Mayor ATTEST: ty Cl e ~+c ORDINANCE NO. 97, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE RICKETTS SECOND ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Resolution 93-118, finding substantial compliance and initiating annexation proceedings, has heretofore been adopted by the Council of the City of Fort Collins; and WHEREAS, the Council does hereby find and determine that it is in the best interests of the City to annex said area to the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. Section 3. That the City hereby consents, pursuant to Section, 37-45-136(3.6), C.R.S., to the inclusion of said property into the Municipal Subdistrict, Northern Colorado Water Conservancy District. RESOLUTION 93-118 OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS REGARDING THE RICKETTS SECOND ANNEXATION WHEREAS, annexation proceedings were heretofore initiated by the Council of the City of Fort Collins for property to be known as the Ricketts Second Annexation; and WHEREAS, following Notice given as required by law, the Council has held a hearing on said annexation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Council of the City of Fort Collins hereby finds that the petition for annexation complies with the Municipal Annexation Act. Section 2. That the Council hereby finds that there is at least one -sixth (1/6) contiguity between the City and the property proposed to be annexed; that a community of interest exists between the property proposed to be annexed and the City; that said property is urban or will be urbanized in the near future; and that said property is integrated with or is capable of being integrated with the City. Section 3. That the Council further determines that the applicable parts of said Act have been met, that an election is not required under said Act and that there are no other terms and conditions to be imposed upon said annexation. Section 4. That the Council further finds that notice was duly given and a hearing was held regarding the annexation in accordance with said Act. Section 5. That the Council concludes that the area proposed to be annexed in the Ricketts Second Annexation is eligible for annexation to the City and should be so annexed. Mayor ATTEST: City Clerk DATE: August 17, 1993 2 ITEM NUMBER:14 a-c Ricketts First Annexation, is in the process of being annexed simultaneously with the Ricketts Second Annexation. The property to be annexed is made up of one parcel under single ownership. This annexation is a 100% voluntary annexation. The current owners are: Van and Norma Ricketts 4700 Cambridge Ave. Fort Collins, CO 80525 Zoning The property is currently zoned FA-1, Farming, in the County. The proposed zoning for this annexation is EP, Employment Park, due to its proximity to the Harmony Road corridor. The EP District designation is for areas of the city which have been designated and planned as "employment parks" in accordance with the city's comprehensive plan and which are used for a variety of activities including, without limitation: industrial uses, shopping centers and residential dwellings. The zoning designation is in accordance with policies of the Harmony Corridor Plan. Property to the north of Harmony Road, zoned IL, is developed with the Hewlett- Packard industrial facility. Properties to the south, east, and west are in the County and are zoned FA-1, Farming. Surrounding land uses include large vacant parcels and large lot (2.5 to 5 acre) residential lots. The property immediately to the north is being annexed simultaneously as Ricketts First Annexation and Zoning with proposed zoning of EP. Staff is recommending the EP Zone for this property as well. The proposed zoning is compatible with the surrounding zoning and land uses. Findings The annexation of this property is consistent with the policies and agreements between Larimer County and the City of Fort Collins as contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for annexation to the City of Fort Collins. 3. Notice of Public Hearing for the Annexation and Zoning Ordinance was published on July 11, 1993. 4. The requested zoning of EP, Employment Park, is in conformance with the policies of the City's Land Use Policies Plan, the Harmony Corridor Plan, and the Intergovernmental Agreement. The requested zoning is compatible with the surrounding zoning districts and existing land uses. RECOMMENDATION: Staff recommends approval of the annexation and requested zoning. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board, at its regular monthly meeting of June 28, 1993, voted 7-0 to recommend approval of the requested annexation and zoning. RECOMMENDATION: Staff recommends approval of the annexation and zoning request. The Planning and Zoning Board voted 7-0 to recommend approval of the annexation and zoning request at its regular monthly meeting on June 28, 1993. EXECUTIVE SUMMARY: A. Resolution 93-118 Setting Forth Findings of Fact and Determinations Regarding the Ricketts Second Annexation. B. Hearing and First Reading of Ordinance No. 97, 1993, Annexing Approximately 2.065 Acres, Known as the Ricketts Second Annexation. C. Hearing and First Reading of Ordinance No. 98, 1993, Zoning Approximately 2.065 Acres, Known as the Ricketts Second Annexation. This is a request to annex and zone approximately 2.065 acres, located on the south side of East Harmony Road, approximately one half mile east of Timberline Road (County Road 11), at Cambridge Avenue. The property is currently vacant. The proposed zoning is EP, Employment Park. This is a 100% voluntary annexation. The proposed annexation and zoning is in conformance with the City's policies and guidelines and meets the criteria included in State law to qualify for annexation. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will agree to consider for annexation property in the UGA when the property is eligible for annexation according to State law. One sixth of the property boundary is contiguous to City limits, through the proposed Ricketts First Annexation, therefore the property is eligible for annexation to the City of Fort Collins.
