Carberry PROJECT DESCRIPTION: This is a request for a Project Development Plan (PDP) for the Foothills Mall Redevelopment, Subdivision Filing 2, located on the northwest corner of East Foothills Parkway and Mathews Street, to replat approximately 9.3 acres to reshape 3 lots and 2 tracts. The Foothills Mall Redevelopment Subdivision is a mixed-use shopping center approved in June 2014 and currently under construction. SUMMARY OF DECISION: Approved ZONE DISTRICT: General Commercial (C-G) HEARING: The Hearing Officer opened the hearing at approximately 5:30 p.m. on March 5, 2015, in Conference Room A, 281 North College Avenue, Fort Collins, Colorado. EVIDENCE: During the hearing, the Hearing Officer accepted the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant; and (3) a copy of the public notice (the formally promulgated policies of the City are all considered part of the record considered by the Hearing Officer). Evidence presented to the Hearing Officer established the fact that the hearing was properly posted, legal notices mailed and notice published. 2. The PDP complies with the applicable General Development Standards contained in Article 3 of the Code. a. The PDP complies with Section 3.3.1(B), Lots, because: the PDP creates no new lots or pad sites; all lots will continue to have direct vehicle access to the public right-of- way; and the general layout of the lots and tracts is not changing. b. The PDP complies with Section 3.3.1(C), Public Sites, Reservation and Dedication, because there are no new dedications in the PDP, and the existing utility and access easements have been redrawn to reflect the lot and tract changes. 3. The PDP is not subject to any standards in Article 4 of the Code. DECISION Based on the foregoing findings, the Hearing Officer hereby enters the following rulings: 1.
