HomeMy WebLinkAboutFOX HILLS ANNEXATION AND ZONING - 36 93A AND B - REPORTS - SECOND READINGNo Text DATE: February 15, 1994 3 I ITEM NUMBER: 14 A-C PLANNING AND ZONING BOARD RECOMMENDATION The Planning and Zoning Board, at its regular monthly meeting of January 24, 1994, voted 7-0 to recommend approval of the Fox Hill Annexation and zoning request as part of the Board's Consent Agenda. DATE: February 15, 1994 I 2 I ITEM NUMBER: 14 A-C According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the County will not accept a development proposal for a property which is eligible for annexation according to State law. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the UGA Agreement, the City will consider the annexation of property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundaries with the Taft Canyon Second Annexation to the east. The surrounding zoning and existing land uses are as follows: N: R, Residential, Springfield Subdivision E: R, Residential, Taft Canyon Subdivision S: FA-1, Westridge Estates Subdivision W: FA-1, various exemptions and Minor Residential Developments (MRDs) The requested zoning for this annexation is the R-F, Foothills Residential District. The R-F District designation is for low density residential areas located near the foothills. The property will probably develop under the Cluster Development option contained in the R-F Zone. The Cluster Development option allows a gross density of one (1) unit per acre with the units clustered together on portion of the property at a density of three (3) to five (5) units per acre. The remainder of the property must be permanently preserved as open space in a manner acceptable to the City. According to policies and agreements between the City of Fort Collins and Larimer County contained in the UGA Agreement, the foothills area, due to the environmental uniqueness of the area, is not appropriate for urban densities (three or more units per acre). The City's R-F Zone was specifically designed to be applied to properties near the foothills when they annexed into the City. Development in the R-F Zone is limited to single-family residential uses, schools, churches, and group quarters. Findings 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. On January 4, 1994, the City Council approved a resolution which accepts the annexation petition and determines that the petition is in compliance with State law. The resolution also initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. Public hearing and first reading of the Ordinances annexing and zoning the property will be considered by the City Council on February 15, 1994. 4. The requested R-F, Foothills Residential District is in conformance with the policies of the City's Comprehensive Plan. STAFF RECOMMENDATION Staff recommends approval of the annexation and requested zoning. This is a request to annex and zone approximately 33.17 acres located west of Taft Hill Road and south of County Road 38E. The requested zoning is the R-F, Foothills Residential, District. The property is presently undeveloped. The property is currently zoned R, Residential in the County. This is a voluntary annexation. Collins, CO 80526 BACKGROUND: The applicant and owner, the Springfield Subdivision Sixth Filing, Joint Venture, has submitted a written petition requesting annexation of approximately 33.17 acres located west of Taft Hill Road and south of County Road 38E. The requested zoning is the R-F, Foothills Residential, District. The property is presently undeveloped. The property is currently zoned FA-1 in the County. This is a voluntary annexation. On February 15, Council unanimously adopted Resolution 94-24 Setting Forth Findings of Fact and Determinations Regarding the Fox Hills Annexation. On February 15, Council also unanimously adopted Ordinance No. 15, 1994 and Ordinance No. 16, 1994 which annex and zone approximately 33.17 acres located west of Taft Hill Road and south of County Road 38E. The requested zoning is the R-F, Foothills Residential, District. The property is presently undeveloped. The property is currently zoned R, Residential in the County. This is a voluntary annexation.
