RE: Old Town Flats Project Development Plan
Please accept this request for a modification of Standards to Section 3.2.2(L)(2) of Land Use Code.
Background
The project is located at the Northeast corner of Maple Street and Mason Street. This site will be
developed into a (5) story multi-family dwelling unit building (94 units) that will face both Mason and
Maple streets. Old town Flats will have a total of 85 off street parking spaces that will be situated to the
Northeast of the buildings. The parking will all be above ground with some being tucked under the
building structure. Zoning for the site is (D) Downtown Development zoning district and falls within the
TOD Overlay district. The development will be just North of the downtown transit station.
This modification request is in accordance with the review procedures set forth in Section 2.8.2(H) of the
Land Use Code as follows:
Modification to Section 3.2.2(L)(2)
Code Language: Section 3.2.2(L)(2) Parking Stall Dimensions states the following:
“(L) Parking Stall Dimensions. Off-street parking areas for automobiles shall meet the following
minimum standards for long- and short-term parking of standard and compact vehicles:
(2) Compact Vehicle Spaces in Long-term Parking Lots. Those areas of a parking lot that are
approved as long-term parking have the option to include compact parking stalls. Such approved
long-term parking areas may have up to forty (40) percent compact car stalls using the compact
vehicle dimensions set forth in Table B.”
Requested Modification: The property is in the TOD Overlay zone district, which does not require
parking for the residential units. The Old Town Flats project will be providing 85 off-street parking
spaces -31 standard (9’x18’) spaces, 50 compact (8’x15’) spaces and 4 accessible spaces. Due to the
unique restraints of the site there is insufficient room needed for drive aisle widths and parking stall
depths.

The following parking spaces are provided:
Standard Parking Stalls = 35 (41.2%)
Compact Parking Stalls = 50 (58.8%)
Total 85 (100.0%)
The Code requires 85 spaces x 40% = 34 compact spaces maximum
Given the above, we respectfully request that the Old Town Flats PDP project be allowed to exceed the
maximum number of compact spaces by 16 spaces.
Justification
This modification is not detrimental to the public good in that:
- We are proposing a project which follows the Land Use Codes and creates a high quality
project in use of architectural features and materials. This would be a minor modification that is
needed due to site constraints.
- While not required in the TOD, the off-street spaces provided help reduce on-street parking
demand, thus providing a benefit to the surrounding neighborhood.
- The proposed project is one that will add great character to the neighborhood and help create
a link to Old Town and the surrounding area with a reduction in the need for vehicular
transportation. Owners will be walking distance from all the Old Town amenities as well as
having the convenience of the downtown transit station. Overall this project will be a great
asset for the area and works well within the surrounding development and getting people within
walking distance.
