Comment Number: 13 Comment Originated: 02/07/2012 02/07/2012: As set forth in Section 4.22(B)(2)(d)1 & 5 of the CS, Service Commercial District, warehouses and wholesale distribution facilities must be located at least 200' from North College Avenue. Just in case the property owner(s) were to want to include these uses on the development plan please take note that none of the buildings are to be at least 200' from the street. Response: While the east wall of the western building is 177’-9 ½” from the North College right-of-way and it is screened from North College by heavy plantings and a 6 foot high fence. We ask that warehouses and wholesale distribution uses be allowed in this building at distances greater than 200’-0” from the North College right-of-way. The preliminary design of the building is such that it would be divided into four 25’ wide bays. This would mean that the eastern-most 25’ bay could be used for offices while the western 75’ of the building could be used for warehouses and wholesale distribution. This could be monitored as building plans or tenant finish plans are submitted to the city for review. Comment Number: 3 Comment Originated: 02/06/2012 02/06/2012: There is so much line work on the 2 Site Plans and it makes it very difficult to read them. The utilities, curve radii, existing landscaping & notes, and possibly contours may be eliminated from these plans. Response: The drawings have been cleaned up for clarity. Comment Number: 4 Comment Originated: 02/06/2012 02/06/2012: There is a lot of "line over" information on the Site Plans that must be eliminated. This makes certain areas of the plan illegible. Comment Number: 5 Comment Originated: 02/06/2012 02/06/2012: Is the pond in the southwest corner of the site really a "retention" pond, not a detention pond? Response: The drawings have been changed to show a “detention pond.” Comment Number: 6 Comment Originated: 02/06/2012 02/06/2012: There are 2 described lines (metes & bounds) on the Site & Landscape Plans that are not shown on the Subdivision Plat. What are they for? Please see red-lined Site Plans. Apparently they are not needed on the plans and should be removed to help clarify the plans. Response: These lines have been removed. The described lines were shown to denote the existing internal property lines and the 200’ frontage currently used for the sale of automobiles. Comment Number: 8 Comment Originated: 02/08/2012 02/08/2012: Is it intended with Phase 4 that curb and gutter (along with sidewalk?) is to be constructed along the north side of the future street abutting the detention pond? The metal culvert plate seems to imply that an attached sidewalk is being proposed and that the culvert outlets to a curb and gutter section, but this isn't entirely clear. Response: The curb, gutter and sidewalk are to be installed at such time that the future street is installed. This has been clarified on the revised Site Plan. See revised Civil drawings. P.O. Or is this intended to indicate an additional phase for the development not indicative of the future street being built? Please note that upon such time that the future street is intended to be built, any curb, gutter, sidewalk and pavement proposed with this project that may be existing is not assumed to be in place to satisfy the ultimate construction for the future street. It would then need to be apparent in language in the development agreement that the developer's obligation for the north half of the future street, at the time the street is constructed, assumes that any improvements proposed with this development would not constitute ultimate improvements that are in satisfaction (either partially or in whole) with the future obligation requirement. Response: It is the intent that the curb, gutter and sidewalk are to be installed at such time that the future street is required to be installed. The “Phase 5” note has been removed from the Site Plans. Comment Number: 11 Comment Originated: 02/08/2012 02/08/2012: The metal sidewalk culvert detail if intended to be built with a phase in the development has since been updated and should be modified as attached. Response: It is the intent that the curb, gutter and sidewalk are to be installed at such time that the future street is required to be installed. The “Phase 5” note has been removed from the Site Plans. Topic: General Comment Number: 3 Comment Originated: 02/08/2012 02/08/2012: Please ensure document titles are consistent across all the documents. Some documents have "PDP" after the Legacy Auto title. It is suggested to remove the "PDP" designation on the documents as it's not necessary. Response: “PDP” has been removed as suggested. Comment Number: 4 Comment Originated: 02/08/2012 02/08/2012: The requirement of a letter of intent for offsite work is intended to come from the offsite property owner. The offsite storm drainage work requires a letter of intent from Lamplighter Lodging Inc. prior to a hearing on the project. Comment Number: 6 Comment Originated: 02/08/2012 02/08/2012: The use of bollards to block the emergency access should be verified for acceptability by PFA. If acceptable to PFA, the placement of the bollards should be outside of public right-of-way, behind the sidewalk on private property. Response: The knock-down bollards have been moved west of the North College right-of-way. Comment Number: 7 Comment Originated: 02/08/2012 02/08/2012: The access ramp on the west side of the drive aisle that intersects with the future street should ideally be mimicking the access ramp on the east side, directing pedestrians east-west across, not to the corner of the intersection. Response: The intent of the configuration shown was to provide easier handicap access. At such time that the future street is installed the ramp can be reconfigured to current city street standards. This is fine. The only concern again would be verification of how the proposed metal sidewalk culvert would tie into an area without the typical curb and gutter, street improvements to tie into. I'd suggest then that the construction plans don't indicate this curb/gutter street work as Phase 5, but perhaps "future asphalt street and concrete walk, not a part of this development plan". Response: It is the intent that