Staff is recommending a condition stating that the property known as the Karl Peterson Annexation be placed in the Residential Neighborhood Sign District and be subject to all limitations and requirements of the district as defined in Sections 29-593 and 29- 593.1 of the City Code. Findinas: 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. On June 1, 1993, the City Council considered and approved a resolution determining that the proposed annexation is in compliance with State law. The resolution also initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. Public hearing and first reading of the Ordinances annexing and zoning the property will be considered by the City Council on July 6, 1993. 4. The requested RLP, Low Density Planned Residential District is in conformance with the policies of the City's Comprehensive Plan. Staff is recommending a condition that the property be placed in the Residential Neighborhood Sign District that was approved by City Council and put into effect on January 15, 1993. STAFF RECOMMENDATION: Staff recommends approval of the annexation and requested zoning with the following condition: 1. The property known as the Karl Peterson Annexation be placed in the Residential Neighborhood Sign District and be subject to all limitations and requirements of the district as defined in Sections 29-593 and 29-593.1 of the City Code. Karl Peterson Annexation and Zoning - #29-93,A June 28, 1993 P & Z Meeting Page 2 Background: The applicants Karl R. and Ruth S. Peterson, being the property owners, have submitted a written petition requesting annexation of 3.0259 acres located on the south side of West Drake Road approximately 1/2 mile west of South Taft Hill Road. The applicants are requesting that this property be placed in the RLP, Low Density Planned Residential District with a Planned Unit Development (P.U.D.) condition attached. The property is currently a residential use and is zoned FA-1, Farming in Larimer County. This is a 100% voluntary annexation. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will agree to consider annexation of property when the property is eligible for annexation according to State law. This property gains the required 1/6 contiguity to existing City limits from a common boundary with the Manion Annexation to the south and east, Dixon Creek Annexation to the west, and Herring Annexation to the north. The surrounding zoning and existing land uses are as follows: N: RL; existing single family residential (Brown Farm) S: RLP; proposed single family residential (Fox Creek P.U.D.) E: RLP, FA-1; proposed single family residential in the City (Fox Creek P.U.D.) and existing single family residential in Larimer County W: rp; existing single family residential in the City (Quail Hollow) zoning: The applicants are requesting that this property be placed in the RLP, Low Density Planned Residential District with a Planned Unit Development (P.U.D.) condition attached. The RLP District is for areas planned as a unit to provide variation in use, density and building placement. The property is currently being used as a residence. Effective January 15, 1993, the Residential Neighborhood Sign District was established to regulate signage of non- residential uses in areas of the City which may be impacted by signage because of their predominantly residential use or character. The district includes neighborhood service centers, neighborhood convenience shopping centers, business services uses, and auto -related and roadside commercial areas that are in proximity to existing or planned residential areas.
