Council gave a decision on the First Christian Church, Master Plan and First
Phase Preliminary Plan. As stated in the minutes, Curt Smith, City Director of
Planning, responded to Council inquiries regarding the Master Plan which would
grant the applicant a variance on the height, and permission to exceed City
standards on the entrance and exit drives, delay of construction of privacy fencing
until those areas are developed.
City Council approved the First Christian Church, Master Plan and First Phase
Preliminary Plan by a vote of 5-1.
The opinion of the City Attorney's Office is that the content of these documents substantiates
the First Christian Church position that City Council did, on the night of December 4, 1979,
approve the First Christian Church Master Plan and First Phase Preliminary Plan that does, in
fact, grant the. church an on -going variance on the building height and allow a 20 year building
program (expiring in the year 2000).
The First Christian Church Master Plan has a perpetual life but does not give a vested right to
allow construction on the site. The First Christian Church First Phase Preliminary Plan does not
give a vested right of construction. Vested rights are established with approval and recording of
final development documents. Preliminary and Final Phase Plans must subsequently be submitted
to the City for review, with all final decisions being given by the Planning and Zoning Board.
The architecture, landscaping, and parking are part of each phase plan review. To date, the
church has final approval for Phases One and) Two.

The Planning and Zoning Board approved this request (5-0) with the 5 conditions
and sent a recommendation of approval on to City Council.
B. Letter dated November 19, 1979, to Joe Frank of the Department of Planning and
Development, City of fort Collins, from the First Christian Church indicating that
the church agreed with the 5 conditions of approval recommended by staff.
Furthermore, their understanding was that with the Board Approval of the Master
Plan they were provided the following rights under a 20 year building program:
1) To exceed city standards for entrance/exit drive.
2) To delay construction of privacy fencing on the east property line until
such time that future parking lots in that proximity are developed.
3) To exceed the forty foot height restriction in the construction of the future
sanctuary/auditorium.
This letter requested that the church be notified in writing if any of the provisions
and conditions in the letter were not accurate. The letter was signed by Herbert
Spencer, Rex Anderson, and Robert Shields. There is no record of written
notification to the church in the Planning Department files.
C. Agenda Item Summary (AIS) prepared by John E. Arnold, City Manager, for the
December 4, 1979 City Council public hearing. The subject was:
* the Master Plan ... a preliminary P.U.D. proposal on 25.25 acres
consisting of a 136,293 sq. ft. church with accessory recreational facilities
and parking.
* First Phase Preliminary Plan of the First Christian Church ... 50,000 sq.
ft. of multi -purpose area: worship area (seating up to 1200 people),
recreation and kitchen, education area (approximate 700 seating capacity),
and gallery for meetings, exhibits, etc. Other: parking (385 spaces),
volleyball, and playing field.
The AIS gave the Planning and Zoning Board's recommendation, with the
aforementioned 5 conditions and a 6th condition attached. Condition 6 reads as
follows:
6) The Board was concerned about the 20 year phasing of the preliminary
plan and recommended that the developer request master plan approval for
the entire site, with preliminary plat approval for the first phase. At such
time as the applicants wish to construct the second phase of the project,
a preliminary plan would be submitted and following the normal
procedures and requirements of the P.U.D. regulations.

Re: First Christian Church, The Healing Place, Phase IV
Dear Carl,
In response to your letter of July 9, 1993, I have further reviewed the following documents
relative to your question of what was previously approved for the First Christian Church and the
status of the approval(s):
A. Planning and Zoning Matter #193-79, First Christian Church P.U.D. A
preliminary P.U.D. proposal on 25.25 acres consisting of a 136,293 sq. ft.
church with accessory recreational facilities and parking, zoned RLP, Low
Density planned Residential, and RP, Planned Residential districts, located on the
southeast corner of Lemay and Drake. This was a planning staff memo, with a
staff recommendation containing 5 conditions, for the Planning and Zoning Board
public hearing on November 15, 1979. The 5 conditions were:
1) That all parking lots meet the minimum design standards as specified by
city staff.
2) That a minimum 6' bike lane and 5' sidewalk be provided on both sides
of Drake Road and along Lemay Avenue.
3) That three additional landscaped islands be provided per staff comments.
4) That all hydrants and fire access roads be installed for each phase prior
to building construction.
5) That the developer work with City staff to develop an agreeable design
solution for the Lemay/Drake intersection.
