until proper sampling and analysis have determined the asbestos content. The Utah Department of Environmental Quality requires all suspect ACM, including drywall, vinyl floor tiles and mastics, textured paints, spray-on ceiling texture, etc. be assumed to be positive with regard to asbestos or sampled to indicate negative asbestos content prior to renovation or demolition activities that will disturb suspect ACM. If the buildings are intended to be demolished, an asbestos survey is recommended. All other suspect materials not identified within this report should be assumed to be asbestos containing, unless future bulk sampling determines otherwise. 8.2 Radon Radon is a naturally occurring colorless, odorless gas that is a by-product of the decay of radioactive materials potentially present in bedrock and soil. The EPA guidance action level for annual residential exposure to radon is 4.0 picoCuries per liter of air (pCi/L). The guidance action level is not a regulatory requirement for private owners of commercial real estate, but is commonly used for comparison purposes to suggest whether further action at a building may be prudent. Cardno ATC’s review of published radon data indicates that the property is located in EPA Zone 1, which is an area of moderate to high propensity with regard to the potential for elevated levels of radon gas. Of the 12 sites tested for the zip code 80524, the average radon concentration was 5.2 pCi/L. This level is above the EPA guidance action level. Based on the available statistics, zoning of the property and the lack of projected below-grade areas, radon is not considered an environmental concern to the property. 8.3 Lead in Drinking Water Cardno ATC reviewed the 2013 Fort Collins City Water Quality Report, which indicates that the municipally-supplied water meets or exceeds federal drinking water standards, including those for lead. Lead in drinking water testing was not conducted for this ESA. Based on the commercial nature of the property and because the property receives its drinking water from a municipal source, testing for lead content in drinking water was not addressed for this Phase I ESA and no additional investigation is recommended at this time. PHASE I ENVIRONMENTAL SITE ASSESSMENT Proposed Maverik Store 4333 East Mulberry Street Fort Collins, Colorado 80524 Project No. 271BS00099 24 Cardno ATC 8.4 Lead-Based Paint (LBP) Based on the date of construction it is possible Lead-Based Paint (LBP) exists on the property. No LBP sampling was conducted during Cardno ATC's assessment. Cardno ATC does not recommend further action with regard to LBP on the site. 8.5 Mold Screening Microbial growth (e.g., mold or fungus) on building materials may occur when excess moisture is present. Porous building materials such as gypsum board, insulation in walls and ceilings, and carpeting retain moisture and become microbial growth sites if moisture sources are not controlled or mitigated. Potential sources of moisture include rainwater intrusion, groundwater intrusion, condensation on cold surfaces, and water leaks from building systems (e.g., plumbing leaks, HVAC system leaks, overflowing drains, etc.). Inadequate ventilation of clothes dryers and shower stalls may also result in excess moisture conditions. Microbial growth may be clearly visible (e.g., ceramic tile mortar in shower stalls) or may be concealed with no visible evidence of its existence (e.g., inside wall cavities). During the site reconnaissance, Mr. Russell Hamblin of Cardno ATC conducted a limited visual water intrusion screening survey for readily observable conditions conducive to water intrusion at the property. The screening consisted of limited interview, document review, and physical observations. It should be noted that this was a non-intrusive investigation and it is possible that water damaged materials and fungal growth may be present in other areas of the building. This includes, but is not limited to, wallboard, wall cavities, pipe/duct insulation above ceilings and in chases, and wall insulation. In addition, if water damaged building material including sheetrock ceilings and walls are not replaced a favorable environment for microbial growth will be created. No areas of moisture intrusion were noted by Cardno ATC, nor were any moisture intrusion issues reported to exist at the property. It should be noted that water stained areas with no visible mold impact does not mean that mold growth is not present in these areas. 8.6 Vapor Encroachment Cardno ATC conducted a limited screening for potential vapor encroachment conditions (VECs) that may affect the property. The VEC screening focused on the current and historical usage of the property and also utilized the aforementioned regulatory database report provided by EDR to evaluate identified Chemicals of Concern (COC), including petroleum hydrocarbons. The results of the limited screening did not indicate the presence of potential VECs for the property. This would not be considered a recognized environmental condition related to the property. A VEC report is located in Appendix L. Should the client wish to further evaluate the potential VECs, Cardno ATC can provide services accordingly. HAMBLIN Page 2 of 7 Professional History Farmland Remedial Investigations Investigation and remedial activities at 180,000-acre Cattle and Sheep ranches in Central and Eastern Montana. The total environmental spend was $475,000. Activities included the investigation and soil and groundwater remediation at various ranch and farm-related facilities at each of these ranches including, several localized farm-related landfills, fuelling centers with