Berglund Farnsworth Group INC. 1612 Specht Point Road, Suite 105 Fort Collins, CO 80525 OWNER: Alberta Development Partners 5750 DTC Parkway, Suite 210 Greenwood Village, CO 80111 PROJECT DESCRIPTION: This is a request for consideration and approval of Project Development Plan (PDP), Foothills Mall Redevelopment Subdivision Filing 2. The project is located on the northwest corner of E Foothills Parkway and Mathews Street. The project will replat approximately 9.3 acres to reshape 3 lots and 2 tracts. The Foothills Mall Redevelopment Subdivision is a mixed-use shopping center that was approved in June 2014 and is currently under construction. The original plat included approximately 74 acres located between Standford Road and S College Ave. For information purposes, the buildings in the replated area are currently undergoing review through a Minor Amendment. However, the Minor Amendment is not the subject of the administrative hearing. RECOMMENDATION: Staff recommends approval of Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan. EXECUTIVE SUMMARY: The approval of Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan complies with the applicable requirements of the City of Fort Collins Land Use Code (LUC), more specifically: • Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan complies with process requirements located in Division 2.2 – Common Development Review Procedures for Development Applications of Article 2 – Administration. COMMENTS: 1. Background: Vicinity Map The subject property was annexed into the City in February of 1969 as part of the Spencer Annexation. Today the property is being redeveloped as part of the Foothills Mall Redevelopment. Demolition and construction are currently underway for the entire approved redevelopment project, including this area. Foothills Mall Redevelopment Subdivision Filing 2, PDP150002 Administrative Hearing Officer: March 5th, 2015 Page 3 Zoning History (most recent to past): • Upon annexation in 1969 the property was zoned General Business (B-G). • In 1970 the City’s zoning ordinance was amended to include a new zone district call High Business (HP). Shortly following this amendment the property was rezoned to (HP) • In 1997, upon the adoption of the Land Use Code, the property was zoned Commercial (C). • In 2011 the C District was renamed General Commercial (C-G) District. This site was included in the renaming. The C-G designation has remained intact through the present. The current surrounding zoning and land uses are as follows: Direction Zone District Existing Land Use North Medium Density Mixed-Use Neighborhood Thunderbird Estates Eighth: Single Family units General Commercial Residential: Swallow Condominium General Commercial Thunderbird Estates Ninth: Fueling Station South General Commercial Foothills Mall Redevelopment East General Commercial Foothills Mall Redevelopment West General Commercial Foothills Mall Redevelopment Additionally, the property and the surrounding properties that are zoned C-G are also within the boundaries of the Transit Oriented Development Overlay district. 2. Compliance with Article 4 of the Land Use Code – General Commerical (C-G): The site is located in the General Commercial (C-G) district. There are no zone district standards that pertain to the platting or replatting of property. Compliance with Article 3 of the Land Use Code – General Development Standards The project complies with all applicable General Development Standards; with the following relevant comments A. Division 3.2 – Site Planning and Design Standards 1) 3.3.1(B)(1) – Lots: The replat creates no new lots or new pad sites. With access easements, all lots will continue to have vehicle access directly to the public right-of-way. The replat allows for an access point that was to the public right-of-way Mathews Street to be relocated to connect with the private drive E Foothills Parkway. 2) 3.3.1(B)(2) – Lots: The general layout of the lots and tracts in the relationship of the larger foothills Mall Redevelopment does not change. The changes to the lots are to accommodate different sized buildings. 3) 3.3.1(C) – Public Sites, Reservation and Dedications: There is no new dedication of right-of-way with this plat. Utility, access, and emergency access easements have been reshaped to meet the needs of the lot and tract changes. 4. Findings of Fact/Conclusion In evaluating the request for the Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan, Staff makes the following findings of fact: A. Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan complies with process located in Division 2.2 – Common Development Review Procedures for Development Applications of Article 2 – Administration. B. Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan complies with relevant standards located in Article 3 – General Development Standards. C. There are no applicable standards in Division 4.21, General Commercial (C-G) of Article 4- Districts for Foothills Mall Redevelopment Subdivision Filing 2 Project Development Plan.
