This concludes Staff comments at this time. Please note the
following deadlines for the April 25, 1994 Planning and Zoning
Board meeting:
Plan revisions are due April 7, 1994.
P.M.T.'s, to prints, renderings are due April 18, 1994.
Please note that the Utility Plans, Drainage Report, Drainage and
Grading Plans will be reviewed by the Mike Herzig and Kerrie
Ashbeck of our office and comments may be forwarded to the
consulting engineer under separate cover. The Development
Agreement will be prepared our office after Utility Plans have been
revised accordingly.
As always, please call the Planning Department if you have any
questions regarding these comments.

Development Review Section will process the dedication of this
easement by separate legal instrument.
6. The request for the 35 foot wide curb cut on East Stuart
Street will be allowed.
7. In lieu of losing two evergreen trees between the structures,
it is recommended that one, 1 1/2 inch caliper Spring Snow
Crab be added to the Stuart Street frontage between the
intersection and the Hackberry.
8. Please add a note to the landscape plan that all landscape
material, including that which is planted in the public right-
of-way, is to be maintained by the owner.
9. Exterior walls located closer than 10 feet from property lines
shall be on one -hour fire resistive construction with
protected openings. No openings are permitted in walls
located closer than five feet from property lines. Parapets
extending 30 inches above the roof surface must be constructed
in accordance with Section 1710 of the Uniform Building Code.
10. Exterior routes of travel and parking facilities for use by
disabled persons shall be provided in accordance with the 1991
U.B.C. Appendix Chapter 31.
11. The P.U.D. site plan should make a distinction that this is
the Final for Lot One. This could be done by adding "Lot One"
to the title in the lower right corner of the sheet. In
addition, a thick line should separate the two Lots. Site
development data should refer to Lot One. A note should be
added stating that there is a previously approved separate
Final P.U.D. for Lot Two on file with the City of Fort
Collins. Signage details for Best Western Transmission should
be deleted. Note number seven should be deleted.
12. Is note number nine applicable for Lot One?
13. The owner's certification should include a notarial block.
14. The developer of Lot One is encouraged to work with the
Planning Department and the developer of Lot Two in order to
provide a unity of design for the free-standing signage along
College Avenue. Since these are two lots of the same P.U.D.,
it is desirable to have a cohesion in signage design within
such close proximity. It is suggested that areas of cohesion
between the Best Western Transmission sign and the sign for
Lot One could be found in terms of height, width, and use of
common base material. Staff is willing to work with the
applicant to find ways to promote design consistency within
the P.U.D. in terms of signage that provides identification
needs for the applicant.

Dear Al:
Staff has reviewed the request for Final P.U.D. for Lot One of the
Best Western Transmission P.U.D. at the southeast corner of South
College Avenue and East Stuart Street. The following comments are
offered:
1. Lot One will need to have a separate Utility Plan set with a
separate Development Agreement. Otherwise, the plans and
agreement for both lots must be combined and this may cause a
timing setback for Mr. Flowers. It is our assumption that Mr.
Flowers desires to seek a building permit for Lot Two as soon
as possible and that waiting for Lot One approval on April 25,
1994 would be unacceptable. This Utility Plan set must
include details on the removal and re -construction of the
driveways on College Avenue.
2. As you are aware, the immediate corner of College and Stuart
is to be re -constructed with the proper radius, sidewalk,
ramps, and removal and replacement of the traffic signal mast,
streetlight, and fire hydrant. These design details must be
shown on the Utility Plans.
3. The City's Street Oversizing Fund will reimburse the developer
of Lot One for improvements that are eligible to be paid for
by the City. The City will not reimburse for improvements
which are considered to be the obligation of the developer.
The Development Agreement will specify which improvements will
be paid for by the City, and which will not. Please note that
the City will not act as the general contractor but will only
disburse funds accordingly. The developer must act as the
general contractor.
4. U.S. West cautions that any relocation of existing telephone
facilities will be at the expense of the developer.
5. City of Fort Collins Light and Power Department will require
a six foot wide easement along the east property of Lot One.
Since this lot is already platted, this easement will have to
