hereby responds to CCF Investments, LLC's ("CCF") request for a waiver of notice
concerning your desire to obtain approval by the City of Fort Coliins (the "Cit ") of the
Waterfield Third Fiiing plat (the "Plat") to subdivide portions of a propertl ibr residential
development letter.
CCF purports to o\ n a cefiain parcel of real propefty u,ithin ttre Vy'aterfield
Subdivision in the City of Fort Collins, Counfy of Larimer, State of Colorado, and more
particularly described as: LOTS 1 THROUGH 43, hICLUSM, AND TRA.CT C,
WATEMIELD PUD FIRST FILNG, AND LOTS 1 THROUGH 102, INICLUSNE, AND

LARIMER, STATE OF COLORADO ("Propert-y"). A portion of the Property'. is subject to a
mineral reservation currently held by Aaadarko of "a11 coal that ma1' be underaeath the
surface" as set forth in a deed dated June 15, 1885 and recorded in Book 29 at Page 563 of
the Larimer County real properl,v records.
Pursuant to C.R.S. $24-65.5-103, the City requires that Surface Omer
provide
lotification to mineral estate o\4'ners of ihe application for surface development or obtain a
ra.ritten w.aiver of such notificatio11. Anadarko hereby w.aives notification in connection rvith
the processing and approval of the Plat.
Notice is waived only to the extent that the application applies to this matter so that
Notice is not waived for subseqr:ent applications for deveiopment that include other or
additional property for which the Aradarko or affiiiates own minerals or oil and gas
ieasehold intcrests.
It is our understanding that this letter u.,i11 be provided to the Board as evidence of the
-,vaiver by Anadarko and atfiliates to timely notice of the hearing.