the curb, gutter and sidewalk are to be installed at such time that the future street is required to be installed. The “Phase 5” note has been removed from the Site Plans and Farkus Place is noted as “future.” Comment Number: 12 Comment Originated: 02/08/2012 02/08/2012: Matt Baker in Engineering Street Oversizing has provided the information that the repay due for College Avenue improvements is currently $190,935.83. This amount is based on today's dollars and would be adjusted with inflation at the time of repayment which would be prior to issuance of a building permit. Topic: Plat Comment Number: 1 Comment Originated: 02/08/2012 02/08/2012: The plat language (certificate of dedication, maintenance guarantee, etc.) has since been updated. Please indicate the "limits of development" line, as per Section 3.4.1(N)(1) of the Land Use Code. 2. Please add the following note to the utility, site and landscape plans "See Section 3.4.1 of the Land Use Code for allowable uses within the buffer zone" 3. Please add an Environmental Planner signature to the signature blocks on the utility plans. Response: See revised Utility Plans, Site Plans and Landscape Plans. Topic: Landscape Plans Comment Number: 2 Comment Originated: 01/27/2012 01/27/2012: Within the 50' buffer zone, according to Article 3.4.1(E)(1)(g), the City has the ability to determine if the existing landscaping within the buffer zone is incompatible with the purposes of the buffer zone. The landscaping in the buffer zone, as currently proposed, in insufficient to meet the standards of 3.4.1. For instance, the trees proposed within the buffer area (only three) are lacking both in quantity (we want more trees and shrubs throughout the entire site) and quality (the proposed trees are not native, please see the City's Native Plants Guide available at http://www.fcgov.com/naturalareas/native-plants.php for a more appropriate plant palette). Staff would be happy to meet with you to discuss these issues in more detail. Response: Additional trees and shrubs have been added to the 50’ buffer zone along the north property line. Thus, lighting from the parking areas or other site amenities shall not spill over to the buffer areas. The lighting plan must not allow for any foot candle spillage into the buffer zone, in addition to addressing zoning's comments below. Response: Ruud Lighting will revise the site lighting design so that there will not be any foot-candle spillage into the 50’ buffer zone from lighting installed as part of this development. Additional trees may be required between parking areas and the street. Review Parking lot Perimeter Landscaping standards 3.2.1 (E) (4) (a) (b) and how they may be applied to this project with the Project Planner. Response: Additional trees have been added to the landscape buffer between the parking areas and North College Avenue as required per Section 3.2.1 (E) (4) (a) (b) 2. Ohio buckeye is not well adapted to areas that are in parking lot islands or low water use areas. It is prone to leaf scorch in hot dry sites. Bur oak or Catalpa are good drought tolerant trees for these situations. Response: The Ohio Buckeyes have been replaced with Western Catalpas. 3. Douglas fir does not do as well as Austrian Pine or Blue Spruce on most Fort Collins sites. The latter two are more reliable over time as landscape trees. Response: The Douglas firs have been replaced by Blue Spruce. 4. Conifer trees need to be specified as 6 foot height B&B. Shrubs need to be specified as 5 gallon. Response: The landscape schedule found on Sheet PDP-C3.2 has been revised to specify 6 foot height B&B conifers and 5 gallon shrubs are to be installed. 5. Check trees species numbers for Minimum Species Diversity 3.2.1 (3) Response: I checked the tree diversity and it meets the City’s minimum tree diversity standards. I have added a tree diversity table to Sheet PDP-C3.2. 6. In phase 2 a tree could be added in the lawn area just to the NW of the new building located at the center of the project. Response: I added the suggested tree. 7. Add tree protection notes found in 3.2.1 (G) Response: See note #24 on Sheet PDP-C3.2. P.O. Box 270788. Add these landscape notes: • The soil in all landscape areas, including parkways and medians, shall be thoroughly loosened to a depth of not less than eight (8) inches and soil amendment shall be thoroughly incorporated into the soil of all landscape areas to a depth of at least six (6) inches by tilling, discing or other suitable method, at a rate of at least three (3) cubic yards of soil amendment per one thousand (1,000) square feet of landscape area. • A permit must be obtained from the City forester before any trees or shrubs as noted on this plan are planted, pruned or removed on the public right-of-way. This includes zones between the sidewalk and curb, medians and other city property. This permit shall approve the location and species to be planted. Failure to obtain this permit may result in replacing or relocating trees and a hold on certificate of occupancy. • The developer shall contact the City Forester to inspect all street tree plantings at the completion of each phase of the development. All trees need to have been installed as shown on the landscape plan. Approval of street tree planting is required before final approval of each phase. Failure to obtain approval by the City Forester for street trees in a phase shall result in a hold on certificate of occupancy for future phases of the development. Response: See Landscape Notes #2, #3, and #4 on Sheet PDP-C3.2. 9. The existing tree on the north edge of the property is a multi-stem Siberian Elm. This species is exempt from the tree retention requirements in 3.2.1. (F) The applicant has retained the tree in the design at their discretion. The tree has several years of maturity. The City Forester recommends that the applicant obtain additional information on the tree by having a private certified arborist evaluate the elm. This individual could provide information on the trees condition as it relates to suitability for retention, and identify needs for pruning, protection or other treatments that could improve its structure, function and survivability. Response: Duly noted. I will inform the Owner of your recommendation.
