Staff is recommending a condition of approval stating that No automobile display or parking can occur on the turf grass, landscape buffer areas between curbs internal to the site and the curbs on both West Drake Road and McClelland Drives'. Staff is also requiring that the wording of this condition be added to the Site and Landscape Plans before they are recorded by the City. 281 North College Avenue • P.O. The proposed landscaping ance on -site and on the periphery The site presently does not have any formal parking due to the use being a "drive-thru" operation. The new use is providing 50 parking spaces for automobile display and customer parking. 4. Neighborhood Compatibility: A neighborhood meeting was not held for this request. The Spradley- Barr (formerly Ghent) automobile dealership is a long-standing use in this commercial neighborhood and the proposed change in use will not create adverse impacts to the surrounding area. 5. Transportation: Access to this site will continue to be from West Drake Road, an arterial street, and a new curb cut on McClelland Drive, an arterial street. There are two existing curb cuts into West Drake Road that will be closed off to provide one curb cut centered on this use. The change in use to automobile display & sales is anticipated to decrease the average daily trips to and from this site compared to the traffic generated by a gas service station & car wash. RECOMMENDATION: This proposal is in compliance with Section 29-543 of the City of Fort Collins Zoning Regulations; therefore, staff recommends approval of the Spradley-Barr Isuzu, Non -Conforming Use - #16-93. Spradley-Barr Isuzu - Non Conforming Use, #16-93 April 26, 1993 P & Z Meeting Page 3 (2) The difference in quality and character of the proposed use; The change in use to automobile display & sales will operate on the same lot as the existing use. The new use will reuse the existing structure (requiring remodelling) and eliminate the gas pumps, underground gas storage tanks, and cashier's booth. The entire site is presently paved and does not have any landscaping. The new use will provide landscaping on three sides and in the interior parking areas. This will decrease the hard -surface, impervious area and soften the overall appearance of the site. (3) The difference in the degree of use of the proposed use, including but not limited to hours of operation and parking requirements; The owner has indicated that the proposed use will operate from 8:00 a.m. to 8:00 p.m. on weekdays and 8:00 a.m. to 6:00 p.m. on Saturday. The existing use is a "drive-thrull operation that requires virtually no parking. The new use is predominantly long-term parking of automobiles for display & sales. On -site customer parking must also be provided. (4) The reasons for the proposed change; The owner has indicated that the change in use is to provide needed area for display and sales of a new line of automobiles that the dealership is offering. (5) The overall impact of the proposed use on the surrounding property; Staff finds that the change of use as proposed, with the new access, driveway, and parking configuration, will not create adverse impacts to the surrounding area. The addition of landscaping on the north, south, and west sides of the site help mitigate adverse visual impacts. 3. Design• Architecture: The basic building configuration will not significantly change with the change in use of the property. The existing building is single - story with a gently sloped roof and is made of sandstone and concrete block. The concrete block portion of the building matches the large building to the east in both material and color. Physical changes will be the addition of windows and the closure of the north and south ends that presently access the car wash. Background• The surrounding zoning and land uses are as follows: N: HB; existing retail (K-Mart Plaza) S: IL; existing automobile storage (Spradley-Barr Ford) E: HB; existing automobile sales/service (Spradley-Barr Ford) W: RH; existing business offices (Drake Professional Park) The property was annexed into the City with the Ghent Annexation in June, 1966. This property was subdivided as the Ghent Subdivision in April, 1967. 2. Land Use: This is a request for a non -conforming use approval for a change in use from an existing gas service station & car wash to proposed automobile sales & service at 215 West Drake Road. The new display area for sales of Isuzu automobiles and the existing display area for sales of Ford automobiles are under one common ownership. The property fronts on West Drake Road and extends west from South College Avenue to McClelland Drive. Automobile sales & service are not a "use -by -right" in the HB, Highway Business Zoning District; therefore, the existing Ford automobile sales & service and gas service station & car wash are on -going non -conforming uses and the proposed Isuzu sales will be a change to a non -conforming use. Section 29-543. Change of use of the City Code requires that: a) A non -conforming use may be changed to any conforming use. Any change of a non -conforming use, other than to a conforming use, shall require the approval of the Planning and Zoning Board.
