Weed control needs to be addressed on this project, especially the area to the south of the ponds shown on these plans, on south to Kechter Road. Response: We have met with Les Thompson from the Boxelder Ditch Co to review the plans. Les indicated that he was fine with the plans and would sign them. He isn’t too concerned about the “filling operations” because it doesn’t propose to change or impact the Boxelder ditch in any way. All work proposed needs to be within this legally described area. Response: A metes and bounds legal description is now provided in the Weitzel Pond #1 (formerly named “Harmony & I-25 PDP SOUTH”) submittal supporting documentation sheet (updated January 13, 2015). Comment Number: 2 Comment Originated: 12/01/2014 12/01/2014: Need ownership information for the Agreement. Response: Ownership information is also provided on the updated Weitzel Pond #1 (formerly “Harmony & I-25 PDP SOUTH”) submittal supporting documentation sheet. Comment Number: 3 Comment Originated: 12/01/2014 12/01/2014: Label the plans as Overlot Grading Plans for: rather than calling these utility plans. That way we will be able to distinguish them later in the agreements. Response: The plan title has been changed to “Overlot Grading Plans for…” as requested. Comment Number: 4 Comment Originated: 12/01/2014 12/01/2014: Please note that any filling within areas that are to be future right-of-ways are to be tested and meet certain criteria. Since there are going to be areas of future right-of-way that are not identified on these plans the Developer needs to know that those areas may require different fill/ compaction/ treatment/ mitigation at such time those areas become right-of-way and infrastructure improvements are constructed. Response: We have added a note to the Grading Plan (note #9) to address this concern. Comment Number: 5 Comment Originated: 12/01/2014 12/01/2014: Site plan doesn’t show that all the trees within the LOD are going to be removed. How are you going to fill and keep these? Will there be a tree mitigation plan? Response: A Tree Mitigation Plan has been included with this submittal that indicates the trees to remain, as well as some notes on the grading plan that indicate specific grading around the existing trees. Comment Number: 6 Comment Originated: 12/01/2014 12/01/2014: Sheet 5 of 6 of the utility plans notes work outside of the LOD. Is this work actually proposed? If so the LOD needs to be modified. If the work is not to be done than remove the note. Response: The LOD has been modified to include all improved areas. Grading and Erosion control sheets have been modified to show the area that shows grading (removal) of the illegally placed fill in the floodway. Comment Number: 7 Comment Originated: 12/01/2014 12/01/2014: Can’t tell from the contours if the bank of the ditch is the highest spot and thus no additional drainage goes into the ditch or if the new fill will be the highest spot and additional drainage will go into the ditch. Ditch company will need to sign the plans if there is any impact to the ditch or work within the ditch companies easement. Response: The top of bank on the east side of the Boxelder ditch is a local high spot. The proposed contours show a high point ridge (running north-south) that would direct some runoff toward the direction of the Boxelder ditch, but the ditch bank will prevent stormwater from directly running into the ditch and the grading plan now shows a swale along a portion of the Boxelder on the east side to accept runoff. Response: Top of Bank line included as requested. Comment Number: 2 Comment Originated: 12/02/2014 12/02/2014: Please delineate and label the Buffer Zone for the Resource of Special Concern at this site, namely, the Great Blue Heron Colonial Nesting Site. The Buffer Standard for the City of Fort Collins is 825 ft. As discussed and agreed upon at the October 30, 2014, meeting, please delineate using the Colorado Parks and Wildlife Buffer Standard of 1,640 ft. Response: The City of Fort Collins standard 825’ buffer for the rookery is shown on the site plan and grading plan. Per the discussion with CPW their standard is at max 300 meters and this has been shown on the site plan. Comment Number: 3 Comment Originated: 12/02/2014 12/02/2014: The Ecological Characterization Study relates that at this time, the effects of development on the Great Blue Heron Colonial Nesting site is uncertain, whether development activities in PDP South occur during heron nesting season or outside of heron nesting season, or whether changes in habitat occur during or outside heron nesting season. Therefore, a heron expert needs to be consulted to review this situation in order to provide further information and expert recommendations moving forward. With this information, the City of Fort Collins will have a better estimate of how the filling of the pond(s) will or will not impact the heron rookery, which is currently the most critical resource located on this site. Response: Nancy Howard and Mike Sherman from the CPW have agreed to serve as the Heron Experts for this project. They were present at a meeting on 1/26/2015 and gave their advice on the rookery and the impacts of construction. A course of action was agreed upon and TST will generate a draft of the language for the Development Agreement to outline this course of action. An updated ECS was also submitted prior to the 1/26/15 meeting. Comment Number: 4 Comment Originated: 12/02/2014 12/02/2014: 6. If the ponds can be filled without negatively impacting the heron rookery, then, a Conceptual Mitigation Plan will need to be created to mitigate for the lost ecological value from the loss of the ponds and the surrounding wetlands. I suggest a meeting to review the written and drawn plans with myself, the applicant, and the ecological consultant. As discussed in the October 30, 2014 meeting, the priority area for mitigation is in the Wellington Downs Pit (via permanent protection of this area). If this is not able to be achieved, then mitigation in the pre-1981 pond can be explored. Please note that the Mitigation Plan will need to include estimated mitigation costs associated with this PDP South development in order to determine the amount of bond that the City of Fort Collins would require. This bond will be included as a part of the project’s Development Agreement. Response: We are continuing to work with Environmental Planning directly on the Mitigation Plan, we have included a draft inventory of the mitigation areas with this submittal. Comment Number: 5 Comment Originated: 12/02/2014 12/02/2014: 6.7. If a Tree Inventory is required and a Tree Mitigation Plan, please note that tree removal or pruning should occur outside of migratory songbird nesting season (February 1 – July 31), or, that a survey should be completed prior to removal or pruning to ensure that no active nests are present. A note should be added to the site/landscape plans accordingly. Response: A Tree Mitigation Plan is provided with this submittal. The requested note has been added to the plans. The erosion control requirements are in the Stormwater Design Criteria under the Amendments of Volume 3 Chapter 7 Section 1.3.3. Current Erosion Control Plan Submitted does not meet requirements please correct redlines (included in the Stormwater Plans). The No-Rise Certification must include existing and proposed grades and documentation that the proposed grades will be the same as what existed prior to the LOMR-F. The pre-LOMR-F grades can be found on the FEMA work maps (with 2-foot contours) that were in effect at that time. After the grading is complete, we will need to be provided with a re-certification documenting that the finished grades do in fact match the pre-LOMR-F grades. Response: Noted.