USTs and ASTs, farm vehicle maintenance shops, drum storage areas, wood post treatment centers, and cattle and sheep dip tank operations. Hundreds of soil and groundwater samples were collected and analyzed and several groundwater monitoring wells were installed to establish groundwater networks for each area of investigation and remediation. Approximately 5,000 tons of soil contaminated with RCRA 8 metals (includingPb and As), petroleum (diesel, gasoline, and used oil), pentachlorophenol, dioxins, and pesticides (including DDT and Beta-BHC) were permitted and transported to various state and federal solid waste landfills including approximately 700 tons transported to a hazardous waste facility in Idaho. Penta, dioxin, and pesticide-contaminated groundwater from abandoned wood post treatment centers and sheep dip tank areas were treated via post excavation natural attenuation. Additional remediation activities of groundwater contaminated with DDT and beta-BHC required installation of an in situ groundwater infiltration curtain consisting of enclosed filter fabric filled with activated granular carbon charcoal material, various reactive chemicals, and fungus-containing pine tree bark chips designed to react and adsorb the dissolved Beta-BHC contaminants. Regulatory No Further Action Status letters were submitted by the MT Department of Environmental Quality for the closures of each of these facilities. Investigation and remediation activities of soil and groundwater at a 275-arce sod farm in Northern Utah. The total environmental spend was $140,000. Activities included the investigation and soil and groundwater remediation at various farm-related facilities including three AST fueling centers and a farm vehicle maintenance shop with a drum storage area. Nearly 100 soil and groundwater samples were collected and analyzed and four groundwater monitoring wells were installed to establish a groundwater monitoring network one area of investigation and remediation. Diesel, gasoline, and used oil petroleum-related compounds were the main contaminants of concern. Approximately 500 tons of contaminated soil were removed from the three areas of investigation and transported to a local bioremediation repository near Salt Lake City, Utah. Groundwater was treated with several applications of an oxygen release compound (ORC). The ORC material was injected into on-site monitoring wells and directly into an open excavation to expedite the remediation process. Once confirmation sampling confirmed that site soils and groundwater reached compliance with respect to State of Utah screening levels, the remediation team applied for and obtained an Enforceable Written Assurance (EWA) letter, on a fast-track basis, with the Utah Division of Environmental Response and Remediation. The EWA letter allowed for the sale of the property to be completed. Investigation and remediation activities of soil at a 2,500-arce hay farm in Northern California. The total environmental spend was $30,000. Activities included the investigation and soil remediation at various farm-related facilities including a farm equipment storage and wash area, a drum storage area, and two AST fuelling centers. Approximately 30 soil and groundwater samples were collected and analyzed to determine the extent of contamination in these farm facilities. Diesel, gasoline, and used oil petroleum-related compounds were the main contaminants of concern. Approximately 175 tons of contaminated soil were removed from the three areas of investigation and transported to an on-site treatment cell constructed for this remediation activity. Contaminated soils were spread to a thickness of approximately 12 to 16 inches and contained on a plastic liner in a berm area in a remote location at the farm. The soils were treated with bioremediation and oxygen release compounds to allow for ex-situ bio-chemical degradation of the hydrocarbons in the soil. Following four months of product applications, tilling, and watering of the soil, the contaminant levels decreased within California Regional Water Quality Control Board soil www.cardno.com RUSSELL D. Investigation and remediation activities of soil at three 500-arce grape vineyards in the Southern San Joaquin Valley, California. The total environmental spend was $130,000. Activities included the investigation and soil remediation at various farm-related facilities including farm AST fuelling centers and drum storage area. Approximately 90 soil samples were collected and analyzed to determine the extent of contamination in these farm facilities. Diesel and used oil petroleum-related compounds were the main contaminants of concern. Approximately 500 tons of contaminated soil were removed from the three areas of investigation and transported to an off-site bioremediation treatment center for this remediation activity. The remediation team coordinated investigation, remediation, and site closure activities with the Kern County Environmental Department and the Central Valley Regional Water Quality Control Board for No Further Action Status at each of the three sites. Investigation and remediation activities of soil at a farm labor camp and abandoned orange orchard totalling approximately 1,000 acres of derelict farm properties, located approximately 50 miles south of Tampa, Florida. The total environmental spend was $72,000. Farm facilities consisted of an abandoned orange orchard with several AST fuel storage areas where about 400 tons of diesel-contaminated soils were excavated and transported to a county landfill. The services also included an investigation and soil remediation of approximately 100 tons of