This may not be a problem depending on the owner's care. 16. The covenants include maintenance language. I request that we do the property line trees as each house is built, so that the trees have a chance to survive. We will do the fence first thing, as we have previously agreed, but these new trees will require weekly watering and we will not have a water source available close by until those three houses are built. Tim agrees this is the best solution. 20. My engineer refuses from a legal point of view, to do this. It is not proper to name a business on a plat. The business may be gone tomorrow. Engineers and others will be searching for a Horsetooth Stables Plat that doesn't exist. This should be labeled "Agricultural Use". Very truly yours, III �4. Mark Linder enc. Collins, CO 80524 Dear Kirsten: Enclosed, please find the revisions for my Lindimer Subdivision. Most of the items are on the drawings or in the drainage report. The following are additional responses or clarifications to your June 24 letter with comments. 1. I have met with Mark and talked with Suzanne Bassinger. It appears very unlikely that a satisfactory (to all parties) route across the stable property will be agreed upon. Mark told me to submit as designed and wants to have one last meeting with you, me, Suzanne, Mike or Kerry, and Dick next week. Could you please give me a day and time for you, Mike or Kerry, and Mark? I think the rest of us can adjust to that time with a little notice. 2. Enclosed are our red -lined covenants which address the various fencing, maintenance, and detention issues. We deleted the right to fence the front of the ponds (our mistake). Please have Kate review the HOA section concerning pond maintenance. This is a first draft, I would welcome any clarifications, expansion language, or corrections. 8. Bret and I intend to build out these lots ourselves and are aware of the limited building placements on those lots. Dick or I couldn't find a red -lined plat, but I have included a plat with my calculations of the building envelopes and 18 "typical" plans that fit most of the lots. We realize that lots 1 and 2 are tough and will require custom drawn houses and precise staking for excavation. These are not lots that will be for sale to an unsuspecting public, we are the builder and can deal with the setbacks and zoning requirements. I would be happy to meet with someone from zoning to discuss this. Our goal always has been to build small and affordable houses for first time buyers. 13. A dedication sentence has been added on the plat. 15. I spoke with Tim and discussed the need for a quick growing tree buffer. He OK'd the use of Sargentis cottonwoods, which are indigenous, broadleafed, and hardy. These trees are in backyards Specializing in Development Properties 309 W.
