FINDINGS
1. Evidence presented to the Hearing Officer established the fact that the hearing was
properly posted, legal notices mailed and notice published.
2. The PDP complies with the applicable General Development Standards contained in
Article 3 of the Code.
a. The PDP complies with Section 3.3.1(B), Lots, because: the PDP creates no new
lots or pad sites; all lots will continue to have direct vehicle access to the public right-of-
way; and the general layout of the lots and tracts is not changing.
b. The PDP complies with Section 3.3.1(C), Public Sites, Reservation and Dedication,
because there are no new dedications in the PDP, and the existing utility and access
easements have been redrawn to reflect the lot and tract changes.
3. The PDP is not subject to any standards in Article 4 of the Code.
DECISION
Based on the foregoing findings, the Hearing Officer hereby enters the following rulings:
1. The PDP is approved as submitted.
DATED this 16
th
day of March, 2015.
