Enlargement of Building Containing Non-Conforming Use
Request for an Enlargement of a Building Containing a Non-Conforming Use. The applicant would adding two bedrooms, a bathroom and closet to the
second floor of an existing dwelling unit located within a two-family dwelling (duplex). There would be no building expansion outside the existing
building footprint. The structure has been considered to be two-family dwelling since prior to the adoption of the Land Use Code in 1997. Located at
726 W. Mountain Ave., on the north side of West Mountain Ave., between N. Grant Ave. and N. Whitcomb St. Zoning is NCL - Neighborhhood

2 Electric [1/27/09] There is an ordinance from the 1970's that requires a separate
electric meter for each dwelling unit. However, this site is exempt from that
ordinance (it was 'grandfathered' since it was already a duplex when the
ordinance was approved). Although separate metering in this case is NOT
REQUIRED, the owner is encouraged to install separate electric meters as
an energy conservation measure. If any questions, please contact Doug

3 Electric [2/2/09] Could you please add the following notes to the plan:
Damaged curb, gutter, and sidewalk existing prior to construction, as well as
existing fences, trees, streets, sidewalks, curbs and gutters, landscaping,
structures, and improvements destroyed, damaged or removed due to
construction of this project, shall be replaced or restored in like kind at the
developer's expense, unless otherwise indicated on these plans, prior to the
acceptance of completeted improvements and/or prior to the issuance of the
first Certificate of Occupancy.
No work may commence within any improved or unimproved public
Right-of-Way until a Right-of-Way Permit or Development Construction
Permit is obtained, if applicable.

4 Electric [2/2/09] Upon final approval Engineering will need 2 copies of the signed
plans.