pesticide-contaminated and heavy oil contaminated soil associated with a former agricultural vehicle wash pad. Completed several other farm-related investigation and remedial activities at contaminated agricultural sites in Eastern Montana, Southern Georgia, Northern California, Central California, Western Kansas, and in Northern Utah. Mining-Related Investigations In 2006-2007 Mr. Hamblin conducted detailed due diligence-related studies including a Phase I ESA, Expanded Phase I ESAs, and Phase II ESA sampling and analyses for a approximately 500-acre abandoned uranium mine site on Prince of Wales Island in Alaska. The studies included contamination assessments of uranium and other radioactive compounds and heavy metals of four areas where mine-related waste material have been disposed. The goal of the investigation was to differentiate areas which have been affected by radioactive mine waste materials and areas of naturally high radioactivity, which have not been affected by mining activities and associated waste materials. In 2007-2008 Mr. Hamblin completed due diligence studies at two large open pit mining operations within the Mesabi Range in northern Minnesota. Evaluated past and current environmental issues including areas of petroleum contamination from USTs and ASTs and current and futures status of the facilities’ Mine Closure Permit, Title V Air Quality Permit, and National Pollutant Discharge Elimination System (NPDES) permits with the State of Minnesota Department of Natural Resources and Pollution Control Agency to determine current and future liabilities for the prospective purchaser. This assessment was to allow the client to satisfy one of the requirements to qualify for the innocent landowner, contiguous property owner, or bona fide prospective purchaser limitations on CERCLA liability. The scope of services also included sampling and analyses of near surface soils in an abandoned explosives magazine. This assessment constituted all appropriate inquiry into the previous ownership and uses of the site consistent with good commercial or customary practice, as defined in 42 U.S.C. § 9601(35)(B) of CERCLA. Conducted detailed due diligence-related studies on a mining operation in Emery County Utah including evaluation of facility compliance related to the use of on-site organic solvents; spill containment and integrity of aboveground storage tanks; evaluation of wastewater discharge permits; waste-rock storage evaluation; and ore processing operation. The purpose of the Hydrologic Description was to evaluate the potential hydrologic consequences of additional underground mining operations. Evaluations included the study of groundwater chemistry from existing groundwater monitoring wells and surface water monitoring locations (including creeks and springs) and proposing additional monitoring wells to fill data gaps related to proposed additional mining locations. Managed a team that completed and submitted a Notice of Intent (NOI) to Utah’s Division of Air Quality as part of the Air Quality permitting process for a client conducting mining and milling of copper and other precious metals in Southern Utah. Services also included completing a fugitive dust permit and a compliance program to implement and stay in compliance with the air quality permit. Conducted soil and vegetation sampling in Juab County as part of a University academic study on the potential for heavy metal (Cu, Au, Ag) absorption by desert flora. Tasks included field sampling, mapping, and laboratory sample preparation. Manufacturing and Hazardous Waste-Related Investigations Managed soil and groundwater assessments at chemical and industrial manufacturing facilities in Oregon, California, and Utah, including RCRA and CERCLA facilities. Soil and groundwater studies involved the investigations and remediation of halogenated and aromatic volatile constituents, petroleum (gasoline diesel, and waste oil) products and metals. Managed a preliminary RCRA soil sampling investigation and completed a RCRA Facilities Investigation (RFI) Work Plan development at a solvent recovery in the Portland Oregon, area. Services have also included negotiations with state [Oregon Department of Environmental Quality (DEQ)] and Federal (EPA) regulatory agencies for corrective measures study (CMS). Performed Hydrogeologic Assessment Report (HAR) studies for the State of California's Regional Water Quality Control Board (RQCB) at two chemical manufacturing facilities in Bakersfield and Fresno County. The study at the Fresno County facility involved investigation of radionuclides, metals, sulfuric acid, and dissolved solids. The Bakersfield facility involved the investigation of metals and chlorinated solvents. Both HARs included aquifer testing and characterization. Conducted groundwater assessments and Solid Waste Assessment Testing (SWAT) for the State of California at several landfills, including sites near Fresno, Modesto, Visalia, and Corcoran. The studies included ongoing groundwater monitoring and aquifer- and vadose- zone monitoring. Performed hydrogeologic investigations at several agricultural impoundment facilities throughout the West Coast. Included evaluation of pesticide and agricultural chemical source areas, including USTs, lined ponds, and unlined impoundments. Agricultural chemical included organophosphorus and chlorinated pesticides, carbonated and phenoxy herbicides investigations included soil and groundwater investigations and on-going quarterly groundwater monitoring. Managed installation of groundwater remediation network at an NPL Superfund site in Salt Lake City, Utah. This remedial investigation included installation of extraction wells and piezometers, well development, soil sampling, step drawdown testing and evaluation, and well modification to network with an air-stripping system. Conducted and managed a Remedial Investigation (Rl) at a major paper products facility in Portland, Oregon. Multiple investigations were conducted at this facility concurrently, based on CERCLA investigation protocols, following the removal of over 25 USTs, which previously www.cardno.com RUSSELL D. Soil and groundwater samples were analyzed for several other organic chemicals including chlorinated solvents (TCE and PCE) and total priority pollutant metals. A vapor extraction system was designed, pilot tested, and installed at this site to remediate toluene-impacted soils. Managed the design, implementation, and monitoring of five vapor extraction systems for soil and groundwater remediation systems at several UST and hazardous waste facilities in Oregon and Utah. Designed and installed a vapor extraction/air sparging dual system at a wood products facility in North Bend, Oregon. The System operated for approximately 1.5 years and was successful in remediation of soil and shallow groundwater contaminated with mineral spirits. Multiple remedial investigations were also conducted at this facility to evaluate and assess hydraulic oil, mineral spirits, diesel, and gasoline contaminated soil and groundwater. Managed design, implementation, and monitoring of soil mounding and venting bioremediation systems. Included treatment of over 1,000 cubic yards of excavated soils contaminated with gasoline, heavy fuels, and waste oil via injection of nitrogen and phosphate nutrients, microbes, and emulsifiers for bioremediation at an 80-year-old bulk storage facility for a major petroleum company in Cornelius, Oregon. Completion of the bioventing mound was accomplished in approximately one year. Conducted feasibility studies at industrial waste facilities for soil and groundwater remediation considerations; including completing aquifer slug and pumping tests, vapor extraction pilot testing, air sparging pilot testing, soil permeability assessments, chemical evaluation, and historical research. Mr. Hamblin utilized data from these studies to evaluate the most feasible and cost-effective remedial action alternatives. Designed, installed, and operated soil vapor extraction (SVE) system for a paper products company in Portland, Oregon, for the remediation of toluene-contaminated soils. Underground Storage Tank (UST) Remedial Investigations Managed soil and groundwater investigations and remediation relating to (Leaking Underground Storage Tanks (LUST systems at over 100 service station facilities and Managed soil and groundwater investigations and remediation relating to bulk chemical plants for major oil companies (7-Eleven, Texaco, Mid-State Petroleum, Unocal, ARCO, and Pennzoil) sites in Oregon, California, Washington, Idaho, and Utah. Projects included UST decommissioning, site inspections, initial contaminant abatement measures, follow-up soil and groundwater investigation to define the extent of contamination, and Feasibility Studies (FSs) for on-site and off-site remediation. Managed a $1.25 million remediation project for a major US oil company in a rural community in southern Utah. Remedial investigations included installation of 16 groundwater monitoring wells and 20 remediation wells, including 10 extraction wells, seven monitoring wells, and three injection wells. Well depths ranged from 40 to 120 feet. Remedial investigations also included quarterly groundwater monitoring, natural attenuation monitoring and evaluations, development of a remedial strategy, evaluation of light non-aqueous phase liquid (LNAPL), soil vapor extraction (SVE) and high vacuum (HiVac) pilot testing, ecologic and human health risk assessment, indoor air quality monitoring and evaluation, remedial design, and SVE/HiVac system installation, operation, monitoring, and maintenance. Also conducted sound monitoring and assisted with the design and construction of sound attenuation measures for the remediation system, which included a sound attenuation barrier and silencer emissions stack. Expert Witness Served as an expert witness on a case in Hillsboro, Oregon for an owner of a gasoline service station who was in part bought out by the state of Oregon Highway Division as part of a state road expansion project. The buy-out resulted in the closure of the gasoline retail operation, and because contamination was encountered during closure of the USTs, the State offered minimal financial reimbursement for the property. Legal counsel and Mr. Hamblin were successful in negotiating additional State money for our client based on the argument that retail gasoline operations could have been reopened while in situ vapor extraction remedial activities were completed on site if the State had not purchased the property. Due Diligence-Related Property Transfer Assessments and Auditing Completed and managed over 1,600 Phase I and Phase II property transfer assessments for various landowners, land developers, commercial lending institutions, and industrial facilities in over 30 U.S. states, three Canadian Provinces, and Baja California, Mexico. Managed and performed over 100 transaction screen process (TSP) investigations of proposed cellular tower sites in accordance with ASTM standards in Utah and Idaho for a major regional FCC-regulated cellular telecommunications company. Cryptosporidium and Giardia Cryptosporidium and Giardia come from animal and human waste in the watershed and are common in untreated surface water. When ingested, the organisms may cause fever, nausea and diarrhea. They are removed by a well-maintained water treatment process. In 2013, Fort Collins Utilities tested the untreated source water for the organisms. Both Giardia and Cryptosporidium were found in the Poudre River samples. Neither was found in Horsetooth Reservoir samples. Unregulated Contaminants EPA required that we monitor the finished water three times in 2013 for 28 contaminants that are not currently regulated (no MCL). EPA plans to use this information for writing future regulations. Where Our Water Originates Fort Collins Utilities’ water comes from the Horsetooth Reservoir and Cache la Poudre River. Beginning as rain and snow in the mountains, Horsetooth water is delivered from the western slope via the Colorado- Big Thompson Water Project, while Poudre River water originates on the eastern slope, northwest of Fort Collins. Our Water Treatment Facility produces nearly all the water it distributes; however, customers may occasionally receive a blend of water treated by Utilities and the Soldier Canyon Filter Plant. Both treatment facilities Source water may contain: • Microbial contaminants, such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations and wildlife. • Inorganic contaminants, such as salts and metals, which may be naturally occurring or result from urban stormwater runoff, industrial or domestic wastewater discharges, oil and gas production, mining or farming. • Pesticides and herbicides, which may come from a variety of sources, such as agriculture, urban stormwater runoff and residential uses. • Organic chemical contaminants, including synthetic and volatile organic chemicals, which are byproducts of industrial processes and petroleum production. These contaminants also may come from gas stations, urban stormwater runoff and septic systems. • Radioactive contaminants, which may be naturally occurring or the result of oil and gas production and mining activities. Environmental Leadership The Water Treatment Facility strives to be a good steward of natural resources and an environmental leader. The facility has established a formal Environment Management System (EMS) that has been certified to conform to the ISO 14001:2004 standard. A key aspect of this EMS is reduction in energy usage and greenhouse gas footprint. The facility is participating in the Colorado Industrial Energy Challenge, which is sponsored by the Colorado Governor’s Energy Office and the U.S. DOE. The facility also conducted technical energy audits and engineering studies with recommendations that yielded significant reductions in energy usage, and cost savings; even in the face of rising treated water demands. The facility participates in the Colorado Environmental Leadership Program (ELP), which is administered by the CDPHE Division of Environmental Health and Sustainability. As the result of its continuing environmental stewardship and the successful ISO certification of the EMS, the facility was recognized as an ELP Gold Leader in 2013. Protecting the Colorado-Big Thompson and Cache la Poudre Watersheds Our drinking water originates in the Cache la Poudre River and Colorado-Big Thompson (C-BT) watersheds. Fort Collins Utilities collaborates with other local drinking water providers to monitor and assess water quality in the upper Cache la Poudre watershed. We also are a member of the Big Thompson Watershed Forum (btwatershed.org) and partner with a variety of organizations to monitor and analyze water quality in the C-BT watershed and Horsetooth Reservoir. Monitoring data are used to determine if activities in the watershed are causing water quality to change over time. With the exception of wildfires, water quality data collected by Utilities do not indicate the presence of any persistent sources of contamination within either watershed. In 2012, the Upper Poudre Watershed was heavily impacted by the Hewlett and High Park Fires, which together burned nearly 95,000 acres. The City of Fort Collins has worked with the Natural Resource Conservation Service (NRCS) and other local partners through the Emergency Watershed Protection (EWP) program to assess and mitigate the hazards associated with flash flooding and sediment erosion. In 2013, post- fire treatments focused on aerial application of wood mulch to burned drainages that pose the greatest risk to water quality and other human, cultural and natural resource values in the watershed. Additional mulching will continue in 2014 and is expected to be completed by the end of August. Utilities will continue to monitor the effects of the fires on water quality as the watershed recovers. Using early-warning technology and targeted water quality monitoring, Utilities is able to evaluate the watershed recovery process and optimize water treatment operations, while continuing to meet the standards for high-quality drinking water. To help protect our watersheds, the Colorado Department of Public Health and Environment (CDPHE) prepared a screening- level assessment of potential sources of contamination. The ratings show our two watersheds have moderate and moderately low susceptibility for contamination from several potential sources which may include underground, above ground and/or leaking storage tanks, existing and/or abandoned mine sites, septic systems, among other potential hazards. Treating Source Water Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of these contaminants does not necessarily indicate that the water poses a health risk. As water travels over the land’s surface or through the ground, it dissolves naturally occurring minerals and can pick up substances resulting from the presence of animals and humans.
